WHEREAS the City of Pickering notified the Region of Durham that it would not to be a
'participating' municipality in the eg~on s acceptance of all waste management powers
as the matter was under review; and
WHEREAS the City of Pickering has undertaken a pilot project for the curb side
collection of organics and expanded recyclables which has achieved a diversion rate of
over 60% in the test community of Amberlea; and

WHEREAS the Region of Durham stands to financially benefit from the diversion of
waste from landfill as it will not have to pay to dispose of that waste: and
WHEREAS the City of Picketing is currently contracting Miller Waste to provide waste
collection services and the Region of Durham is proposing to use the same comractor for
the provision of Regional waste services: and
WHEREAS the Region of Durham can better achieve economies of scale in the
contracting out of waste services; and
WHEREAS it is highly desirable to achieve a high degree of waste diversion across the
Region and not just in one or two municipalities: and
WHEREAS the City of Pickering does not have the financial capacity to implement an
organic curb side collection service or expand the current list of recyclable materials; and
WHEREAS

having two levels of government deliver waste services is confusing to the
means that adoption of change is slow and conflicted by competing
NOW THEREFORE the Corporation of the City of Pickering advises the Region of
Durham that it agrees in principal to being a 'participating' municipality in the Region's
acceptance of all waste managemem powers subject to the following:
1. Pickering's participation is comingent upon the provision of curb side organic waste
collection and expanded recyclables (similar to what is currently provided to the
residents of Amberlea in the City of Pickering's waste diversion pilot project)
effective upon the Region's assumption of all waste services.
2. A commitment to achieve a waste diversion ratio greater than 50% across the
participating municipalities be made effective from the period of implementation.
3. Additional cost for the provision of new diversion._ efforts be fully borne by the
Region of Durham as it will have offsetting cost decreases fi.om reduced disposal
costs.
4. The City of Pickering have input into the process and practices the Region of Durham
will employ in the delivery of waste management services both through meetings
with staff, council and the broader public before agreeing to forfeit its jurisdiction
over waste; and
FURTHER THAT the appropriate staff of the City of Pickering work with staff of the
Region of Durham with the goal of successfully negotiating the conditions set out in this
resolution; and
FURTHER THAT this motion be circulated to the other municipalities within the Region
of Durham and that they be encouraged to pass similar motions to effect positive change
across the Region.

That the Committee of the Whole of the City of Pickering having met on April 8, 2002, presents
its fourth report to Council and recommends:
MAYORS REPORT 01-02
CANADIAN ASSOCIATION OF NUCLEAR HOST COMMUNITIES
-MEMBERSHIP IN ASSOCIATION
That City Council receive for information, Report to Council MO 01-02 concerning
the Canadian Association of Nuclear Host Communities; and
That City Council endorse Pickering's membership in the Canadian Association of
Nuclear Host Communities, as a Class A voting member, generally as described in
the final draft documents submitted by the Municipality of Kincardine and attached as
Attachment No. 1 to Report to Council MO 01-02; and that the appropriate City
officials be authorized to finalize and execute these documents.
That Mayor Arthurs be appointed as the City's representative on the Board of
Directors of the Canadian Association of Nuclear Host Communities, and that
Councillor Holland be appointed as the City's alternative representative, tbr a term to
coincide with the current term of Council.
That a copy of Report to Council MO 01-02 be ibrwarded to the Mulficipality of
Kincardine, the Municipality of Clarington, the Town of Deep River, Gentilly District
(Becancour, PQ), and Point Lepreau (Muscuach Parish, NB).

That the Council of the City of Pickering approves the recommendation of the PAW Joint
Animal Control Committee dated March 20, 2002 respecting improvements to animal
services.

NOXIOUS WEEDS
That Report CL 08-02 regarding Noxious Weeds be received; and
That the Council of the Corporation of the City of Pickering authorizes the
publication of a Public Notice regarding the destruction of weeds under the provision
of the Weed Control Act, R.S.O. 1990 Chapter W.5 of the Province of Ontario and
directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be
destroyed in such a manner as they may deem proper; and
That the expenses incurred by the said Weed Inspectors in the discharge of their
duties shall be placed on the Collector's Roll of the City of Picketing against the
respective parcels concerned and that such amount shall be collected in the same
manner as taxes under the Municipal Act.

Being a By-law to amend Restricted Area (Zoning) By-law 2511, as mnended, to
implement the Official Plan of the City of Pickering District Planning Area,
Region of Durham in Part of Lot 18, Concession 1, City of Picketing.

WHEREAS the Council of the Corporation of the City of Pickering deems it desirable to add a
manual car wash and / or automatic car wash facilities to the permitted uses on the subject lands,
being Part of Lot 18, Concession 1, City of Pickering;
AND WHEREAS an amendment to By-law 2511, as amended, is therefore deemed necessary:
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:

The provisions of this By-law shall apply to those lmlds in Part of Lot 18, Concession 1
in the City of Pickering, designated "CA(F)-1", on Schedule I attached hereto.

GEN EI-kM. PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved or
structurally altered except in conformity with the provisions of this By-law.
DEFINITIONS
In this By-law,
(1)
"Automobile Service Station - Type F" shall mean an establishment where
vehicle fuels, lubricants, and automobile-related accessories are offered for retail
sale, and which also may include one mechanical and\or one manual car wash and
limited convenience retail sales, but shall not include facilities for the repair and
maintenance of vehicles, or facilities for the repairing or painting of vehicle
bodies;
(2)
"Build-to-Zone" shall mean an area of land within which all or part of a building
or buildings are to be located;
(3)
"Gross Leasable Floor Area" shall mean the aggregate of the floor areas of all
storeys above or below established grade, designed for owner or tenant occupancy
or exclusive use only, but excluding storage areas below established grade;
(4)
(a)
"Lot" shall mean an area of land fronting on a street which is used or
intended to be used as the site ora building, or group of buildings, as thc case
may be, together with any accessory buildings or structures, or a public park
or open space area, regardless of whether or not such lot constitutes the
whole of a lot or block on a registered plan of subdivision;
(b) "Lot Area" shall mean the total horizontal area within the lot lines ora lot;
(c) "Lot Frontage" shall mean the width of a lot between the side lot lines
measured along a parallel to and 7.5 metres distant from the front lot line;

"Manual Car Wash" shall mean an establishment where self service facilities are
provided tbr the washing and cleaning of vehicles by hand labour methods using
sprayers, vacuums and other similar devices:
"Mechanical Car Wash" shall mean an establishment where facilities are provided
l'or the washing and cleaning of vchicles using production line methods
employing mechanical devices wholly enclosed within a building;
"Restaurant - Tvp~ F" shall inean a building or part of a building where Food is
prepared and offered or kept f'or retail sale to the public for immediate
consumption on the premises or off the premises, or both on and off the premises.

"Yard" shall mem~ an area of land which is appurtenant to and located on the
same lot as a building or structure and is open, uucovercd and unoccupied
above ground except for such accessory buildings, structures, or other uses as
are specifically permitted thereon;
"Front Yard" shall mean a yard extending across the £ull width of a lot
between thc front lot tine of thc lot and the nearest wall of the nearest main
building or structure on the lot;
(c)
"Front Yard Depth" shall mean thc shortest horizontal dimension of a front
yard of a lot between the fi'ont lot and the nearest wall of the nearest lnain
building or structure on thc lot:
(d)
"Rear Yard" shall mean a yard extending across the full width of a lot
between the rear lot line of thc lot. or where there is no rear- lot line, the
junction point of tiao side lot lines, and the heal-est wall of the nearest main
building or structure on the lot;
(e)
"Rear Yard Depth" shall mean tile shortest horizontal dimension of a rear
yard of a lot between tile rear lot line c0t' the lot. or where there is no rear lot
line, the junction point of the side lot lines;
(0
"Side Yard" shall mean a yard of a lot exten_ding from the front yard to t}~e
rear yard and from the side lot line to the nearest wall of the nearest main
building or structure on the lot;
(g)
"Side Yard Width" shall mean the shortest hori×ontal dimension of a side
yard of a lot between the side lot line and the nearest wall of the nearest main
building or structure on the lot;
(h) "Flanka~e Side Yard" shall mcan a side yard imnlediately adjoining a street
or abutting on a reserve on tile opposite side o1-which is a street;
(i)
"Flankao_c Side Yard x, Vidtlq" shall mean the shortest horizontal dimension of
a flankage side yard of a lot betxveen thc lot linc adjoining a street or abutting
on a reserve on thc opposite side of which is a street and the nearest wall of
tile nearest main builcting or structure on the lot: and
(j) "Interior Side Yard" shall mean a side xard other than a flmzkage side yard.

PROVISIONS

Uses Permitted ("CA(F)-I" Zone)
No person shall within the lands designated "CA(F)-I" on Schedule ! attached
hereto use any lot or erect, alter or use any building or structure for any purpose
except the following:
(a) automobile service station -Type F
(b) restaurant - Type F
Zone Requirements ("CA(F)-1" Zone)
No person shall within the lands designated "CA(F)-I" on Schedule I attached
hereto use any lot or erect, alter or use any building except in accordance with the
following provisions:

Buildings and structures shall comply with the minimum setbacks
illustrated on Schedule I attached hereto;
A minimum of 40% of the length of the build-to-zones, as
illustrated on Schedule I attached hereto, shall contain a building
or buildings, or part of a building or buildings;
Despite paragraph A above, a manual car wash facility shall only
be permitted on the lands diagonally hatched on Schedule 1
attached hereto;
(ii) Building Height:
A maximum of 12.0 metres;
B minimum of 5.0 metres in any build-to-zone;
C
Despite B above, the minimum building height for a mechanical
car wash facility shall be 6.0 metres;
(d) PARKING REQUIREMENTS:
(i) There shall be provided and maintained on the lands designated
"CA(F)-I" on Schedule I attached hereto, a minimum of:
A
8.0 parking spaces per 93 square metres of gross leasable floor area
provided for all restaurants - Type F
B 10 parking spaces for any automobile service station Type F
(ii)
Clauses 5.21.2a) to 5.21.2e), inclusive, of By-law 2511, as amended,
shall not apply to the lands designated "CA(F)-I" on Schedule I attached
hereto;

(iii) Notwithstanding clauses 5.21.2g) and 5.21.2k) of By-law 2511, as
amended, all entrance and exits to parking areas and all parking areas
shall be surfaced with brick, asphalt, or concrete, or any combination
thereo
SPECIAL REGULATIONS:
The aggregate of thc gross leasable floor area of all restaurants - Type F
shall not exceed 300 square metres;
(ii) The maximum gross leasable floor area of m~y kiosk associated with tile
automobile service station - T.Wc F shall not exceed 19() square metres;
(iii)
A maximum of one automobile service station - Type F shall be
permitted on thc lands designated "CA(F)-I" on Schedule I attached
hereto;
(iv) All uses, other than parking, shall take place entirely within enclosed
buildings or structures with no outside storage or display;
Despite section 5.(2)(e)iiv) above, a maximum area of 10.0 square
metres may be used For the outdoor storage or display of limited
convenience items accessory to an automobile service station - Type F;
(vi)
Despite section 5.19{a)(provisions for accessory structure location)of
By-law 2511, as amended, and section 5.(2)(c)(i)A of this By-laxv, one
garbage enclosure not exceeding 15.0 square inetres ill size may be
located in the interior side Nard a minimum o£ 0 metres From that

BY-LAW 2511
By-law 4989/97 is hereby repealed.
By-law 2511, as amended, is hereby further amended only to the extent necessary
to give effect to the provisions of this By-lax',- as it applies to tile area set out in
Schedule I attached hereto. Definitions and subject matters not specifically dealt
with in this By-law shall be governed by relevant provisions ot' By-law 2511, as
amended.
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.

Being a by-law to amend By-law 44/74 and
repeal By-law 3929/92 (Lottery Licencing)
to provide for increased lottery licence fees.
WHEREAS the Council of the Corporation of the Town of Picketing enacted By-law Number
44/74 on April 22, 1974 to licence and regulate lotteries; and
WHEREAS the Council of the Corporation of the Town of Pickering enacted By-law Number
3929/92 on February 3, 1992 to increase lottery licence fees; and
WHEREAS Section 23 of the Order-in-Council 2688-93 effective October 27, 1993, increased
thc maximum prize values and maximum licence fees; and
WHEREAS it is deemed expedient to amend By-law Number 44..74. as amended, to standardize
the fees for the various classes lotteries and increase fees for some classes of lotteries:

Being a by-law to appoint By-law Enforcement Officers
for certain purposes (Parking Regulation -1330 Altona
Road and Pickering Town Centre)
WHEREAS pursuant to section 15(i) of the Police Services Act., R.S.O. 1990, c.P.15, as
amended, a municipal council may appoint persons to enforce the by-laws of the municipality
and
WHEREAS pursuant to section 15(2) of the said Act, municipal by-law enforcement officers are
peace officers for the purpose of enforcing municipal by-laws;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
That the following persons be hereby appointed as municipal law e~orcement officers in
and for the City of Pickering in order to ascertain whether the provisions of By-law
2359/87 are obeyed and to enforce or carry into effect the said By-law and are hereby
authorized to enter at all reasonable times upon lands municipally known as:
a) 1330 Altona Road:

The authority granted in section 1 hereto is specifically limited to that set out in section 1,
and shall not be deemed, at any time, to exceed the authority set out in section 1.
These appointments shall expire upon the person listed in_ section l(a) ceasing to be an
employee of Direct Services Limited or upon Direct Services Limited ceasing to be an
agent of 1330 Altona Road, or the persons listed in section l(b) ceasing to be an
employee of Pickering Town Centre, or upon whichever shall occur first.

NOTICE OF MOTION

WHEREAS the City of Pickering notified the Region of Durham that it would not to be a
'participating' municipality in the Region's acceptance of all waste management powers
as the matter was under review: and
WHEREAS the City of Pickering has undertaken a pilot prqiect lbr the curb side
collection of organics and expanded recvclables which has achieved a diversion rate of
over 60% in the test community of Amberlea: and
WHEREAS the Region of Durham stands to financially benefit from the diversion of
waste from landfill as it will not have to pay to dispose of that waste; and
WHEREAS the City of Pickering is currently contracting Mi~er Waste to provide waste
collection services and the Region of Durham is proposing to use the same contractor for
the provision of Regional waste services: and
WHEREAS the Region of Durham can better achieve economies of scale in the
contracting out of waste services: and
WHEREAS it is highly desirable to achieve a high degree of waste diversion across the
Region and not just in one or tv,'o municipalities: and
WHEREAS the City of Pickering does not have thc financial capacity to implement an
organic curb side collection service or expand the currcm list of recvclable materials; and
WHEREAS having two levels of government deliver waste services is confusing to the
public and means that adoption of change is slow and conllicted by competing
jurisdictions:
NOW TttEREFORE the Corporation of the Cit~ o1' Pickering advises the Region of
Durham that it agrees in principal to being a ~participating' municipality in the Region's
acceptance of all waste management powers subject to the tbllowing:
1. Pickering's participation is contingent upon the provision of curb side organic
waste collection and expanded recyclables (similar to what is currently provided
to the residents of Amberlea in the City of Pickering's waste diversion pilot
project) effective upon the Region's assumption of all waste services.
2. A commitment to achieve a waste diversion ratio greater than 50% across the
participating municipalities be made effective from the period of implementation.
3. Additional cost for the provision of new diversion efforts be fully borne by the
Region of Durham as it will have offsetting cost decreases from reduced disposal
costs.
4. The City of Pickering have input into the process and practices the Region of
Durham will employ in the delivery of waste management services both through
meetings with staff, council and the broader public before agreeing to tbrt~it its
jurisdiction over waste; and
FURTHER THAT the appropriate staff of the City of Pickering work with staff of the
Region of Durham with the goal of successfully negotiating the conditions set out in this
resolution; and
FURTHER THAT this motion be circulated to the other municipalities within the Region
of Durham and that they be encouraged to pass similar motions to effect positive change
across the Region.
