This billing will raise approximately $15.4 million m property taxes for the City, Durham Region and School Boards. EXECUTIVE SUMMARY: Adoption of the above recommendations and passing the attached By-Law provides for the final 2001 tax billing for the commercial, industrial and multi-residential properties. Bill 140 Statistics Bill 140 basically limits the 2001 tax increase to 5(I,, Iofttne £t)(}/} taxes) plus thc municipal budgetary increase. In other words, Bill 140 puts a cap or ceiling on municipal tax increases. The cost of capping protection is funded v,-itb-in the same property tax class. This means that the capping protection provided to fine industrial tax class is "paid for" by clawing back or v,'ittn tnolding assessment related property decreases from industrial property owners. OO4 Report to Council CS 23-01 Subject: 2001 Final Tax Due Date for Commercial, Industrial & Multi-Residential Realty Tax Class Date: September 4. 2001 Page 3 The Multi-Residential realty tax class experienced a significant increase in assessment value as a result of the Province Wide Re-Assessment. (The re-assessment was based on the change in valuation dates from June 30, 1996 to June 30, 19993 Multi-residential buildings are assessed using the income approach and with the change in rent controls, their incomes have increased and therefore, increased their assessment value. The higher assessment values increased the amount of capping protection required due to the fact municipal taxes were generally capped at 5% increase over last year. As a result of the higher assessment and 5% cap, there was a shortfall of approximately $2 million (Region wide) to fund the required capping protection. In order to decrease the amount of capping protection, the multi-residential tax ratio was reduced from 2.7103 to 2.4900. The lowering of the tax ratio translated into a lower tax rate that reduced the number of properties and dollar amount requiring capping protection. The multi-residential tax ratio was calculated to create a tax neutral position from a funding perspective between the capped and clawbacked properties. Therefore, the 100% clawback percentage as shown in Table One reflects the tax neutral position. For the industrial realty tax class, the municipal budgetary increase could not be allocated to this group due to the fact this tax class was hard capped. The term "hard capped" refers to the tax condition where the tax ratio of realty tax class is above the Provincial Average. For the 2001 taxation year, the Durham Region industrial tax ratio of 2.98 was above the Provincial average ratio of 2.63. Therefore, the budgetary increases of the Region of Durham and City of Pickering were allocated to the other realty tax classes. The end result is that less capping protection was required due to the hard cap that translated into a lower clawback percentage as reflected under Table One. The increase in the commercial clawback is mainly due to the change in the vacancy methodology and recent Assessment Review Board decisions. Prior to Bill 140, any business property or unit that was classified as vacant received a reduction in their tax rate of 30% for commercial or 35% for industrial. For the 2001 taxation year, all commercial and industrial properties are reflected as fully occupied and therefore, attract a higher tax rate and require more capping protection. (Property owners have to apply for the vacancy rebate.) The increase cost of capping protection requires more funding from the clawback property owners. Within each realty class there are tax reductions and increases due to capping protection. Table Two provides a detailed breakdown regarding tax shifts among the various realty classes. The "shortfall" of $1,528,804 will be provided for by a transfer of funds from the Region similar to 1998 and 1999 when residential properties in Picketing assisted in funding shortfalls mainly in Oshawa and Whitby. Being a by-law of The Corporation of the City of Picketing to levy the FINAL commercial, industrial and multi-residential taxes for the year 200l. WHEREAS the Regional Municipality of Durham has passed By-law No. 47-2001 to establish tax ratios and By-Law 42-2001 to adopt estimates of all sums required by The 7Regional Municipality of Durham for the purposes of the Regional Corporation and By-Law 45-2001 to set and levy rates of taxation for Regional Solid Waste Management and By-laws No. 44-2001 to set and levy rates of taxation for Regional General Purposes and set tax rates on Area Municipalities; and, WHEREAS Provincial Regulations require reductions in taxes for certain classes and or subclasses of property; and, WHEREAS the Regional Municipality of Durham has passed By-law No. 65-98 opting to have the optional property classes consisting of the office building property class, shopping centre property class and large industrial property class within the Region of Durham: and. Plan 40R-XXXX/north side of Commerce Street) are no longer required by the Corporation and should be sold. In this instance, because the portion of land is laid out as public highway, the process to sell the propeny must be in accordance with the Municipal Act, which takes precedence over tine City's Sale of Surplus Land Policy. BACKGROUND: The subject lands were laid out as pan of Pleasant Street pursuant to Plan 65. While the subject lands have never been opened or travelled upon, the lands are considered to be public highway pursuant to the Surveyors Act. This parcel of land is approximately 66' wide x 146' deep, making it a building lot that possesses the same characteristics as those in the neighbourhood. The zoning of this parcel of land would be the same as the abutting parcels of land which is "R4"-Detached dwelling; Fourth Density Zone, By-law 2511, permitting the development of one detached residential unit. 010 Report to Council L 18-01 Subject: Road Closing/Disposal of Lands Date: July 30, 2001 Page 2 Zoning By-law 2511 contains a provision which states, in part: "in the event of any street or lane shown ............... ix being closed, the property jbrmerly in said closed street or lane shay be included in the zone of the adjoining property of either side of the said street or lane." Council should note that, as the subject lands constitute a public highway, the road closing process, as governed by the MUnicipal Act, takes precedence over the Sale of Surplus Land Process. As such, section 315(2) of the MunicipalAct states, in part: "The Council shall by by-law set the sale price of the lan& to be sold and shall of[er to sell it to the owner o. f the land abutting the land to be sold and where there are parcels of land abutting on opposite sides of the land to be sold. the owner of each parcel has the right O/first refusal to purchase the land to its middle line." As it is staff's intention to get the full appraised value for this property, the conditions of sale would include: (a) the conveyance of both parts, half to each adjacent owner; (b) the conveyance of both parts to one adjacent owner, in the event the other owner waives their right to purchase their half: or (c) the conveyance of both parts to an independent purchaser, in the event both adjacent owners waive their right to purchase the lot as a whole. The appropriate notice has been published once a week for four consecutive weeks and the provisions of the Municipal Act relating to the stopping-up and closing of a highway have been complied with. It is therefore recommended that: 1) a by-law be enacted to dedicate those parts of Pleasant Street, Plan 65, Pickering, designated as Parts 1 and 2, Plan 40R-XXXX as public highway (north side of Commerce Street); 2) a by-law be enacted to stop-up and close those parts of Pleasant Street, Plan 65, Pickering, designated as Parts 1 and 2, Plan 40R-XXXX for the purpose of sale in accordance with provisions of the Municipal Act. 3) the Mayor and Clerk execute all necessary documentation relating to the stopping-up, closing and sale of this road. In October 1994, at the 44th Session of the International Conference on Education in Geneva, UNESCO designated October 5 as World Teachers' Day. It was also recommended that this be an annual event. The date is the anniversary of the adoption of the 1966 Recommendation on the Status of Teachers. The United Nations agency has designated a World Teachers' Day to recognize the work of teachers, and the role they play in shaping our collective future. In 1998-99 Ontarians spent o total of 561,433 days in hospital because of injuries due to unintentional falls, while in Durham Region 555 residents 65 years and older were hospitalized as a result of an injury from falling. The majority of unintentional injuries suffered by seniors occur in their homes (53%). For the fourth year in o row, the Durham Region Health Department, Falls Prevention Workgroup, Injury Prevention Program is planning a public awareness campaign for the week of October 15-21, 2001.
