It is recommended that Report CS l l-O1 of the Director, Corporate Services & Treasurer
be received and that:
a grant be provided to those organizations that provide free youth programs, have a
dedicated centre with dedicated space and the grant be provided to those
organizations that are registered charitable organizations that qualify under subsection
248(1) of the Income Tax Act (Canada) with eligibility to be annually confirmed by
application;
a maximum grant in the amount of $5,000 per year be provided and the amount of the
grant be reduced by the amount an organization may receive from the Charity
Property Tax Rebate Program;
3. that this grant be charged to Account 2195 (Grams to Organizations and Individuals):
4. that a grant be provided to the Edge Youth Centre and Family & Youth Action Centre
as these two organizations meet the criteria as established under Recommendation # 1;

that the Region of Durham be requested to offer a grant (in addition to the Charity
Property Tax Rebate Program) that is at least equal to the City of Pickering's

EXECUTIVE SUMMARY:
At the January 15th, 2001, Council meeting, Council passed Resolution#3/01(b) asking staff to
prepare a report on providing assistance to youth organization. The above grant is a component
of the City's Youth Partnership Initiative Program.
BACKGROUND:
At its meeting of January 17, 2001, Council passed Resolution#3/01(b) as follows:
"That the following three paragraphs be referred to staff for a report to be prepared and brought
back to Council; said report to include the implications respecting donations:
THAT the Corporation of the City of Pickering give a donation to any not-for-profit organization
in the city that rents space for the expressed purpose of assisting youth an amount equal to the
city portion of their tax bill; and
THAT the Region of Durham be requested to follow the City of Pickering's lead and offer a
donation equal to the regional portion of the tax bill for similar orgmfizations across thc Region;
and
THAT this motion be circulated to Roger Anderson, Regional Chairman, Durham Region."
Staff had several meetings to discuss the administration and design of the grant funding within
the context of Resolution#3/01(b). The discussion raised many valid and complex issues
regarding administration of a youth grant funding program, that if implemented, would have
made the program too complex and unworkable. It was therefore, decided that a simpler
approach regarding grant funding would be used to assist the youth organizations.
The grant recommended in the report is indirectly linked to the Charity Property Tax Rebate
program that has been in existence since 1998. Currently, through the Municipal Act and most
recently as amended by Bill 140 "Continued Protection for Property Taxpayers Act," the Charity
Property Tax Rebate Program provides a rebate of 40% of the property taxes paid by registered
charities that occupy commercial or industrial space. The loss in tax revenue associated with the
40% rebate is funded by all property tax classes in the same proportion of the tax rate. In other
words, Pickering's cost of the rebate under the 2000 commercial tax class is 14 cents for every
dollar granted.
Recommendation#2 provides these organizations with a guaranteed level of funding per year.
There is also a possibility that the Region of Durham may also provide some additional funding.
The foregoing was developed in conjunction with the Director, Operations & Emergency
Services and the Clerk.

On March 26, 2001, Executive Committee recommended approval of Zoning By-law Amendment
Application A 3/00 to permit the establishment of a 90 square metre accessory dwelling unit on the
second floor of a detached garage. There were no conditions of approval which require fifllfilment prior
to the passing of the implementing by-law.
Should Council adopt Executive Committee's recommendation for approval at their April 2, 2001
Meeting, Council may consider the attached Zoning By-law later on that same meeting.
A Statutory Public Meeting was held for this application on February 15, 2001.
Please note that this by-law may be given all three readings at the April 2, 2001 Council Meeting,
provided Council approves the above-noted application earlier that same Meeting.
The purpose and effect of this by-law is to permit the establishment of an accessory dwelling Unit, 90
square metres in area, on the second floor of the existing detached garage located in the north side yard
with a maximum height of 9.0 metres.

Being a By-law to anaend Restricted Area (Zoning) By-law 3037, as amended by

WHEREAS tile Council of tine Corporation of the City of Picketing deems it desirable to rezone
the subject lands, being Part o£Lot 19, Concession S, and Block 22, Plan 40M-1538, and Part 3,
Plan 40R-9493, in the City of Picketing, for the development of an accessory dwelling unit on
the second floor of a detached garage;
AND WHEREAS an amendment to Bv-law 3037, as amended by By-law 2209/86, is therefore
deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. TEXT AMENDMENT
(1) Section 4.(1) of amending By-law 220986 is hereby further amended by adding
thereto tile following subsection:
(d)
"Accessopr' Dwelling Unit" shall mean one or more habitable rooms
occupied or capable of being occupied as a single, independent and
separate housekeeping unit which is accessory to, and sharing the same
water and sanitary services as. a main dwelling located on tile same lot;
(2) Section 5.(1)(a) of amending By-law 220980 is hereby further amended by
adding thereto the following subsection:
(ii) accesso~' dwelling unit subject to tile provisions of
Section 5.(1 )(d) below.
(3) Section 5.(1) of amending By-law 2209"86 is hereby filrther amended by adding
thereto tile following subsection:
(d) SPECIAL REGULATIONS - DETACt tED GARAGE AND
ACCESSORY DWELLING UNIT:
(i)
Despite Section 5.(l)(b)(ix)(A) and (B) above, a maximum of one
accessory dwelling unit may bc established on the lands cross
hatched on Schedule I, where a detached dwelling exists on the lot.
(ii)
Despite tile accessory building and use provisions of Section 5.18
of By-law 3037, a maximum of one accessory dwelling unit may
be erected on thc second floor of a detached garage located in any
side yard or rear yard of the lands cross hatched on Schedule I,
subject to the following provisions:
A
A detached garage, accessory dwelling unit and any
associated uncovered steps and platforms may be erected in
any side or rear yard, a minimum of 5 metres from any lot
line
B Floor Area Residential (maxinmm): 90 square metres
C Height (maximum): 9 metres

SCHEDULE "I" AMENDMENT
(a)
Schedule 'T' to By-law 2209/86 is hereby amended by adding cross hatching
thereto those lands being Part of Lot 19, Concession 8, and Block 22,
Plan 40M-1538, and Part 3, Plan 40R-9493, and extending thereon cross hatching.
Accordingly, Schedule 'T' to By-law 2209/86 is replaced with Schedule 'T' attached
hereto.

By-law 2209/86 is hereby further amended only to the extent necessary to give effect to
the provisions of this By-law as set out in Sections 1 and 2 above, and as set out in
Schedule I attached hereto. Definitions and subject matter not specifically dealt with in
this By-la~v shall be governed by the relevant provisions of By-law 3037, as amended.
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.

When the above-noted plan was registered, the reserve block referred to was conveyed to
the City along Stouds Lane. This reserve was intended to be dedicated as public highway
upon the development of adjacent lands.
As our Planning & Development Department has advised that road works within this plan
and adjacent lands have been constructed to standards sufficient to permit public access,
the required dedication should therefore be made.
Attached hereto is a location map and a draft by-law, enactment of which will lift the 0.3
metre reserve thus permitting legal access to the adjacent lands. This by-law is in the
fbrm usually used in such cases and is attached for the consideration of City Council at its
meeting scheduled for April 2, 2001.

WHEREAS pursuant to section t5(I) of the Police Setwices Act., R.S.O. 1990, c.P.15, as
amended, a municipal council may appoint persons to enlbrce the by-laws of the municipality
and
WHEREAS pursuant to section 15(2) of the said Act, municipal by-law enforcement officers are
peace officers for the purpose of enfbrcing municipal by-laws;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
The following officers be hereby appointed as municipal law enibrcement officers in and
for the City of Picketing in order to ascertain whether the provisions of By-law 2359/87
