Being a by-lan, to authorize the execution of an
Agreement to amend the Subdivision Agreement dated
July 2, 1985 between Shipstate Ltd. and The Corporatiott
of the Town of Pickering with respect to the develol~ment
of Plan 40M-1383, Pickerit~g.
WHEREAS, pursuant to section 50(6) of the Planning Act 1983, S.O. 1983, chapter 1, Shipstate Ltd.
and The Corporation of the Town of Picketing entered into a Subdivision Agreement dated July 2, 1985,
Notice of which was registered January 13, 1986 as Instrument LT257275 respecting the development
of Plan 40M-1383, Picketing, which Agreement requires an mnendment in a certain respect;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute an Agreement, in the foma attached
hereto as Schedule A, to amend the Subdivision Agreement dated July 2, 1985 between
Shipstate Ltd. and The Corporation of the Town of Pickering respecting Plan 40M-1383,
Pickering.
BY-LAW read a fixst, second and third time and finally passed this 17th day of December, 1990.

THIS AGREEMENT made this 17th day of December, 1990.
BETWEEN:
herein called the "Owner"
OF THE FIRST PART,
THE CORPORATION OF THE TOWN OF PICKERING
herein called the "Town"
OF THE SECOND PART.
WHEREAS by Agreement dated July 2, 1985, between the Owner, the Town and the Royal Bank of
Canada, Notice of which was registered on January 13, 1986, as Instrument LT257275, the Owner
agreed to develop the lands now known as Plan 40M-1383 in accordance with the requirements of the
Town set out therein, which requirements are now advisable to amend in one respect;
NOW THEREFORE THIS AGREEMENT WITNESSETH, that in consideration of the sum of two
dollars, now paid by each Party to the other, receipt of which by each is hereby acknowledged, the
Parties hereto agree as follows:
1. In this Agreement, the term, "Subdivision Agreement" means the Agreement dated July 2, 1985,
between the Owner and the Town and the Royal Bank of Canada, Notice of which was
registered January 13, 1986, as Instrument No. LT257275.
2. (1) The Owner acknowledges and agrees that it continues to be bound by all the terms and
provisions of the Subdivision Agreement as mnended hereby.
(2) This Agreement and everything herein contained shall enure to the benefit of and be
binding upon the parties hereto, their successors and assigns.
(3) Section 34(1)(b) of the Subdivision Agreement is hereby deleted and the following
substituted for it:
(b) a permanent fence of 9 gauge, galvanized steel link fencing having 0.05 metre
mesh 1.8 metres high,
(i) along Block 33 from the southwest comer of Lot 30 to a point 100
metres east;
(ii) along Block 34 from a point 50 metres east of Greenbum Place to the
southeast comer of Lot 1.
IN WITNESS WHEREOF, the Owner and the Town have hereunto affixed their corporate seals attested
to by the hands of their proper authorized officers.
