Being a by-law to authorize the
execution of a Memorandum of
Settlement between the Town of
Pickering Public Library Board, the
Pickering Public Library Staff
Association and the Corporation of the
Town of Pickering.
Whereas the Pickering Public Library Staff Association submitted an
application for Review Services to the Pay Equity Commission on
February 7th, 1990, confirmed April 10th, lggo, which alleged, for
the purposes of pay equity, that the Town may be the employer of the
members of the Association; and
Whereas an Order was made on May 31st, 1990 by Review Officer, Joyce
Caldwell, stipulating that the Town was the employer of the members
of the Association and ordering that the Town post a Pay Equity Plan
covering all non-union employees by August 31st, 1990;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
l. The Mayor and Clerk are hereby authorized to execute a
Memorandum of Settlement in the foFin attached hereto as Schedule
"A" between the Town of Ptckertng Public Library Board, the
Pickering Public Library Staff Association and the Corporation
of the Town of Picketing respecting the remuneration of the
employees of the Town of Picketing Public Library Board.
By-law read a first, second and third time and finally passed this
15th day of October, 1990.

AND WHEREAS an Order was made on May 31~, 1990 by

AND WHKRKA$ to resolve all matters in dispute between
them arising out of the Application for Review Services, the
Town, the Hoard and the Association have a~reed ss follows~
1. The Board has established a new pay scale es attached
for library positions as they exist on the date hereof by
evaluating certain Association 3ob classes et the Board as
benchmark comparators under the Town's Pay Equity Plun (Thorne,
Stevenson, Kellogg). The remaining (non-benchmark) Association
positions were then ranked in relation to the library benchmarks
by using the Board~s Pay Equity ~valuatton Plan (Coopers,
Lybrand).
2. The "Job rate" in a particulsr grade is reached afte~
twelve months of continuous employment. The entry level wage rate
in e particular ~rade is 90% of tho 3ob rate, After six months of
continuous employment, the intermediate level of 95% of the 3ob
rata is reached. The period of all continuous employment prior to
this Memorandum for all current Board staff is included in
calculating whether an employee is to be placed st 90%, 95% or
100% Of the ]ob rate retros=tlYe to January let, 1990. The
attached pay scala is retroactive to January let, 1990.
Progression ~o either 9§% or 1OO% of the Job rate is also ~ubJect
to the condition of obtaining a satisfactory performance
appraiesl before moving to the next stap. Future change~ in pay
levels, such ss in the case of increased or modified duties and

responsibilities, etc., wfll be reviewed by the Board with
respect to Association positions with a representative of the
Association.
The Town will support the cost of implementation of the
Board's new pay scale and maintain it consistent with the
provisiOnS Of the pay equity legislation. The parties ugrce that
in order to maintain pay equity, the same process ss described in
paragraph 1 may e~ain De used so that the Library benchmark
positions {or such other Library benchmark positions as may be
agreed upon between the Board and the Associat~on) will be
evaluated under the Town's Plan, with the result~ bein~ used to
upd&te, if necessary, the ranking and pay ~¢ale of all
Association positions.
4. Other forms of compensation for Board staff are not
affected or eltered by this Memorandum.
5. This Mumu&'u~dum, togetheN with the Coops=s, Lybrand
Evaluation Plan constitutes the necessary Pay Equity Plan (the
"Plan") in accordance with the Pay ~qqity Act, 1987.
6. The Association shall not contest the ~act that the
Town did not ~ost a revised Pay Equity Plan on August 31st, 1990
as originally required by the Review Officer's Order dated
May 31, 1990.
7. The Aasociation, the Town and ~he Board agree that
purposes under :he ~y Equity AcE, %987, as amended from t£me to
this Plan has been re-posted and if no ob3eotiona from or on
behalf o~ any individual have been mede within the praaoribed
~me frame.

withdraw the application for a hearing before the Pay Equity
Hearings Tribunal, which ~earin~ is presently scheduled for
October 18th and 19~h, 1990. The part/es a~ree ~o adjourn %hoae
hearing dates until the Drescribed time frame in Dara~raph 8 has
exDired.
10. For purposes of en£orcemen~ of this Memorandum, i~ is
agreed that thl~ M~mo£andum supersedes ~he oforesnid Neview
Of£1oer Order. If requested by any party to this Memorandum, it
is hereby agreed that all parties request the issuance by the Pay
Equity Hearings Tribunal of this Memorandum as an Order 0f the
Tribunal.
