HomeMy WebLinkAboutBy-law 3418/90 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3418/90 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment, and amendments thereto, respecting Plans M-1194, M-1202, M-1203, M-1207, M-1215, M-1222 and 40M-1236, Pickering. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Gorporation of the Town of Pickering and Black File Investments Inc. and Silver File Investments Inc. entered into an Agreement dated June 16, 1980, Notice of which was registered on September 11, 1980 as Instrument No. LTl12902 respecting the subdivision and development of Plans M-1194, M-1202, M-1203, M-1207, M-1215, M-1222 and 40M-1236, Pickering which Agreement was subsequently amended by Agreements dated February 2, 1981, May 4, 1981 and July 5, 1982, Notices of which were registered on March 11, 1981, July 15, 1981 and August 19, 1982 as Instrument Nos. LT120676, LT129272 and LT151484; and WHEREAS Maple Ridge Homes Limited is the successor to Black File Investments Inc. and Silver File Investments Inc.; and WHEREAS the terms and conditions of that Agreement, as amended, have been com- plied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of: (a) an Agreement dated June 16, 1980, Notice of which was registered September 11, 1980 as Instrument No. LTl12902 between Black File Investments Inc. and Silver File Investments Inc. and The Corporation of the Town of Picketing; (b) an Amending Agreement dated February 2, 1981, Notice of which was registered March 11, 1981 as Instrument No. LT120676 between Maple Ridge Homes Ltd. and The Corporation of the Town of Pickering; (c) an Amending Agreement dated May 4, 1981, Notice of which was registered July 15, 1981, as Instrument No. LT129272 between Maple Ridge Homes Ltd. and The Corporation of the Town of Pickering; (d) an Amending Agreement dated July 5, 1982, Notice of which was registered August 19, 1982, as Instrument No. LT151484 between Maple Ridge Homes Ltd. and The Corporation of the Town of Picketing; respecting the subdivision and development of Plans M-1194, M-1202, M-1203, M-1207, M-1215, M-1222 and 40M-1236. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 5th day of March, 1990. Wayne Ar~thu~, Mayor ~ APPROVED ~r~ce Tayl~, ~erk Lt{G~L DEPT. ~ RELEASE AND DISCHARGE WHEREAS the Agreement dated June 16, 1980, Notice of which was registered September 11, 1980, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT112902 between, BLACK FILE INVESTMENTS INC. and SILVER FILE INVESTMENTS INC. of which Maple Rid_ge Homes Ltd. is the successor hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", as amended by the Agreements dated February 2, 1981, May 4, 1981 and July 5, 1982, Notices of which were registered on March 11, 1981, July 15, 1981 and August 19, 1982, in that Office as Instrument Nos. LT120676, LT129272 and LT151484; provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of all four Agreements. TltlS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 41 inclusive, Blocks 42 to 54 inclusive, Bushmill Street, Bridge Gate Crescent and Maple Ridge Drive on Plan M-1194; Lots 1 to 41 inclusive, Blocks 42 to 44 inclusive, Bushmill Street, Fieldstone Circle, Maple Ridge Drive and Pebblestone Crescent on Plan M-1202; Lots 1 to 37 inclusive, Block 38 and Pebblestone Crescent on Plan M-1203; Lots 1 to 97 inclusive, Blocks 98 to 101 inclusive, Maple Gate Road, Harvest Drive, Fieldstone Circle and Bramblewood Court on Plan M-1207; Lots 1 to 72 inclusive, Blocks 73 to 76 inclusive, Barnwood Square, Bushmill Street and Wheatsheaf Lane on Plan M-1215; Block 1, Plan 40M-1236; Blocks 131 and 133 to 139 inclusive, Maple Gate Road, Meadowlane Crescent, Wildrose Crescent~ Timber Court and Cedarwood Court on Plan M-1222, all in the Town of Picketing, Regional Municipality of Durham.
