BY-LAW NO. 3276 /89
Being a by-law to authorize the execution of a
Release and Discharge of the Subdivision Agree-
ment, and amendments thereto, respecting Plan
M-1017, Pickering.
WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces-
sor thereof, The Corporation of the Township of Picketing and Dungarvan
Investments Limited, Gillingham Investments Limited and Highcroft Investments Limited
carrying on business under the firm name and style of Lookout Point Developments,
entered into an Agreement dated December 3, 1973, Notice of which was registered on
February 27, 1975 as Instrument No. LTD1555, respecting the subdivision and
development of Plan M-1017, Picketing which Agreement was subsequently amended by
Agreement dated May 16, 1977, Notice of which was registered on July 14, 1977, as
Instrument No. LTD47789; and
WHEREAS The Corporation of the Town of Picketing is the successor to The Corpo-
ration of the Township of Pickering; and
WHEREAS the terms and conditions of that Agreement, as amended, have been com-
plied with to the satisfaction of the Town;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Re]ease and Dis-
charge, in the form attached hereto as Schedule A, of the Agreement dated
December 3, 1973, Notice of which was registered February 27, 1975 as
Instrument No. LTD1555, between Dungarvan Investments Limited, Gillingham
Investments Limited and Highcroft Investments Limited carrying on business
under the firm name and style of Lookout Point Developments and The
Corporation of the Township of Picketing, respecting the subdivision and
development of Plan M-1017, Picketing.
2. Schedule A hereto forms part of this By-law.
BY-LAW read a first, second and third time and finally passed this 2nd day of
October, 1989.

RELEASE AND DISCHARGE
WHEREAS the Agreement dated December 3, 1973, Notice of which was registered
February 27, 1975 in the Land Registry Office for the Land Titles Division of Durham
(No. 40) as Instrument No. LTD1555 between,
DUNGARVAN INVESTMENTS LIMITED
GILLINGHAM INVESTMENTS LIMITED
and
HIGHCROFT INVESTMENTS LIMITED
carrying on business under the firm name and style of
LOOKOUT POINT DEVELOPMENTS
hereinafter referred to as the "Company"
THE CORPORATION OF THE TOWNSHIP OF PICKERING
of which The Cor~ooration of the Town of Pickerin[~ is the successor
hereinafter referred to as the "Town",
as amended by the Agreement dated May 16, 1977, Notice of which was registered on
July 14, 1977, in that Office as Instrument No. LTD47789.
provided for the subdivision and development of lands affected hereby; and
WHEREAS the terms and conditions of that Agreement, as amended, have been
complied with to the satisfaction of the Town with respect to the lands affected
hereby;
THE TOWN HEREBY remises, releases and forever discharges the Company, its suc-
cessors and assigns, from any and all liabilities, actions, causes of action, debts,
claims or demands of any kind whatsoever which the Company may have been, is, or
may become subject to pursuant to the provisions of both Agreements.
THIS RELEASE AND DISCHARGE affects the lands described as:
Lots 1 to 1Z, inclusive, Lots 18 to 33, inclusive, Lots 39 to 186, inclusive, Block A,
Part Block B, Block C and Blocks AX, BX, CX, DX, Creekview Circle, Broadgreen
Street, Carme]lo Court, Petticoat Lane, Downland Drive, Stonebridge Lane, and
Kings]and Boulevard, Plan M-1017 and Lots 1 to 79 inclusive and Blocks A, B, C,
Broadgreen Street, 'Victor Court and Brian Court, Plan M-1135, and all units and
common elements comprising Durham Condominium Plan Number 52, all in the Town of
Picketing, Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to
by its properly authorized officers.
