Being a by-law to authorize the execution of a
Servicing Agreement respecting Part Lots 7 and
Z2, Plan 228, Pickering, (Parts 3 and 9, Plan
40R-7991) (The Church of the Nazarene; A 20/88)
WHEREAS, as a condition of the approval of Zoning By-law Amendment Application
A 20/88 the owner of Part Lots 7 and 22, Plan 228, Pickering, (Parts 3 and 9, Plan
40R-7991) is required to make a cash contribution to the cost of Altona Road sidewalk
�,I! construction;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Servicing Agreement
between The Corporation of the Town of Pickering and The Church of the
Nazarene in Ontario in the form attached hereto as Schedule A, respecting the
development of Part Lots 7 and 22, Plan 228, Pickering, (Parts 3 and 9, Plan
40R-7991) (The Church of the Nazarene in Ontario; A 20/88).
BY-LAW read a first, second and third time and finally passed this 28th day of
November, 1988.

Schedule A
THIS AGREEMENT roade this 28th day of Noverober, 1988.
B E T W E E N:
THE CORPORATION OF THE TOWN OF PICKERING
herein called the "Town"
OF THE FIRST PART,
- and -
THE CHURCH OF THE NAZARENE IN ONTARIO
herein called the "Owner" .
OF THE SECOND PART.
WHEREAS the Owner herein is the registered owner, in fee eimple, of the lande
affected hereby; and
WHEREAS pursuant to the proviaions of the predecessor of section 90 of the Planning
Act, R.S.O. 1980, chapter 379, the Council of The Corporation of the Town of
Pickering enacted By-Law 1079/80 on January 21at, 1980, deeignating the whole of the
ares of the Town of Pickering ae a eite plan control area including the lande affected
hereby; and
WHEREAS the lands affected hereby were the aubject of Zoning By-law Amendment
Application A 20/88, a condition of the approval of which is that the Owner make a
cash contribution to the Town towarda the future conetruction of a aidewalk acrosa
the frontage of the lands affected hereby;
NOW THEREFORE, THIS AGREEMENT WITNESSETH that in coneideration of the Town
approving Application A 20/88, the Parties hereto agree as followe:
1. The land affected by this Agreement (herein called the "Land") is that part of
Lots 7 and 22, Plan 228, Pickering, deaignated ae Parte 3 and 9, Plan
40R-7991.
2. The Owner ehall pay to the Town on or within 60 daye of written demand
therefor, the sum of $2,100 adjueted to date of demand in accordance with the
Southam Conetruction Coat Index for Ontario, Compoaite Portion, by cash or
certified cheque, for the conatruction and inatallation of a aidewalk on the east
side of Brock Road across the frontage of the Land.
3. Thia Agreement shall enure to the benefit of and be binding upon the PartIea
hereto and their respective heira, executors, succeaeors and assigna.
IN WITNESS WIiEREOF the Parties hereto have hereunto affixed their corporate aeals
duly attested by their proper authorized officers.
