BY-LAW NUMBER 2869/88
Being a 6y-law to amend Restricted Area (Zoning) 13y-law 3036, as amended, to implement
the Official Plan of the 1'own of Pickering District Planning Area, Region of Durham, in
Part of Lot 32, Range 3, Broken Front Concession, in the Town of Pickering. (A 58/86;
OPA 86-86/Y)
WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to
permit the establishment of restricted light industrial uses, home improvement cenires,
furniture and major appliance sales, restaurants, business offices and professional offices in
Part of Lot 32, Range 3, Broken Front Concession;
AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it
desirable to amend By-law 2622/87 to also permit a day nursery in Part of Lot 32, Range 3,
[3roken Front Concession;
NOW THEREFORE THE COUNCIL OF 'fHE CORPORATION OF THE TOWN OF P[CKERING
HEREBY ENACTS AS FOLLOWS:
TEXT AMENDMENTS
(1} Section 4 of By-law Z622/87 is hereby amended by adding thereto the following
definitions:
(12) "Day Nursery" shall mean lands and premises duly licensed pursuant to the
provisions of the Day Nurseries Act, or any successor thereto, and for the use
as a facility for the daytime care of children;
(13) "Activity Roorn Area" shall mean the floor area within a day nursery that is
used by children for their day-to-day activities but shall exdude all floor area
allocated to corridors, storage areas, washroom and kitchen facilities and
offices;
(2) Section 5 of By-law 2622/87 is hereoy amended by adding thereto the following
subsection:
(�) Special Regulations ("(DN-l)" Symbol)
On la�ds where the "MI-8" designation on Schedule I attached here[o is
followed by the symbol °(DN-1)", the following regulations shall apply:
(a) In addition to the uses specified in section 5(l) of this By-law, a day
nursery shall be permitted during the period of June 26, 1989 to December
3l, 1989 subject to the provisions of section 5(2) of By-law 2622/87 and
subclauses (b), (c) and (d) of this subsection.
(b) All zone requirements specified in section 5(2) of this By-law shall apply
except that, for a day n�rsery use,
(ij despite section 5(2)(a), the minimum lot area shall be 0.3 hectare;
and
(ii) despite secTion 5(2)(j)(ii), there shall be provided and maintained
on the lot a minimum of 5 parking spaces per l00 square metres or
part thereof of a�tivity room area of the day nursery use.
(c) "fhe aggregate of the numbers of children attending day nurseries on the
lands at any one time shall not exceed 30.
(d) Despite Section 5.18(a) of By-law 3036, an accessory building not
exceeding a floor area of 35.0 square metres may be permitted in the
front yard.

2. SCHEDULE AMENDMENTS
Schedule I to Dy-law 2622/87 is hereby amended by changing from "Ml-8" to "Ml-8(DiV-1)"
the zone designation of the lands designated "h11-8(DN-1)" on Schedule [ attached hereto.
3. BY-LAW 2622/87
By-law 2622/87 is hereby amended only to the extent necessary to give effect to the
provisions of this By-law. Definitions and subject matters not specifically dealt with in
this F3y-law shall be governed by the relevant provisions of By-law 2622/87 and By-law
3036, as amended.
4. E.FFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approvat of the
Ontario P✓lunicipal Board, if required.
