BY-LAW NO. 2818 /88
Being a by-law to authorize the execution of an
Agreement amending the Subdivision Agreement
respecting Plan 40M-1510, Pickering, (Draft Plan
18T-79088; Phase 2B, Grand Oak Homes (Eastern
Division) Inc. )
WHEREAS pursuant to the provisions of the Planning Act, 1983, S.O. 1983, chapter
1, section 50, The Corporation of the Town of Picketing entered into a Subdivision
Agreement dated April 21, 1987 with Grand Oak Homes (Eastern Division) Inc.
respecting the development of what is now designated as Plan 40M-1510 (Draft Plan
18T-79088; Phase 2B, Grand Oak Homes (Eastern Division) Inc.);
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute an Agreement, in
the form attached hereto as Schedule A amending the Subdivision Agree-
ment dated April 21, 1987 between The Corporation of the Town of
Pickering and Grand Oak Homes (Eastern Division) Inc. respecting Plan
40M-1510, Pickering (Draft Plan 18T-79088; Phase 2B, Grand Oak Homes
(Eastern Division) Inc.).
BY-LAW read a first, second and third time and finally passed this 20th day of
June, 1988.

NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute an Agreement, in
the form attached hereto as Schedule A amending the Subdivision Agree-
ment dated April 21, 1987 between The Corporation of the Town of
Picketing and Grand Oak Homes (Eastern Division) Inc. respecting Plan
40M-1510, Picketing (Draft Plan 18T-79088; Phase 2B, Grand Oak Homes
(Eastern Division) Inc.).
BY-LAW read a first, second and third time and finally passed this 20th day of

Schedule A
THIS AGREEMENT made this 20th day of June, 1988.
BETWEEN:
GRAND OAK HOMES (EASTERN DIVISION) INC.
hereinafter called the "Owner"
OF THE FIRST PART,
- and -
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter called the "Town"
OF THE SECOND PART.
WHEREAS, by Agreement dated April 21, 1987, between the Owner and the Town, the
Owner proposed to subdivide and register a plan of subdivision of part of Lot 20,
Concession 2, Picketing, now being Plan Number 40M-1510, Picketing (Draft Plan
18T-79088, Phase 2B); and
WHEREAS, it is deemed desirable to amend that Agreement in certain respects;
NOW THEREFORE, THIS AGREEMENT WITNESSETH, that in consideration of the sum
of Two Dollars ($2.00) paid by each Party to the other, receipt of which by each is
hereby acknowledged, the Parties hereto agree as follows:
1. The lands affected by this Agreement are all of Blocks 46 to 50, both inclusive,
Plan 40M-1510, Picketing.
2. In this Agreement, the term "Subdivision Agreement" shall mean the Agreement
dated April 21, 1987, between the Owner and the Town, Notice of which was
registered December 22, 1987, as Instrument LT365113.
3. The Owner is bound by all the terms and provisions of the Subdivision Agree-
ment, as amended hereby.
4. (1) Subsection 1 of Section 5 of Schedule A to the Subdivision Agreement is
hereby amended by deleting "Blocks 40 to 51" from the first line thereof
and by substituting "Blocks 40 to 45 and Block 51" therefor.
(2) Items 6, 7, 8, 9 and 10 of the Table in subsection 3 of that section are
hereby amended by deleting "lST-79004(R)-S* " from Column II of each
and by substituting "Plan 40M-1512" therefor in each case.
(3) Subsection 5 of that section is hereby amended by deleting "Draft Plan
18T-79004(R), south M-Plan" from the third line and by substituting
"Plan 40M-1512, Picketing" therefor.
Section $ of that Schedule is hereby deleted and the following substituted for
it:
6. BUILDING PERMITS - DELAYED APPLICATION
Despite any other provisions of this agreement, the Owner shall not apply
for a building permit for the construction of any building,
(a) on any of Blocks 40 to 45 and Block 51 until the provisions of
section 5(1) of this Schedule have been complied with; and
(b) on any of Lots 33 to 39 and Blocks 41 to 45 and Block 51 until
the south M-Plan of Draft Plan lST-79004(R) has been registered.
6. This Agreement and everything herein contained shall enure to the benefit of
and be binding upon the Parties hereto, their successors and assigns.
IN WITNESS WHEREOF, the Owner and the Town have hereunto affixed their corpo-
rate seals attested to by their authorized officers.
