BY-LAW NO. 2755/88
Being a by-law to authorize the execution of
Transfers from Grand Oak Homes (Eastern
Division) Inc. to The Corporation of the Town of
Pickering respecting storm sewer easements over
Part Lots 3-4, 19-20, 23-24, 65, 67-70 and Part
Blocks 80-84, Plan 40M-1526, Pickering (Parts
1-2, Plan 40R-11124, Parts 1-6, Plan 40R-11125,
Parts 1-8, Plan 40R-11126).
WHEREAS The Corporation of the Town of Pickering requires storm sewer easements
over Part Lots 3-4, 19-20, 23-24, 65, 67-70 and Part Blocks 80-84, Plan 40M-1526,
Pickering (Parts 1-2, Plan 40R-11124, Parts 1-6, Plan 40R-11125, Parts 1-8, Plan
40R-11126) for the purpose of draining storm water and pursuant to the provisions of
section 193 of the Municipal Act, R.S.O. 1980, chapter 302, a municipal council may
pass by-laws for acquiring interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Transfer/Deed
of Land, in the form attached hereto as Schedule A, from Grand Oak
Homes (Eastern Division) Inc. to The Corporation of the Town of Picker-
ing, respecting storm sewer easements over Part Lots 3 and 4, Plan
40M-1526, Pickering (Parts 1 and 2, Plan 40R-11124).
The Mayor and Clerk are hereby authorized to execute a Transfer/Deed
of Land, in the form attached hereto as Schedule B, from Grand Oak
Homes (Eastern Division) Inc. to The Corporation of the Town of Picker-
ing, respecting storm sewer easements over Part Blocks 83 and 84, Plan
40M-1526, Pickering (Parts 5 and 6, Plan 40R-11125).
The Mayor and Clerk are hereby authorized to execute a Transfer/Deed
of Land, in the form attached hereto as Schedule C, from Grand Oak
Homes (Eastern Division) Inc. to The Corporation of the Town of Picker-
ing, respecting storm sewer easements over Part Lot 65, and Part Blocks
80, 81 and 82, Plan 40M-1526, Pickering (Parts 1-4, Plan 40R-11125).
4. The Mayor and Clerk are hereby authorized to execute a Transfer/Deed
of Land, in the form attached hereto as Schedule D, from Grand Oak
Homes (Eastern Division) Inc. to The Corporation of the Town of Picker-
ing, respecting storm sewer easements over Part Lots 19, 20, 23, 24, 67,
68, 69 and 70, Plan 40M-1526, Pickering (Parts 1-8, Plan 40R-11126).

of Land, in the form attached hereto as Schedule C, from Grand Oak
Homes (Eastern Division) Inc. to The Corporation of the Town of Picker-
ing, respecting storm sewer easements over Part Lot 65, and Part Blocks
80, 81 and 82, Plan 40M-1526, Pickering (Parts 1-4, Plan 40R-11125).

1. The Tcanaferot hereby transfers to the Transferee the free, uninterr�pted
and unobatructed right and easement to construct, operate ard maintain such
atorm drainage worka, toge[her vith any appurtenaqces thereto as may be
required from time to time in, under and across the lands herein
described, together with a right of the Transferee, its successocs and
asaigns and it� and their servants, agents and workmen, with all necessary
equipment, machinery and veAicles to enter upon the lands at all times and
to pass and repasa thereon for replacing (including replacement with storm
drainage worka of larger size and capacity) and maintaining the storm
drainage works or any part thereof or appurtenances theceto to be
constructed, reconstructed, examined, repaired, renewed, replaced or
maintained aituate on the lands.
2. The Tzanafaror covenants that it shall not eract any bullding or structure
nor place or remove any fill on or from any pazt of the lands without the
expresa wrltten conaent of the Tranaferee.
3. The Tranaferor hereby releases the 'fransferee from any claim which may
arise out of the exercise by the Transferee of the riqht and easement
granted hereby, or whlch may arise out of the existence or�operation of the
atorm drainage works, provided the Transferee fills in all excavations and
as Ear as le practicable, reatoces the surface to the condition existing
prior to any entry thereon to exercise the rlght hereby granted.
4. The Transferor covenants that it shall execute such further assurances of
the right and easement granted hereby as may be required by the
Transferee.
5. 1'he burden of this Transfer and of all the covenants contained herein shall
run with the lands herein deacribed.
6. This Transfer shall be binding upon and ahall enure to the benefit of the
parties hereto and their respective succesaors and assigns.

7. The benefit of this Transfer and all oE the covenants contained herein
shall run with all other lands and interests in land owned, occupied or
used by the Transferee, its successora and assigns for the purpose of
operating and maintaining storm drainage works.

required from time to �ime in, under and across the lands herein
described, �ogether with a right of the 1Yansferee, its succesaors and
asaiqna and its and tneir servants, agents ard workmen, with all necessazy
equipment, machlnery and vehiclea to enter upon the lande at all timee and
to pass and repass thereon for replacing (including replacement wit� etoro
dralnage worke of laryer size and capaclty) and maintaiaing the storm
drainage works or any part thereof or appur[enancee thereto to be
constructed, reconstructed, examined, repaired, renewed, teplaced or
maintained situate on the lands.
2. The Transferor covenanta that it shall not erect any building or structure
nor place or remove any fill on or from any pazt of the lands without the
expresa written consent of the Transferee. "
3. The Tzanefezor hereby releases the Tranaferee frao any claia which may
arise out of the exercise by the Transferee of the right and easement
gcanted hereby, or whlch may ariae out of the existence oi operation of the
etorm drainage worka, provided the Tranaferee fllla in all excavationa and
ae far as ie practicable, restorea the eurface to the condition exieting
prior to any entry thereon to exercise the right hereby granted.
4. The Tranaferor covenants that it shall execute auch further assurancea of
the right and easement granted hereby as may be cequired by the
Transferee.
5. The burden of thia Tranafer and of all the covenanta contained herein shall
run with the lands herein deacribed.
6. Thia Transfer shall be binding upon and shall enure !o the benefit of the
partiee hereto and their respective succesaora and assigne.

equipment, machinery and vehiclea to enter upon the lands at all timea and
to pass and repass thereon for replacinq (includinq replacement vith storm
drainage works of larger size and capacity) and maintaiaing the stor■
drainage works or any part thereof or appurtenances thereto to be
constructed, zeconatructed, examined, zepaired, renewed, zeplaced or
maintained aituate on the lands.
2. Tha Transferor covenanta that it shall not erect any building or atructure
nor placa or remove any fill on or from any part of tAe lands without the
express written consent of the Transferee.
3. The Tranaferor hereby releasea the Transferee frao any claim vhlch may
arise out of the exercise by the Transferee of the right and easement
gzanted hereby, or which may arise out of the existence or aperation of che
etorm drainage worka, provided the Transferee fllls in all excavetiona and
as far ae ie practicable, restorea the eurface to the condition exieting
prior to eny entry thereon to exerciae the right hereby granted.
�. The Transferor covenants thaG it shall execute auch further asaurances of
the right and easement granted hereby as may be required by the
Transferee.
5. The burden of thia 1Yanefer and of all the covenants contained herein shall
run with the lande herein deecribed.
6. Thls Tranafer shall ba binding upon and shall enure to the benefit of the
partiea hereto and their respec[ive auccessors and assigns.
