Being a by-law to attthorize the execution of a
Transfer/Deed of Land from Bramalea Limited to
The Corporation of the Town of Picketing
respecting storm sewer easements over Block 109
and Part Lot 5, Plan 40M-1473, Picketing (Parts 1
and 2, Plan 40R-10908).
WHEREAS The Corporation of the Town of Pickering requires storm sewer easements
over Block i09 and Part Lot 5, Plan 40M-1473, Pickering (Parts 1 and 2. Plan
40R-10908) for the purpose of draining storm water and pursuant to the provisions of
section !93 of the Municipal Act, R.S.O. 1980, chapte" 302, a municipal council may
pass by-laws for acquiring interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer/Deed
of Land, in the form attached hereto as Schedule A. from Bramalea
Limited to The Corporation of the Town of Picketing, respecting storm
sev,er easements over Block 109 and Part Lot 5, Plan 40M-1473, Picketing
(Parts 1 and 2. Plan 40R-10908).
BY-LAW read a first, second and third time and finally passed this 21st day of
March, 1988.

The ?ransferor transfento the ?ransferee the right, interest and
easement on, over, under and through the described lands o£ the
Transferor as the servient tenement for the following purposes, namely :
The free uninterrupted and unobstructed right and easement in
perpetuity to construct, operate and maintain storm water run-off
including the installation and maintenance of catch basins, together
with any and all appur'cenancea thereto aa may be required from t~e to
time in, under and across the lands described herein.
?OGETH~w~th the right of the Transferee, its successors and
assigns and its and their servants, agents and workmen with all necessary
equipment, machinery and vehicles to enter upon said lands at all t£mes
and to paso and repass thereon for the purpose of constructing and
reconstructing, exa~Lning, repairing, renewing or replacing and maintain£n
the said sto~m water run off and catch basins or any part thereof whether
or not any part to be as constructed, repaired, renewed, replaced or
maintained As situate on the lands described herein.
TO HAV~ M~D TO ~O~D. the said easement in, under and across the lands
described herein unto the Transferee, its successors and assigns for its
and their sole and only use forever.
MD the Transferor covenants that it will not erect any Buildings or
structures, place or remove any fill on any part of the lands herein.
AI~D the Transferor hereby releases the Transferee from any end every
claim which may or might arise out of the exercise by the Transferee of
any of the rights granted by this indenture or which may arise out of the
existence or operation of the storm water run off and catch basins and
~:.. accsp~ the consideration above-mentioned in full satisfaction of all such
· : claims, provided the Transferee fills in all excavations and as far as is
:i:. practicable, restores the surface to the condition existing prior to any

RECOMMENDATION:
A by-law authorizing the execution of a Transfer of storm sewer ease-
ment to the Town in Plan 40M-1502, over Part Lots 5 and 6, Plan
40M-1502, Pickeriog (Parts 1 and 2, Plan 40R-10933), should be enacted.
ORIGIN:
Storm drainage design, Subdivision Plan 40M-1502.
AUTHORITY:
Municipal Act, R.S.O. 1980, chapter 302, section 193.
BACKGROUND:
One of the provisions of the Subdivision Agreement respecting Plan
40M-1502 requires the owner to provide storm sewer easements as
required. Such easements are required over Part Lots 5 and 6 and the
developer has obtained those easements for the Town. Enactment of the
attached by-law will authorize the execution of that easement document
and thereby permit the registration thereof.
