- By-law 2655/88 and Resolution 21/88
By-law 2655/88 was given two readings at the Council meeting held
January 19, 1988. Resolution 21/88, amending By-law 2655/88 by delet-
ing self-serve car wash as a permitted use, was also made at that meet-
ing.
However, no resolution was made pursuant to section 34(16) of the
Planning Act, 1983, whereby the Council would determine whether any
further notice is to be given in respect of the proposed by-law, inas-
much as by virtue of Resolution 21/88, a change has been made in the
proposed by-law after the statutory public meeting at which the by-law
was reviewed.
Please note therefore tha 'on regarding notice must be
made before By-law 2655/88 receives third reading; failure to "mak~--Su~'h
~--m6h~6~- ~ render th~ by-law invalid (see Spffnce vs. City of York,
1985 - Ontario Supreme Court of which you have a copy).

(3) Section 5 of By-law 2t)57/87 is hereby revoked and the following substituted therefor:
PROVISIONS
(1) Uses Permitted ("SC~22/GS#" Zone)
No person shall within the lands designated "SC-22/GSt)" on Schedule "]"
attached hereto use any lot or erect, alter or use any building or structure
for any purpose except the following:
(a) automobile service station - type D
(b) business office
(c) dry cleaning depot
(d) laundromat
(e) professional office
(f) restaurant - type A
(2) Zone Requirements ("SC-22/GSt)" Zone)
No person shall within the lands designated "SC-22/GS#" on Schedule "I"
attached hereto, use any lot or erect, alter or use any building or structure
except in accordance with the following provisions:
(a) LOT AREA (minimum): 0.3 hectare
(b) FRONT YARD DEPTH (minimum): It) metres
(c) INTERIOR SIDE YARD WIDTH
(minimum): 10 metres
(d) FLANKAGE SIDE YARD WIDTH
(minimum): 1# metres
(e) REAR YARD DEPTH (minimum): 3 metres
(f) LOT COVERAGE (maximum): 33 percent
(g) BUILDING HEIGHT (maximum): 10 metres
(h) OPEN STORAGE: no open storage shall be
permitted in any yard
(i) PARKING REQUIREMENTS:
A For the purpose of this clause "parking space" shall mean a usable
and accessible area of not less than 2.6 metres in width and 5.3
metres in length for the temporary parking of a vehicle, but shall
not include any portion of a parking aisle or driveway;
B There shall be provided and maintained a minimum of 3# parking
spaces;
C Sections 5.21.2a) and 5.21.2b) of By-law 3036, as amended, shall not
apply to the lands designated "SC-22/GS4" on Schedule 'T' attached
hereto;
D All parking areas shall be set back a minimum of 3.0 metres from
all road allowances;
E Despite Section 5.21.2g) of By-law 3036, as amended, all parking
areas shall be surfaced with brick, asphalt or concrete, or any
combination thereof.

SPECIAL PROVISIONS:
A The aggregate of the gross floor areas of all Buildings on the lot
shall not be less than 900 square metres and shall not exceed 1200
square metres;
B The aggregate of the gross floor areas of all restaurants - type A
on the lot shall not exceed 190 square metres;
C The aggregate of the gross floor areas of all dry cleaning depots
and laundromats on the lot shall not exceed 140 square metres;
D Despite Sections 5.18 of By-law 3036 as amended, and 5(2)(c) of this
By-law as amended, an accessory building not exceeding 3 metres
in height and not exceeding l0 square metres in gross floor area
may be erected:
(i) in an interior side yard not less than 1.5 metres from the lot
line;
(ii) in a flankage side yard not less than l0 metres from the lot
line.
2. SCHEDULE AMENDMENTS
Schedule "I" to By-law 2457/g7 is hereby amended by changing from "SC-9" to
"SC-22/GS#" the zone designation of the lands designated "SC-22/GS4" on Schedule 1
attached hereto.
3o BY-LAW 2#57/87
By-law 2457/87 is hereby amended only to the extent necessary to give effect to the
provisions of this By-law. Definitions and subject matters not specifically dealt with
in this By-law shall be governed by the relevant provisions of By-law 2457/87 and
By~law 3036, as amended.
4. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof, subject to the approval
of the Ontario Municipal Board, if required.
