Taylor City Clerk Tyler Barnett Planner 1 Draft Amending By-law for Zoning By-law Amendment Application A 10/00 Brydale Developments (Pickering) Inc. Part of Lot 1, Plan 819 Parts 1 to 6, Plan 40R-19693 City of Pickering Council, on June 26, 2000, approved the above-noted application to permit three detached residential dwellings. Conditions of approval have now been satisfied and a draft amending by-law has been prepared. The draft by-law has been circulated to and approved by the applicant, and is attached for the consideration of City Council at their meeting scheduled for December 18, 2000. A Statutory Public Meeting was held for this application on May 18, 2000. Please note that this by-law may be given all three readings at the December 18, 2000, Council Meeting. The purpose and effect of this by-law is to permit the development of three detached residential dwellings and to zone a portion of the subject lands as "Open Space - Hazard Lands". Dire"'cto~ng and Development JTB/pr ltb~ale~byl awm~n.doc Enclosure THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5780/00 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended by By-law 5575/99, to implement the Official Plan of the City of Pickering District Planning Area, Region of Durham in Part of Lot 1, Plan 819 (Parts 1 to 6, Plan 40R-19693), in the City of Pickering. (Al0/00) WHEREAS the Council of the Corporation of the City of Picketing deems it desirable to rezone the subject lands, being Part of Lot 1, Plan 819 (Parts 1 to 6, Plan 40R-19693), in the City of Picketing, for the development of residential uses and open space hazard land uses; AND WHEREAS an amendment to By-law 3036, as amended by By-law 5575/99, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. SCHEDULE "I" AMENDMENT (a) Schedule 'T' to By-law 5575/99 is hereby amended by adding thereto those lands being Part of Lot 1, Plan 819, further described as Parts 2, 3, 4, 5, & 6, Plan 40R- 19693, and extending thereon, the "S3-7" (Detached Dwelling Residential Zone) zone category. (b) Schedule 'T' to By-law 5575/99 is hereby further amended by adding thereto those lands being Part of Lot 1, Plan 819, further described as Part 1, Plan 40R- 19693, and extending thereon, the "OS-HL" (Open Space Hazard Land Zone) zone category. Accordingly, Schedule 'T' to By-law 5575/99 is replaced with Schedule 'T' attached hereto. 2. BY-LAW 5575/99 By-law 5575/99 is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Section 1 above, and as set out in Schedule I attached hereto. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3036, as amended. 3. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
