HomeMy WebLinkAboutBy-law 5759/00THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5759/00 Being a by-law to authorize the execution of a Licence Agreement between Martin and Lisa Kaefer and John and Martina Belgiorgio. WHEREAS the City is the owner in fee simple of Block 53, Plan 40M-1866, Pickering, which Block was conveyed to the City for future walkway purposes; and WHEREAS Martin and Lisa Kaefer are the owners in fee simple of Lot 13, Plan 40M-1866, Pickering, which lot lies immediately east of Block 53 and they have expressed an interest in occupying the eastern half of Block 53, Plan 40M-1866 for residential purposes in conjunction with their lot; and WHEREAS John and Martina Belgiorgio are the owners in fee simple of Lot 14, Plan 40M-1866, Pickering, which lot lies immediately west of Block 53 and they have expressed an interest in occupying the western half of Block 53, Plan 40M-1866 for residential purposes in conjunction with their lot; and AND WHEREAS, pursuant to section 191 of the Municipal Act, R.S.O. 1990, chapter M.45, the Council of the City may dispose of interests in land owned by it while that land is not required by the City; and NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Licence Agreement between The Corporation of the City of Pickering and Martin and Lisa Kaefer and John and Martina Belgiorgio in a form satisfactory to the Solicitor for the City to permit an encroachment of Block 53, Plan 40M-1866 by the owners of Lots 13 and 14, Plan 40M-1866 for the purposes of utilizing it for residential purposes in conjunction with their respective until such time as the City requires the lands for walkway purposes. BY-LAW read a first, second and third time and finally passed this 16th day of October, 2000.
