BY-LAW NO. 5755/00
Being a By-law to amend Restricted Area (Zoning) By-law 2511, as
amended, to implement the Official Plan of the City of Picketing District
Planning Area, Region of Durham in Part of Lots 30 and 31, Range 3
B.F.C, and Part of Lots 5 to 7, Plan 230, (Parts 1 to 3 and 11, 40R-8223,
Parts 2, 3, 7-11, 40R-18317, Part 3, 40R-16498), City of Picketing.

WHEREAS the Council of the Corporation of the City of Picketing deems it desirable to
recognize the existence of an industrial warehouse\office building and to permit the development
of an additional industrial warehouse\office building, on the subject lands being Part of Lots 30
and 31, Range 3 B.F.C, and Part of Lots 5 to 7, Plan 230, (Parts 1 to 3 and 11, 40R-8223, Parts 2,
3, 7-11, 40R-18317, Part 3, 40R-16498), City of Pickering;
AND WHEREAS an amendment to By-law 2511, as amended by By-laws 789/78 and 893/78, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
SCHEDULE I
Schedule I attached hereto with notations and references shown thereon is hereby
declared to be part of this By-law.
AREA RESTRICTED
The provisions of this By-law shall apply to those lands in Part of Lots 30 and 31,
Range 3 B.F.C, and Part of Lots 5 to 7, Plan 230, (Parts 1 to 3 and 11, 40R-8223, Parts 2,
3, 7-11, 40R-18317, Part 3, 40R-16498), in the City of Pickering, designated "MI-I(S)"
on Schedule I attached hereto.

GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved, or
structurally altered except in conformity with the provisions of this By-law.
DEFINITIONS
In this By-law,
(1)
"Business Office" shall mean a building or part of a building in which the
management or direction of a business, a public or private agency, a brokerage or
a labour or fraternal organization is carded on which may include a telegraph
office, a data processing establishment, a newspaper publishing office, the
premises of a real estate or insurance agent, or a radio or television broadcasting
station, but shall not include a retail store;
(2)
(a) "Dwelling" shall mean a building or part of a building containing one or more
dwelling units, but does not include a mobile home or trailer;

(b)
"Dwelling Unit" shall mean one or more habitable rooms occupied or capable
of being occupied as a single, independent, and separate housekeeping unit
containing a separate kitchen and sanitary facilities;
(c) "Dwelling, Single or Single Dwelling" shall mean a single dwelling
containing one dwelling unit and uses accessory hereto;
(3)
(a) "Floor Area - Residential" shall mean the area of the floor surface contained
within the outside walls of a storey or part of a storey;
(b)
"Gross Floor Area - Residential" shall mean the aggregate of the floor areas of
all storeys of a building or structure, or part thereof as the case may be, other
than a private garage, an attic, or a cellar;
(4)
"Light Manufacturing Plant" shall mean a manufacturing plant used for the dry
cleaning, pressing or laundering of garments, the production of apparel and
finished textile products other than the production of synthetic fibers, printing or
duplicating, the manufacture of finished paper and allied products other than the
processing of wood pulp, the production of cosmetics, drags and other
pharmaceutical supplies, or the manufacture of finished lumber products, light
metal products, electronic products, plasticware, porcelain, earthenware,
glassware or similar articles, such as furniture, housewares, toys, musical
instruments, jewellery, watches, precision instruments, radios and electronic
components;
(5)
"Manufacturing Plant" shall mean a building or structure or part thereof in which
is carded on an activity or operation pertaining to the making of any article or part
of an article, which shall include altering, assembling, repairing, ornamenting,
finishing, cleaning, polishing, washing, packing, adapting for sale, breaking up, or
demolishing the said article;
(6)
"Scientific, Research or Medical Laboratory" shall mean a building or part of
building wherein scientific, research or medical experiments or investigations are
systematically conducted and where drags, chemicals, glassware or other
substances or articles pertinent to such experiments or investigations may be
manufactured or otherwise prepared for use on the premises;
(7)
"Warehouse" shall mean a building or part of a building which is used primarily
for the housing, storage, adapting for sale, packaging or wholesale distribution of
goods, wares, merchandise, food-stuff, substances, articles or things, and includes
the premises of a warehouseman but shall not include a fuel storage tank except as
an accessory use.
PROVISIONS

Uses Permitted ("MI-I(S)" Zone)
No person shall within the lands designated "MI-I(S)" on Schedule I attached
hereto, use any lot or erect, alter, or use any building or structure for any
purpose except the following:
(a) Residential Uses
(i) Accessory dwelling unit
(b) Non-Residential Uses
(i) Business Office
(ii) Light Manufacturing Uses
(iii) Scientific, Research or Medical Laboratory
(iv) Warehouse

Zone Requirements ("MI-1 (S)" Zone)
No person shall within the lands designated "MI-I(S)" on Schedule I attached
hereto, use any lot or erect, alter, or use any building except in accordance
with the following provisions:

(i) Building Location and Setbacks:
A
Buildings and structures shall be located entirely within the
building envelope illustrated on Schedule I attached to this
By-law;
B
Despite clause A above, uncovered steps or platforms may
project a maximum 1.5 metres beyond the building
envelope;
(ii)
Building Height: maximum 20 metres except
that where lot coverage exceeds 33 percent the maximum
building height shall be 12 metres;
(iii)
Lot Coverage:
building heights exceeds
shall be 33 percent;
50 percent, except that where
12 metres the maximum lot coverage
(iv) Open Storage:
no open storage shall be
permitted in any yard;
ACCESSORY DWELLING UNIT REQUIREMENTS:
(i) maximum one dwelling unit;
(ii)
minimum unit area of 55.5 square metres plus an additional 1.5
square metres for each bedroom;
LANDSCAPED OPEN AREA:
(i)
Any part of a lot which is not occupied by buildings, structures,
parking areas, loading spaces or driveways shall be maintained
as landscaped open area;
SPECIAL REGULATIONS:
(i) No loading spaces or electric transformers shall be located
adjacent to Granite Court;
(ii)
Clauses 5.21.2a) to 5.21.2b), inclusive, of By-law 2511, as
amended shall not apply to the lands designated "MI-I(S)" on
Schedule I attached hereto.

6. BY-LAW 2511
By-law 2511, as amended, is hereby further amended only to the extent necessary to give
effect to the provisions of this By-law as it applies to the area set out in Schedule I
attached hereto. Definitions and subject matters not specifically dealt with in this By-law
shall be governed by relevant provisions of By-law 2511, as amended.
7. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.

October ,2000.
