Taylor City Clerk FROM: Tyler Barnett Planner 1 Re~ Draft Amending By-law for Zoning By-law Amendment Application A 26/97 (Regional Official Plan Amendment Application 97-023/D) (Pickering Official Plan Amendment Application 97-006/P) (Minister's Zoning Order Amendment Application 18-ZO-02999-02) Brooklin Mews Limited & Kinsale Mews Limited Part of Lot 1 & 2, Concession 7 City of Picketing On June 21, 2000, City Council approved the above-noted rezoning application to permit a golf course on the subject property. A draft amending by-law was prepared and passed by Council on June 26, 2000. It was noted in our previous memorandum, dated June 20, 2000, that additional provisions for a future building envelope for a dwelling to be located on the Eighth Concession Road would be dealt with through a subsequent amending by-law when all the necessary documentation was available. The necessary documentation has been submitted and an amending by-law has been prepared. The draft by-law has been circulated to and approved by the applicant, and is attached for the consideration of City Council at their meeting scheduled for August 8, 2000. A Statutory Public Meeting was held for this application on December 18, 1997. The purpose and effect of this by-law is to permit a detached residential dwelling as an exception in the "OS-HL" - Open Space Hazard Land Zone. Dlr~/e~ment JTB/jw Attachment Jtb'~x'ooklin~nemo.doc THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5720 / 00 Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended by By-law 5706/00, to implement the Official Plan of the City of Picketing District Planning Area, Region of Durham in Part of Lots 1 & 2, Concession 7, in the City of Picketing. (A 26/97; OPA 97-006/P; OPA 97-023/D; MZO 18-02999-02) WHEREAS the Council of the Corporation of the City of Picketing passed By-law 3037 as amended by By-law 5706/00, to zone the subject lands, being Part of LOt 1 & 2, Concession 7, in the City of Picketing, to permit the establishment of a golf course while protecting certain environmental areas; AND WHEREAS the Council of the Corporation of the City of Picketing now deems it desirable to permit the establishment of a detached dwelling and accessory buildings on a portion of the subject lands being Part 18, Plan 40R-19812. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: o TEXT AMENDMENT By-law 5706/00 is hereby amended by adding paragraph (3) to section 6 as follows: (3) Special Regulation ("OS-HL" Zone) Despite the provisions of subsections (1) and (2) above, a detached residential dwelling and accessory buildings shall be permitted on the lands cross hatched on Schedule I in accordance with the following provisions: (a) for a detached residential dwelling, the provisions of Section 6.2.1 of By-law 3037, shall apply. (b) for accessory buildings, the provisions of Section 5.18 of By-law 3037, shall apply. SCHEDULE I AMENDMENT Schedule I to By-law 5706/00 is hereby further amended by adding thereto cross hatching in the "OS-HL" Zone on a portion of the subject lands being Part 18, Plan 40R-19812. Accordingly, Schedule I to By-law 5706/00 is repealed and replaced by Schedule I attached. ~ BY-LAW 5706/00 By-law 5706/00 is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Section 1 and 2 above, and as set out in Schedule I attached hereto. Definitions and subject matter not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3037, as amended. 2 EFFECTIVE DATE This By-law shall take effect fi:om the day of'passing hereof subject to the approval of the Ontario Municipal Board, if required.
