BY-LAW NUMBER 4 ~. 3 ~/92
Being a By-law to amend Restricted Area (Zoning) By-law 2511, as amended, to
implement the Official Plan of the Town of Picketing District Planning Area, Region
of Durham, for Lots 4-14, 21-28, 34-38, 43-45, Plan M-90, and Lots 1-7, Plan M-917,
in the Town of Picketing. (A 12/91)
WHEREAS the Council of the Corporation of the Town of Picketing deems it desirable to
permit the development and redevelopment of detached and semi-detached residential
dwelling units on the subject lands being Lots 4-14, 21-28, 34-38, 43-45, Plan M-90, and Lots
1-7, Plan M-917, in the Town of Picketing;
AND WHEREAS an amendment to By-law 2511, as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:

Schedule I attached hereto with notations and references shown thereon is hereby
declared to be part of this By-law.
The provisions of this By-law shall apply to those lands in Lots 4-14, 21-28, 34-38, 43-45,
Plan M-90, and Lots 1-7, Plan M-917, in the Town of Pickering, designated "S-SD-l" on
Schedule I attached hereto.
3. GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved or
structurally altered except in conformity with the provisions of this By-law.
4. DEFINITIONS
In this By-law,
(1) (a) ~ shall mean a building or part of a building containing one or more
dwelling units, but does not include a mobile home or trailer;
(b) "Dwelling Unit" shall mean one or more habitable rooms occupied or capable
of being occupied as a single, independent and separate housekeeping unit
containing a separate kitchen and sanitary facilities;
(c) "Dwelling. Single or Single Dwelling" shall mean a dwelling containing one
dwelling unit and uses accessory thereto;
(d) "Dwelling. Detached or Detached Dwelling" shall mean a single dwelling which
is freestanding, separate and detached from other main buildings or structures;
(e) "Dwelling,. Semi-Detached or Semi-Detached Dwelline" shall mean one of a
pair of sfngle dwellings, such dwellings being attached ~ogether horizontally in
whole or in part above grade, or below grade, or both above and below grade;
(2) "Gross Floor Area - Residential" shall mean the aggregate of the floor areas of all
storeys of a building or structure, or part thereof as the case may be, other than a
private garage, an attic or a cellar;

(3) (a) "Lot" shall mean an area of land fronting on a street which is used or intended
to be used as the site of a building, or a group of buildings, as the case may be,
together with any accessory buildings or structures, or a public park or open
space area, regardless of whether or not such lot constitutes the whole of a lot
or block on a registered plan of subdivision;
(b) ~ shall mean the percentage of lot area covered by all buildings
on the lot;
(c) "Lot Fr0nta~,e" shall mean the width of a lot between the side lot lines
measured al6ng a line parallel to and 7.5 metres distant from the front lot line;
(4) "Private Garage" shall mean an enclosed or partially enclosed structure for the
storage of one or more vehicles, in which structure no business or service is
conducted for profit or otherwise;
(5) (a) "Yard" shall mean an area of land which is appurtenant to and located on the
same lot as a building or structure and is open, uncovered and unoccupied
above ground except for such accessory buildings, structures, or other uses as
are specifically permitted thereon;
(b) "Fr0n~ Yard" shall mean a yard extending across the full width of a lot between
the front lot line of the lot and the nearest wall of the nearest main building or
structure on the lot;
(c) "Front Yardi Depth" shall mean the shortest horizontal dimension of a front
card of a lot between the front lot line and the nearest wall of the nearest main
uilding or structure on the lot;
(d) "Rear Yard" shall mean a yard extending across the full width of a lot between
the rear lot line of the lot, or where there is no rear lot line, the junction point
of the side lot lines, and the nearest wall of the nearest main building or
structure on the lot;
(e) "Rear Yard Deoth" shall mean the shortest horizontal dimension of a rear yard
of a lot betweeh the rear lot line or, where there is no rear lot line the junction
point of the side lot lines, and the nearest wall of the nearest main building or
structure on the lot;
(f) "Side Yard" shall mean a yard of a lot extending from the front yard to the rear
yard and from the side lot line to the nearest wall of the nearest main building
or structure on the lot;
(g) "Side Yar0 Width" shall mean the shortest horizontal dimension of a side yard
of a lot between the side lot line and the nearest wall of the nearest main
building or structure on the lot;
(h) ~ shall mean a side yard immediately adjoining a street or
abutting on a reserve on the opposite side of which is a street;
(i) "Flankage Side Yard Width" shall mean the shortest horizontal dimension of a
flankage side yard of a lot between the lot line adjoining a street or abutting on
a reserve on the opposite side of which is a street and the nearest wall of the
nearest main building or structure on the lot;
(j) "Interior Side Yard" shall mean a side yard other than a flankage side yard.
5. PROVISIONS
(1) Uses Permitted ("S-SD-l" Zone)
No person shall within the lands designated "S-SD-l" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any
purpose except the following:
detached dwelling residential use
semi-detached dwelling residential use

(2) Z R uir m n CS-SD-l" Zone)
No person shall within the lands designated "S-SD-i" on Schedule I attached
hereto use any lot or erect, alter or use any building except in accordance with
the following provisions:
(a) LOT AREA (minimum): 200 square metres
(b) LOT FRONTAGE (minimum): 7.5 metres
(c) FRONT YARD DEPTH (minimum):
(i) where no dwelling units fronting the same street exist on the lots on
either side, the minimum front yard depth shall be 4.5 metres
(ii) where only one dwelling unit fronting the same street exists on the
lots on either side, the minimum front yard depth shall be the average
of the front yard depth of that dwelling and 4.5 metres
(iii) where a dwelling unit fronting the same street exists on each lot on
either side, the minimum front yard depth shall be the average of the
front yard depths of each of those dwellings
(d) INTERIOR SIDE YARD WIDTH:
(i) for single detached dwellings:
A no minimum one side, minimum 1.2 metres other side or
B minimum 0.6 metres both sides
(ii) for semi-detached dwellings: minimum 1.2
metres, except that,
A where dwellings on abutting lots share a common wall, no interior
side yard shallbe required adjacent to that wall on either lot;
B where dwellings on abutting lots share a common wall and one of
those dwellings has an extension of that common wall that extends
along the common interior side lot line, no interior side yard shall be
required adjacent to the extension of that wall on the lot upon which
that dwelling is located;
C where dwellings on abutting lots share a common wall and one of
those dwellings has an extension of that common wall that does not
extend along the common interior side lot line;
(I) minimum 1.2 metre interior side yard shall be provided adjacent
to the extension of that wall on the lot upon which that dwelling
is located if an abutting interior side yard is not provided on the
other lot, or
(II) minimum 0.6 metre interior side yard shall be provided adjacent
to the extension of that wall on the lot upon which that dwelling
is located if an abutting interior side yard is provided on the
other lot;
(e) FLANKAGE SIDE YARD WIDTH (minimum): 2.7 metres
(f) REAR YARD DEPTH (minimum): 7.5 metres
(g) LOT COVERAGE (maximum): 45 per cent
(h) BUILDING HEIGHT (maximum): 7.5 metres
(i) DWELLING UNIT REQUIREMENTS: maximum one
dwelling unit per lot and minimum gross floor area-residential of 60
square metres
0) PARKING REQUIREMENTS:
minimum one parking space being at least 2.6 metres in width and 5.3
metres in lengthper lot

(k) SPECIAL REGULATIONS:
(i) The minimum horizontal separation distance between a dwelling
on a lot and any building or structure on any abutting lot shall be
1.2 metres.
(ii) All accessory buildings or structures which are not part of the main
building shall be erected in the rear or side yard with no minimum
setback required from any lot line.
(iii) The maximum height of any accessory building or structure shall be
4.5 metres;
(iv) Despite the definition of "Dwelling, Semi-Detached or
Semi-Detached Dwelling" in Section 4(1)(e) a Semi-Detached
Dwelling erected in a "S-SD-l" zone shall be attached above grade
by a common wall which shall be not less than 3.0 metres in length
and not less than 2.4 metres in height.
6. HOLDING SYMBOL
(1) Prio. r to an amendment to remove the "(H)" holding symbol preceeding the use
designation "S-SD-I" the following conditions shall be met:
(a) the land to which the "(H)" holding symbol applies shall be fully serviced, to the
lot line, with municipal sanitary sewers and water supply; and
(b) Waterpoint Street shall be dedicated as a public highway.
(2) Despite the provisions of clause 5(1) while the "(H)" holding symbol is in place no
person shall within the lands designated "(H) S-SD-l" on Schedule I attached hereto,
use any lot or .erect a. lter or use a. ny buildings or structure for any purpose except
detached dwelhng residential uses in accordance with the provisions of Section 10 of
By-law 2511, as amended.
7. BY-LAW
(1) By-law 2511, as amende.d, is hereby further amended only to the extent necessary to
give effect to the provisions of this By-law as it applies to the area set out in
Schedule I attached hereto.
(2) Definitions and subject matters not specifically dealt with in this By-law shall be
governed by the relevant provisions of By-law 2511, as amended, except that Section
5.8 shall not apply to the area set out in Schedule I attached hereto.
8. EFFECq2VE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.
