Being a by-law to authorize the execution of Transfers of
storm sewer easements to The Corporation of the Town
of ?ickering in Plans 40M-1350, 40M-1375 and
40M-1456, Picketing.
WHEREAS The Corporation of the Town of Picketing requires storm sewer easements over parts of
Blocks 102 and 103, Plan 40M-1350, Picketing, parts of Lots 16 and 29, Plan 40M-1375, Picketing and
parts of Lots 4, 5 and 8, Plan 40M-1456, Pickering, for the purpose of draining storm water through the
said plans, and pursuant to the provisions of section 191 of the Municipal Act, R.S.O. 1990, Chap.
M.45, the Council of The Corporation of the Town of Picketing may pass by-laws for acquiring
interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, in
the form attached hereto as Schedule A, from Michele Tracy Chiapponi to The Corporation of
the Town of Picketing, over that part of Block 102, Plan 40M-1350, Picketing, designated as
Part 3, Plan 40R-9460.
2. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easemeut, m
the form attached hereto as Schedule B, from Kenneth Berg and Myra Berg to The Corporariou
of the Town of Picketing, over that part of Block 103, Plan 40M-1350, Picketing, designated as
Part 4, Plan 40R-9460.
3. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, m
the form attached hereto as Schedule C, from Rajendra Paul Rawana and Radha Sonia Rawana
to The Corporation of the Town of Picketing, over that part of Lot 16, Plan 40M-1375,
Pickering, designated as Part 4, Plan 40R-9154.
4. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, m
the form attached hereto as Schedule D, from Michael Ernest Weaver and Jean Margaret
Weaver to The Corporation of the Town of Picketing, over that part of Lot 29, Plan 40M- 1375,
Picketing, designated as Part 2, Plan 40R-9154.
5. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, ~n
the form attached hereto as Schedule E, from Geraldine Clarkson to The Corporation of the
Town of Picketing, over that part of Lot 4, Plan 40M-1456, Picketing, designated as Part 1,
Plan 40R-10143.
6. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, ~n
the form attached hereto as Schedule F, from John Bietola and Cheryl Ann Bietola to The
Corporation of the Town of Picker'mg, over that part of Lot 5, Plan 40M-1456, Pickering,
designated as Part 2, Plan 40R-10143.
7. The Mayor and Clerk are hereby authorized to execute a Transfer of storm sewer easement, m
the form attached hereto as Schedule G, from Robert Cattle and Elaine Cattle to The
Corporation of the Town of Pickering, over that part of Lot 8, Plan 40M-1456, Picketing,
designated as Part 1, Plan 40R-12160.
BY-LAW read a first, second and third time and finally passed this 29th day of June, 1992.

from time to time in, under and across the lands herein described, toiether

vehicles to enter upon the lands at all times and to pass and repass thereon for

3, The Transferor hereby releases the Transferee from any claim which may arise
out of the exercise by the Transferee of the right and easement granted hcre-
by, or which may arise out of the existence or operation of the storm drainage
works, provided the Transferee fills In all excavations and as far as ia practi-
cable restores thc surface to the condition existing prior to any entry thereon
to exercise the right hereby granted.
The Transferor covenants that It shall execute such further assurances of the
right and casement granted hereby aS may be required by the Transferee,

with the lands herein described.
6, This Transfer shall be binding upon and shall enure to thc bcncllt of thc

together with the right to the Transferee, its servants, agents and contractors with all necessary
vehicles, supplies and equipment to enter onto the lands andpass and repass over the lands for
the pu~ose of exercising or enjoying any of the rights granted herein.
The terms and conditions which the parties hereto covenant and agree to observe and he bound
by are as follows:
1. The Transferee shaH, except in case of emergency, before commencing any wedt
authorized hereby, give to the Transferor forty-eight hours previous written notice
thereof, and in cases of emergency such previous notice thereof as b reasonably
possible.
2. Upon completion of any wot~, the Transferee shall Fall in aH excavations, restore fences,
and restore the surface of the ground by restoring aH topsoil and grass: cover disturbed
thereby, and do necessary grading to ensure soil and slope stability, and remove all
equipment.
3. The Transferor shaH not erect any building or structure (except a fence) un the lands,

4. The right and easement granted herein shall he subject to all leases, licences, and any
rights of use or occupation existing at the date hereof, and the Transferor may from time
to time renew or extend these or make new ones, so long as they do not interfere
unreasonably with the right and easement herein granted.
5. The Transferor hereby releases the Transferee from any claim which may arise out of
the exercise by the Transferee of the right and easement granted hereby or which may
arise out of the existence, operation or non-operation of the storm drainage works
provided the Transferee has complied with all of the terms and conditions herein.
6. The Transferor shaH execute such further assurances of the right and easement granted
hereby as the Transferee may reasonably request in writing.
7. The burden of this Transfer and of all the terms and conditions contained herein shall
mn with the lands.
8. This Transfer and ali of the terms and conditions contained herein shall enure to the
benefit of and he binding upon the Transferor and the Transferee and their respective
heirs, executors, administrators, successors and assigns.
