HomeMy WebLinkAboutBy-law 5621/00THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5621/00 Being a by-law to licence and regulate carnivals and other like shows operating in the City of Picketing. WHEREAS pursuant to Section 236(7) of the Municipal Act, R.S.O. 1990, c. M.45, as amended, a Council of a local municipality may pass by-laws for prohibiting or regulating and licensing exhibitions of wax works, menageries, circus-riding, and other like shows usually exhibited by showpersons, and for regulating and licensing roller skating rinks and other places of like amusement, and merry-go-rounds, switchback railways, carousels and other like contrivances; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. In this by-law, "Amusement Device" means a machine, contrivance, structure or vehicle used in an amusement park to entertain members of the public by moving them or causing them to be moved. b) "Carnival" means an exhibition, display, event or amusement show which may include the operation of one or more amusement devices. c) "City" means the Corporation of the City of Pickering. No person shall operate a carnival in the City without first obtaining a licence from the City, which licence shall be called a Carnival Licence. o The owner or operator of a Carnival shall not operate within 100 metres from the lot line of any residential property without the prior written consent of the occupants of the residential properties within that distance. A Carnival Licence shall expire on the date of termination of the event or activity to which the licence relates unless it is sooner forfeited or revoked. The fee for a Carnival Licence shall be $100.00 for the first day of operation and $50.00 for each subsequent day of operation. 6. A Carnival Licence shall not be issued for a period that exceeds seven consecutive days. An application for a Carnival Licence shall include, A copy of an insurance policy in a minimum amount of one million dollars, inclusive limits, naming the City as an insured for loss or damage resulting from bodily injury to, or the death of one or more persons, and for loss or damage to property arising out of the activity or event to which the licence relates. b) c) d) e) The licence fee as noted in Section 5 of this By-law. A sketch of the property on which the Carnival is to be held showing the location of the Carnival on that property and its location relative to surrounding properties. A copy of the applicant's current Amusement Device Licence issued pursuant to the Amusement Devices Act, R.S.O. 1990, c. A. 20, as amended. A list of all amusement devices to be operated at the proposed Carnival and a copy of the Amusement Device Permit issued pursuant to the Amusement Devices Act for each amusement device. A Carnival shall not be operated between the following hours: a) Sunday to Thursday - 10:00 p.m. through to 10:00 a.m. the next day; and b) Friday and Saturday - midnight through to 10:00 a.m. the next day. Any person who contravenes any provision of this By-law is guilty of an offence and upon conviction thereof is liable to a fine of not more than Five Thousand ($5,000.00) Dollars, for each offence committed.
