BY-LAW NO. 4152/93
Being a by-law to require that land be conveyed to the
Town for park or other public recreational purposes as a
condition of development or redevelopment anywhere in
the Town.
WHEREAS, pursuant to subsection 42(1) of the Planning Act, R.S.O. 1990, chapter P.13, the Council of
The Corporation of the Town of Picketing may by by-law applicable to the whole municipality require
that land in an amount not exceeding, in the case of land proposed for development or redevelopment
for purposes other than commercial or industrial purposes, 5 per cent of the land be conveyed to the
Town for park or other public recreational purposes, as a condition of development or redevelopment of
the land; and
WHEREAS, pursuant to subsection 42(6) of the Act, the Council may require the payment of money to
the value of the land otherwise required to be conveyed in lieu of such conveyance, the amount of such
payment to be determined in accordance with the Act;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. As a condition of the development or redevelopment of land proposed to be used for purposes
other than commercial or industrial purposes, the owner thereof shall convey to the Town, free
and clear of all encumbrances and at no cost to the Town, land in an amount equal to 5 per cent
of the land to be developed or redeveloped.
2. Alternatively, the owner may, with the Town's consent, make to the Town a payment of money
to the value of the land otherwise required to be conveyed by this By-law.
3. This By-law shall apply to the whole of the Town of Pickering.
4. This By-law shall at all times be subject to the provisions of section 42 of the Planning Act,
R.S.O. 1990, chapter P.13, as amended from time to time, or any successor thereto.
