BY-LAW NUMBER 5479/99
Being a by-law to licence and regulate carnivals and other
like shows operating in the Town of Picketing.
WHEREAS pursuant to Section 236(7) of the Municipal Act, R.S.O. 1990, c. M.45, as
amended, a Council of a local municipality may pass by-laws for prohibiting or regulating
and licensing exhibitions of wax works, menageries, circus-riding, and other like shows
usually exhibited by showpersons, and for regulating and licensing roller skating rinks and
other places of like amusement, and merry-go-rounds, switchback railways, carousels and
other like contrivances;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. In this by-law,
"Carnival" means an exhibition, display, event or amusement show which
may include the operation of one or more amusement devices or midway
style attractions.
b) "Council" means the Council of the Corporation of the Town of Pickering.
c) "Town" means the Corporation of the Town of Pickering.
No person shall operate a carnival in the Town of Pickering without first obtaining
a license from the Town, which licence shall be called a Carnival Licence.
A licence issued pursuant to this by-law shall first be approved by resolution of
Council.
A Carnival Licence shall expire on the date of termination of the event or activity
to which the licence relates unless it is sooner forfeited or revoked and in any case
shall not be for a longer period than one year.
The fee for a Carnival Licence shall be $100.00 for the first day of operation and
$25.00 for each subsequent day of operation.
6. An application for a Carnival Licence shall include,
A copy of an insurance policy in a minimum amount of one million dollars,
inclusive limits, naming the Town as an insured for loss or damage
resulting from bodily injury to, or the death of one or more persons, an for
loss or damage to property arising out of the activity or event to which the
licence relates.
b) The licence fee as noted in Section 5 of this By-law.
7. A carnival shall not be operated between the following hours:
a) Sunday to Thursday - 10:00 p.m. through to 10:00 a.m. the next day; and
b) Friday and Saturday - midnight through to 10:00 a.m. the next day.

Any person who contravenes any provisions of this By-law is guilty of an offence
and upon conviction thereof is liable to a fine of not more than Five Thousand
($5,000.00) Dollars, for each offence committed.
By-law read a first, second and third time and finally passed this 6th day of April, 1999.
