HomeMy WebLinkAboutBy-law 4501/94 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 4 5 0 3./9 4 Being a By-law to amend Restricted Area (Zoning) By-law 2175/86, which amended Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham in Part of Lot 26, Plan 492 and Part of Lot 23, Concession 1, in the Town of Picketing. (A 28/93) WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 2175/86, amending By-law 3036, to permit the development of a commercial plaza with no restaurant uses, as well as a freestanding eat-in only restaurant with specific floor areas on the subject lands being Part of Lot 26, Plan 492 and Part of Lot 23, Concession 1, in the Town of Pickering; AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it desirable to further amend By-law 3036, as amended by By-law 2175/86, to permit a restaurant with an accessory take-out component in the commercial plaza on the subject lands. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. Section 4.(9) of By-law 2175/86, is hereby renumbered as 4.(9)(a) and the following inserted as Section 4.(9)(b): (b) ~ - shall mean a building or part of a building where food is prepared and offered or kept for retail sale to the public for immediate consumption on the premises, and which may include an accessory take out component. 2. Section 5.(1)(a)(vii) of By-law 2175/86, is hereby renumbered as section 5.(1)(a)(viii) and the following inserted as a new section 5.(1)(a)(vii): (vii) Restaurant - Type D, subject to the provisions of paragraphs (E) and (F) of subclause (ix) of clause (b) of this subsection. 3. Section 5.(l)(b)(v) of By-law 2175/86, is hereby revoked and the following substituted therefor: (v) LOT COVERAGE (maximum): 35% 4. Section 5.(1)(b)(vii) of By-law 2175/86, is hereby revoked and the following substituted therefor: (vii) GROSS LEASABLE FLOOR AREA (maximum): 1605 square metres 5. Section 5.(l)(b)(ix)C of By-law 2175/86, is hereby revoked and the following substituted therefor: C The gross leasable floor area of all Restaurants - Type B, shall not exceed 776 square metres; -2- 6. Section 5.(1)(b)(ix) of By-law 2175/86, is hereby amended by adding the following new paragraphs E and F: E A maximum of one Restaurant - Type D, shall be permitted with a gross leasable floor area not exceeding 78 square metres; F Notwithstanding any other provisions of this By-law, Restaurant - Type D, shall be permitted only on that part of the lands designated "CI 1" on schedule "I" which are not cross-hatched on schedule II attached hereto. This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required. READ A FIRST AND SECOND TIME THIS 3 rd DAY OF October ,1994.
