Being a By-law to adopt Amendment Number 89 to the District Plan for
the Town of Pickering (OPA 94-013/P)
WHEREAS pursuant to the Planning Act, R.S.O. 1990, chapter P. 13, Subsections 17(6) and
21(1), the Council of the Corporation of the Town of Picketing may by by-law adopt
amendments to the District Plan for the Town of Picketing, being an official plan, and submit
them to the Region of Durham for approval.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. Amendment Number 89 to the District Plan for the Town of Picketing, attached hereto as
Exhibit "A" and including the Explanatory Text, is hereby adopted.
2. The Clerk of the Town of Pickering is hereby authorized and directed to submit Amendment
Number 89 to the District Plan for the Town of Picketing to the Region of Durham for
approval.
3. This By-law shall come into force and take effect on the day of the final passing hereof.

AMENDMENT NO. 89 TO THE
TOWN OF PICKERING DISTRICT PLAN

AMENDMENT NO. 89 TO THE PICKERING DISTRICT PLAN
(Woodlands Community Plan, Part A: Kingston Road - Highway 401 Corridor)
PURPOSE: The purpose of this amendment is to provide a mix of uses on the
subject lands, by expanding the range of permitted retail
commercial and personal service uses, and adding office,
residential and community uses as permitted uses. This
amendment implements the results of the Town Centre West Urban
Design and Land Use Study on the subject lands.
LOCATION: The subject lands have an approximate area of 0.5 hectares, and are
located on the south side of Kingston Road, across from Walnut
Lane in the Town of Picketing. The lands are generally described
as Part of Lot 24, Concession 1, in the Town of Picketing, and
specifically as Parts 1, Plan 40R-10821 and Parts 2 and 3,
Plan 40R-6862.
BASIS: This amendment is considered appropriate as it will enable the
existing plaza to better serve the retailing and office needs of the
existing residential community to the north, and over the long
term, enable a mix of retail commercial, office, community and
residential uses that would be compatible with the mixed use
neighbourhood that is proposed for the lands surrounding the
subject property.
ACTUAL The Town of Picketing District Plan (Woodlands Community
AMENDMENT: Plan, Part A: Kingston Road - Highway 401 Corridor) is hereby
amended by:
1. Adding clause (f) to section 3.B. ~, as follows:
(f) Despite the provisions of Section 3.C. of this Plan
and in accordance with the Mixed Use
Commercial land use category of the
Council-adopted Town Centre West Urban
Design and Land Use Study, lands located on the
south side of Kingston Road, in Part of Lot 24,
Concession 1, and specifically known as Parts 1,
Plan 40R-10821 and Parts 2 and 3,
Plan 40R-6862 in the Town of Pickering, may be
used for retail uses, personal service shops,
offices, community uses, and residential uses.
Residential uses shall be permitted up to a
maximum density of 100 units per net hectare.
To assist in the preparation of appropriate
zoning by-laws and to ensure the appropriate
integration of permitted uses, all development
shall have regard for the Council-adopted design
guidelines for the Town Centre West Area.

IMPLEMENTATION: The provisions set forth in the Town of Picketing District Plan, as
amended, regarding the implementation of the Plan shall apply
with regard to this Amendment.
INTERPRETATION: The provisions set forth in the Town of Pickering District Plan, as
amended, regarding the interpretation of the Plan shall apply with
regard to this Amendment.

RECOMMENDED CONDITIONS OF APPROVAL FOR
ZONING BY-LAW AMENDMENT APPLICATION A 13/94
That Town Council approve in principle as revised Zoning By-law Amendment Application
A 13/94 subject to the following conditions:
1. That prior to the forwarding an implementing Zoning By-law for Council's consideration,
the Town and the owner enter into an agreement to convey to the Town all lands
identified for public walkway purposes by the Town Centre West Urban Design and Land
Use Study, and make satisfactory arrangements with the Town regarding the construction
of this walkway; and
2. That the implementing Zoning By-law:
(a) Include provisions that reflect the standards and design guidelines of the Town Centre
West Urban Design and Land Use Study, as approved with amendments by Council
on February 20, 1995, with specific regard to matters including building setbacks,
build-to lines and heights, on-site parking, and lot coverage;
(b) Include provisions that enable the existing retail plaza to remain on the site;
(c) Include provisions that revise the required parking to reflect the supply that remains
following the conveyance to the Town of lands for walkway purposes; and
(d) Permit a range of residential uses, business and professional offices, community uses,
and retail commercial uses including, but not limited to, retail stores, personal service
shops, commercial clubs, commercial school, financial institutions, private club, and
restaurants, but prohibit adult entertainment and body rub parlours, and video arcades.
