BY-LAW NO, 4652/95
Being a by-law to authorize the purchase of those lands
being Water Lots 1, 2, 4, 5, 6 and 7 and Part of Water Lot
3, Plan 65, Pickering, from James McKean and Keen Kraft
Marina Co. Limited
WHEREAS, Section 191(1) of the Municipal Act, R.S.O. 1990, chapter M.45 authorizes the Town of
Picketing to acquire lands for municipal purposes;
AND WHEREAS the Town of Picketing wishes to acquire certain lands for municipal purposes;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
1. The Town of Picketing shall enter into an agreement to purchase Water Lots 1, 2, 4, 5, 6 and 7 and
Part of Water Lot 3, Plan 65 in the Town of Pickering in the Regional Municipality of Durham from
James McKean and from Keen Kraft Marina Co. Limited. The transaction to be closed on or before
the 29th day of September, 1995. The Agreement shall be conditional upon the following matters:
(a) that clear title to the lands be given upon closing, free and clear of all encumbrances;
(b) that the closings be cross conditional;
(c) that the Town and its agents be entitled to full access to the lands up to the date of closing to
conduct all necessary inspections and soil tests;
(d) that the Town be satisfied on or before September 15, 1995 that the lands are free of
environmental contaminations and meets CMHC standards;
(e) that the Town be satisfied on or before Sept. 15, 1995 that the structures located on the lands
are in satisfactory condition in accordance with usual Town standards for municipally owned
buildings, and that they comply with the Building Code;
(f) that all adjustments be made to the date of closing for outstanding realty taxes and utility
charges;
(g) that the Primrose be removed from Frenchman's Bay on or before September 15, 1995 at the
Owner's expense;
(h) that all debris be removed from the subject lands to the satisfaction of the Town's Director
of Works, prior to closing;
(i) that before the closing date the vendor satisfy the Town that the metal sea wall has been
relocated at the vendor's expense, and no longer encroaches on the abutting lands.
2. The purchase price shall be $ 825,000.00
BY-LAW read a first, second and third time and finally passed this 17th day of July, 1995.
