BY-LAW NO. 4986/97
Being a by-law to stop-up, close and sell as public
highway part of Begley Street, Plan 355, Pickering, being
Parts 1, 3, 4, 5, 7, 9 and 10, Plan 40R-17411, Part of Bay
Street, Plan 355, Pickering, being Part 9, Plan 40R-
16457 and part of Hillside Drive, Plan 355, Picketing,
being Part 10, Plan 40R-16457 and to authorize their
sale to abutting owners and to stop-up and close to
vehicular traffic that part of Begley Street being Parts 2,
6 and 8, Plan 4OR-17411.
WHEREAS, that portion of Begley Street is a highway shown on a plan of subdivision (Plan 355,
Picketing) and is therefore deemed to be a public highway pursuant to section 57 of the Surveys Act,
R.S.O. 1990, chapter S.30; and
WHEREAS, pursuant to sections 19l(1), 297(l)(c), 297(1)(d) and 315 of that Act, the Council of the
Town may pass by-laws to stop-up a highway or part thereof and to authorize its sale or the sale of a part
thereof;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
1. The following portions of highway are hereby stopped up and closed to both vehicular and
pedestrian traffic:
(a) part of Begley Street, Plan 355, being Parts 1, 3, 4, 5, 7, 9 and 10, Plan 40R-1741 I;
(b) that part of Bay Street, Plan 355, being Part 9, Plan 40R-16457; and
(c) that part of Hillside Drive, Plan 355, being Part 10, Plan 40R-16457.
2. The following portions of highways are hereby stopped up and closed to vehicular traffic only:
(a) part of Begley Street, Plan 355, being Parts 2, 6, and 8, Plan 40R-17411.
3. Those parts of Begley Street, Plan 355, Picketing, designated as Parts 1, 3, 4, 5, 7, 9 and 10, Plan
40R-17411, shall be offered for sale to the abutting owners at a total sale price of $40,000,
subject to an easement in favour of The Corporation of the Town of Picketing for the purposes of
ingress and egress and for the purposes of maintaining storm sewers.
4. That part of Bay Street and Hillside Drive, Plan 355, Picketing, designated as Parts 9 and 10,
Plan 40R-16457, shall be offered for sale to the abutting owners at a sale price of $2.00.
5. The Corporation of the Town of Picketing shall dispose of utility easements over any of the
lands described in sections 1 and 2, above, that presently contain utility structures of any nature
or sort, to the appropriate utility authority, including, but not necessarily limited to Picketing
Hydro, at a sale price of $2.00 each.
6. The Mayor and the Clerk are hereby authorized to grant an easement in favour of the Regional
Municipality of Durham on Parts 2, 6 and 8, Plan 40R-17411 at a sale price of $2.00.
7. The Mayor and the Clerk are hereby authorized to execute any documents approved by the Town
Solicitor and required to effect the dispositions, offers, transfers and easement as provided for in
this By-law.
BY-LAW read a first, second and third time and finally passed this 21 st day of April, 1997.
