BY-LAW NO. 5364/98
Being a by-law to authorize the sale of surplus municipal
lands being Part of Lot 33, Range 3, B.F.C., Pickering,
designated as Parts 5, 6 and 7, Plan 40R-8386 (now
designated as Parts 1 and 2, Plan 40R-X;YXXX), in
accordance with By-Law 4592/95 and to authorize the
acquisition of a sewer easement, if necessary, over such
lands.
WHEREAS, The Town of Picketing on April 3, 1995 passed By-Law 4592/95 to establish procedures
to regulate the sale of Municipal Real Property pursuant to section 193(2) of the Municipal Act, R.S.O.
1990 c.M.45, as amended;
AND WHEREAS by Resolution No. 116/98, the Council of The Corporation of the Town of Picketing
declared the lands being that Part of Lot 33, Range 3, B.F.C., Picketing, designated as Parts 5, 6 and 7,
Plan 40R-8386 as surplus to the needs of the Municipality;
AND WHEREAS The Corporation of the Town of Picketing desires to sell part of the surplus lands to
the owner of the abutting lands;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
Those lands lying and being in the Town of Pickering, in the Regional Municipality of Durham
legally described as Part of Lot 33, Range 3, B.F.C., Picketing, and being more particularly set
out as Part 1, Plan 40R-XXXXX shall be sold to Armand Reale, in accordance with By-Law
4592/95;
Those lands lying and being in the Town of Picketing, in the Regional Municipality of Durham
legally described as Part of Lot 33, Range 3, B.F.C., Picketing, and being more particularly set
out as Part 2, Plan 40R-XXXXX shall be sold to Royal Holdings Canada Limited, in accordance
with By-Law 4592/95;

That the total sale price for Parts 1 and 2 shall be the sum of 90,000 plus the Town's actual costs
for advertising and appraisal fees.
The sale of the lands described as Part of Lot 33, Range 3, B.F.C., Picketing, designated as Parts
1 and 2, Plan 40R-XXXXX shall be conditional upon the Purchaser agreeing to immediately
convey to the Town/Region any easement(s) required for sewer or other municipal purposes to
The Corporation of the Town of Picketing/The Regional Municipality of Durham in a form
acceptable to the Town Solicitor. The easement(s) shall be conveyed immediately following the
closing of the sale transaction and prior to the registration of any encumbrances on the lands, at
no cost to the Town of Picketing or to the Regional Municipality of Durham.
BY-LAW read a first, second and third time and finally passed this 4th day of August, 1998.
