HomeMy WebLinkAboutBy-law 5363/98THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 5363/98 Being a By-law to adopt Amendment 2 to the Official Plan for the Town of Picketing (OPA 98-003/P) WHEREAS pursuant to the Planning Act, R.S.O. 1990, chapter P. 13, Subsections 17(22) and 21(1), the Council of the Corporation of the Town of Picketing may, by by-law, adopt amendments to the Official Plan for the Town of Pickering, being an official plan, and submit them to the Region of Durham for approval; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: Amendment 2 to the Official Plan for the Town of Picketing, attached hereto as Exhibit "A" and including the Explanatory Text, is hereby adopted. The Clerk of the Town of Picketing is hereby authorized and directed to submit Amendment 2 to the Official Plan for the Town of Picketing, to the Region of Durham for approval. 3. This By-law shall come into force and take effect on the day of the final passing hereof. BY-LAW read a first, second and third time and finally passed this 4thday of August ,1998. QUINN ACTING CLERK Exhibit "A" to By-law 5 3 6 3/9 8 AMENDMENT 2 TO THE TOWN OF PICKERING OFFICIAL PLAN AMENDMENT 2 TO THE TOWN OF PICKERING OFFICIAL PLAN PURPOSE: LOCATION: BASIS: ACTUAL AMENDMENT: IMPLEMENTATION: INTERPRETATION: OPA 98-003/P Town Initiated: Picket'inS Rmal Study Implementation Amendment 2 August 4/98 The purpose of this amendment to the Pickering Official Plan is to delete the Rural Study Area on lands west of the West Duffins Creek and within this area, identify certain additional lands as part of the Open Space System. The amendment would apply to certain lands west of the West Duffins Creek in the Town of Pickering. This amendment to the Pickering Official Plan has been determined to be appropriate following completion of the Pickering Rural Study in the Spring of 1998. The Pickering Rural Study concluded that no changes are necessary to the urban/rural boundary as currently identified in the Durham Regional Official Plan and the Picketing Official Plan, and that minor additions should be made to the ecological system boundary identified in the Picketing Official Plan. The Town of Pickering Official Plan be amended by: Deleting text policy 3.20, Rural Study Areas (Rural Lands) which reads as follows: 3.20 Town Council shall recognize as a Rural Study Area on Schedule I, lands on the west side of the West Duff'ms Creek, and, shall eliminate the Study Area boundary upon completion of an appropriate study that reviews the boundary between the ecological, rural, and urban systems in relation to the area, considering current environmental, open space and wildlife linkages, agricultural, social, and economic conditions. e On Schedule I - Land Use Structure to the Pickering Official Plan: (a) Deleting the "Rural Study Area" boundary located on lands west of the West Duffins Creek as illustrated on Schedule A attached to this Amendment; and (b) Expanding the "Open Space System-Natural Areas" designation as illustrated on Schedule A attached to this Amendment. The provisions set forth in the Town of Picketing Official Plan, as amended, regarding the implementation of the Plan shall apply in regard to this Amendment. The provisions set forth in the Town of Picketing Official Plan, as amended, regarding the interpretation of the Plan shall apply in regard to this Amendment. Accordingly, the Town Clerk shall renumber the sections that follow the deleted section 3.20, delete the policy heading, and revise related section cross-references that appear elsewhere in the Plan.
