NOTICE OF MOTION

WHEREAS numerous personal properties within the City of Pickering back upon
watercourse ravine areas; and
WHEREAS the removal of trees from these environmentally sensitive areas can
lead to erosion, loss of habitat and loss of aesthetic value adjacent to park land;
and
WHEREAS the former municipalities of East York and Scarborough already have
by-laws to control tree removal from properties adjacent to ravines and the City
of Toronto is preparing to implement a city-wide by-law;
NOW THEREFORE the Council of the Corporation of the City of Pickering directs
staff to prepare a draft by-law for consideration of Finance and Operations
Committee that would require residents backing onto watercourse ravine areas to
obtain a permit for felling healthy trees; and
THAT the said by-law include a permit fee and fines for violation of the by-law;
and
THAT the by-law clearly outline very limited circumstances where the felling of
healthy trees would be permitted; and

WHEREAS an incident occurred in the City of Pickering on October 10, 2002
wherein a child was bitten so severely by a neighbour's dog that the child was
taken to the hospital emergency department for treatment; and
WHEREAS the incident took place on a public road and the child did not provoke
the dog in any way; and
WHEREAS Section 9(1) of City of Pickering By-law Number 5728/00 (Cat & Dog
By-law) states:
Where a 'dog has bitten a person or domestic animal, the animal
control and pound supervisor may, at his or her discretion, order the
dog to be muzzled or leashed or both, for a period of time to be
determined by the animal control and pound supervisor and the
owner of the dog shall comply therewith.
WHEREAS the Supervisor, Animal Services Centre determined that it was not
necessary to order the dog that was involved in the October 10th incident to be
muzzled; and
WHEREAS the only other alternative left to the Mother of the child that was bitten
to ensure the safety of her child was to make a civil application under the Dog
Owners' Liability Act to have the offending dog destroyed; and
WHEREAS Section 4(1) of the Dog Owners' Liability Act states that "If it is
alleged that a dog has bitten or attacked a person or domestic animal, a
proceeding may be commenced against its owner .... "; and
WHEREAS a proceeding under Section 4(1) of the Dog Owners' Liability Act may
be made by the municipality in addition to the person that was attacked by the
dog or other interested party; and

WHEREAS it is the responsibility of the municipality and its agent being the PAW
Animal Services Centre to ensure the safety of its residents through aggressive
enforcement and application of its by-laws;
NOW THEREFORE the Council of the Corporation of the City of Pickering
hereby requests the Pickering, Ajax and Whitby Joint Animal Services Committee
to direct the staff of the Animal Services Centre to immediately impose a
muzzling and leashing order on the owner of a dog that has bitten a person upon
being informed of the biting incident; and
FURTHER THAT such muzzling and leashing order remain in effect until the
owner of the dog can prove definitively that they have effective control of the dog
or until a decision is made by the PAW Joint Animal Services Committee in the
event that the owner of the dog appeals the muzzling and/or leashing order; and
FURTHER THAT the Supervisor, Animal Services Centre immediately inform the
Clerk of the City of Pickering of any incidents involving a dog bite in order for the
City to consider making a proceeding against the owner of the dog under the Dog
Owners' Liability Act.

KROSNO CREEK FLOODPLAIN MAPPING STUDY
That Report OES 45-02 regarding the Krosno Creek Floodplain Mapping

That staff from the City of Pickering continue working with TRCA to facilitate a
public consultation process to advise landowners within the watershed of the
implications of the study and recommendations for next steps to implement
solutions; and
That staff be authorized to initiate a Request for Proposal for consulting
services to conduct a Class Environmental Assessment for Krosno Creek
Floodplain Remediation Strategies, subject to approval of this item in the
2003 Current Budget.

Please find attached to this memo the following documentation:
A copy of my letter dated October 11, 2002 to the Federal Electoral boundaries
Commission for Ontario setting out Council's position as of that date on the
proposed restructuring of the Federal electoral boundaries in the Region of
Durham.
A letter dated August 19, 2002 from Doug Moffatt, Mayor, Township of Scugog,
to all Council's in the Region of Durham suggesting an alternative to the
proposed Federal electoral boundaries.
A letter dated September 25, 2002 from the Commissioner of Planning for the
Region of Durham requesting comments on the alternatives suggested by Mayor
Moffatt and enclosing a map and table setting out population figures used for the
purpose of determining Federal electoral boundaries.
I understand that the Region of Durham may be considering comments on the
proposed Federal electoral boundaries and Mayor Arthurs is scheduled to address the
Federal Electoral Boundaries Commission at a hearing to be held in VVhitby on Friday,
November 8th. I have been directed by Mayor Arthurs to include this issue on the
Agenda for the Council Meeting of November 4th in the event that Members of Council
wish to provide alternatives to the position set out in my letter of October 11th.

Electoral Boundaries Restructuring Within the Regional Municipality
of Durham
Dear Sir / Madam:
Please be advised that at its regular meeting of September 17, 2002, the Council of the
City of Picketing considered the proposed electoral boundaries restructuring within the
Regional Municipality of Durham.
The current proposal provides for a Federal riding called Pickering-Durham that will
include the western half of the urban population of the City of Pickering and add it to
the Townships of Brock, Scugog and Uxbridge. This proposed riding will have a
population of 99,646 based on Statistics Canada's 2001 population figures. ~
Another proposed Federal riding called Ajax-Pickering would include the eastern half of
the urban population of Pickering and add it the Town of Ajax. This proposed riding will
have a population of 110,957 based on Statistics Canada's 2001 population figures.
Pickering Council stated that the proposed Pickering-Durham riding is unacceptable
because it will divide the City's urban population and half of that population will be
added to that of three rural townships. The urban interests of the Pickering population
are very different from those of the three rural townships.

City Council has requested that the Commission give consideration to a Federal riding
that would include only the City of Pickering. The population of Pickering based on
Statistics Canada's 2001 population figures is 87,139 and based on a Provincial
quotient of 107,642, this would create a deviation from the Provincial quotient of minus
19.01%. This deviation should not be considered.significant given the fact that the City
of Picketing is on the verge of significant development to the north of our present urban
area within the next five years.
City Council has not had sufficient opportunity to explore any alternatives to the
preferred proposal noted above, however, such alternatives may be presented at the
public hearing to be held in VVhitby on November 8, 2002.
It is important to note that the City of Pickering's "community of interest" in Federal and
Provincial issues are much the same as those found in the urban populations of Ajax
and Whitby.

The document published has some serious flaws which I feel can be corrected.
The proposed riding of Pickering~Durham is perhaps the most confusing riding
boundary imaginable.
The Pickering-Durham riding takes in all of the City of Pickering west of a line drawn
through Frenchman's Bay and adds it to the Townships of Brock, Scugog and Uxbridge.
These three rural areas have a combined population of (12,000; 20,000 &16,000)+
48,000. If the proposal stands, the urban section will have + 60,000 residents.
There is no community of interest among these diverse areas. The new riding
boundary will in fact bi-sect the proposed Pickering Airport which is certain to be a
contentious project.
The orientation of the section of the City of Pickering inclu.ded in the proposed riding is
almost entirely toward the City of Toronto while the three rural municipalities are
oriented toward Orillia/Lindsay (for Brock); Stouffville/Markham (for Uxbridge); and
Oshawa/Whitby for Scugog.
Even health care and hospital services are different for these areas.
There is no media centre which services the whole riding.
The riding proposed straddles a part of the Oak Ridges Moraine for a short portion and
a significant portion of Uxbridge and Scugog contains huge portions of this important
geographic feature. There is great need for a cohesive and collective voice for the
Moraine and this will not occur in the proposal.
A better alignment would be to leave all of the urban portion of Pickering with a 25%
portion of Ajax, for riding A, a portion of Whitby and Ajax (75%) to be riding B, the south
portion of Oshawa to be riding C, and a northern boundary of all A, B & C to be
established at (perhaps) Taunton Road. The portion of the Region of-Durham north of
this line to be included in the new mainly rural riding (Highlands of Durham?) which
would include Brock, Uxbridge, Scugog and the rural portions of the City of Pickering,
Town .of Whitby and City of Oshawa.
Since Federal and Provincial ridings ultimately align, transit corridors such as the 407
cross numerous political boundaries in Durham. Rural and small town areas of
Scugog/Brock/Uxbridge would have more in common with Clarington than with
Picketing, and in fact have been collaborating for over three years on shared services.
This would be providing a community of interest, reduction of domination by one urban
area and an important focus on Oak Ridges Moraine issues. All of these ridings would
be similar in the number of residents (100,000). Each one would also be more compact
and a reasonable media centre possible for each one.
There is a continual re-distribution of these three communities every time there is a re-
alignment. The history of movement has caused much confusion for taxpayers and
voters.
Any discussions held should include the Region of Durham Planning Department as
they could provide population projections and communities of interest. This would
make dealing with major issues of transportation, infrastructure and government
programs much easier.

On September 11,2002, Durham Regional Council considered
correspondence from Mayor Doug Moffatt, Township of Scugog, expressing
concern with the proposed restructuring of the Electoral Boundaries in the
Durham Region area and suggesting changes to the proposed alignment
(copy of correspondence attached). In response, Regional Council referred
the matter to the Planning Department with instructionS to consult with the
local municipalities as a basis for making a recommendation.
Accordingly, we respectfully request your municipalities' comments on the
proposal presented by Mayor Moffatt. The Mayor has indicated an intent to
present a position on the proposed boundary to the Federal Electoral
Boundaries Commission at its sitting scheduled for November 8, 2002, in
Whitby. To facilitate this, it is essential that comments be received by October
11,2002.
To assist, the attached table and map illustrate the proposal and provide an
estimate of the population for the geographic areas based on the 2001
Census.

Greetings fiom the AIDS Committee of Durham Region. As
2002 marks our 10th year anniversary, wc have been busy planning
and implementing many events in an attempt to establish a strong
presence in our community. Community leaders themselves have a
strong presence and play an intricate role in helping us strengthen
our roots in our community,
We arc requesting that the Mayors of Durham declare the week,
of November 25-30 2002, AIDS Awareness Wcck within their
constituency. What we hope to gain f~om this dcclaratiotl is to
increase awareness that HIV/AIDS is no longer confined to one
group. Anyone can, and does, become infected with HIV. Increased
community, national and international awareness is the key to
education and prevention. Declaring AIDS Awareness Week is an
important step in fostering knowledge and understanding desperately
needed to stop this epidemic within our communities.
Please contact the office at the above numbers if there are any
questions regarding this matter. On behalf of the AIDS Committee of

Further to Council's approval of Zoning By-law 6020/02 on September 17, 2002
that designated the subject lands as "R4" with an "(H)" - Holding Symbol, this
Department has prepared a draft amending by-law to remove the "(H)" - Holding
Symbol from the subject lands (see attached Location Map). The draft
amending by-law is attached for the consideration of City Council at its meeting
scheduled for November 4, 2002.
Prior to an amendment to remove the "(H)" holding symbol preceding the
"R4" Zone designation on the subject lands, the owner is reqUired to provide the
City with drawings that show how the basement will be converted from three (3)
dwellings units to one (1) dwelling unit. Such drawings are to reflect no change
in the building footprint of the existing dwelling or substantive change to the
exterior elevation of the existing dwelling. The owner is to provide the City of
Pickering with a letter of undertaking that all works required to convert the
existing basement of the house from three (3) dwellings units to one (1) dwelling
unit will be completed by the owner within six months of the date of the amending
by-law.
The owner has submitted plans to the satisfaction of the City of Pickering and
provided the City with an acceptable' letter of undertaking for the completion of
the required works.
Therefore, the property owner has satisfied the requirements for the lifting of the
(H) Holding Symbol.

The purpose and effect of this by-law is to lift the (H) Holding Symbol designation
to permit one accessory dwelling unit on the subject lands.

THE CORPORATION OF THE CITY OF PICKERING
BY-LAW NO 6050/02
Being a By-law to amend Restricted Area (Zoning) By-law 3036, as
amended, by By-law 6020/02, to implement the Official Plan of the City of
Pickering, Region of Durham, Lot 2, Plan 473, in the City of Picketing.

WHEREAS the Council of the Corporation of the City of Picketing passed
By-law 6020/02 on September 17, 2002, to permit the development of one accessory
dwelling unit within the existing house, Lot 2, Plan 473, in the City of Pickering;
AND WHEREAS By-law 6020/02 includes an "(H)" Holding Symbol preceding the
residential zoning on the lands, which has the effect of preventing any accessory
dwelling unit from occurring until such time as the owners submits a plan to the
City's satisfaction and provides a letter of undertaking that all works required by
the owner will be completed within six months;
AND WHEREAS the owners have now provided the required plan and submitted
the letter of undertaking, all to the City's satisfaction;
AND WHEREAS an amendment to amending By-law 6020/02, to remove the
"(H)" Holding Symbol preceding the residential zoning on the subject lands is
therefore deemed appropriate;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. SCHEDULEI
Schedule I to By-law 6020/02, is hereby amended by removing the
"(H)" Holding Symbol preceding the "R4" Zone designation on the
subject lands as set out on Schedule I attached hereto.
TEXT AMENDMENT
Sections 1 .(3)(a) and 1 .(3)(b) of By-law 6020/02 are hereby repealed.
AREA RESTRICTED
By-law 3036, as amended by By-law 6020/02, is hereby further
amended only to the extent necessary to give effect to the provisions of
this By-law as set out in Section 1 above, and as set out in Schedule I
attached hereto. Definitions and subject matter not specifically dealt with
in this by-law shall be governed by the relevant provisions of
By-law 3036, as amended.
4. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof.

execution of a Licence Agreement with
Beverly & Ron Ireland for the
operation of snack bar concessions at
the Pickering Recreation Complex
Arena.
WHEREAS, pursuant to the provisions of the Municipal Act, R.S.O. 1990,
chapter M.45 the Council of the Corporation of the City of Picketing may enact a
by-law for leasing premises owned by the Corporation.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Licence
Agreement, in a form acceptable to the City Solicitor between the
Corporation of the City of Pickering and Beverly and Ron Ireland for the
operation of snack bar concessions at the Pickering Recreation Complex
Arena.

NOTICE OF MOTION

WHEREAS numerous personal properties within the City of Pickering back upon
watercourse ravine areas; and
WHEREAS the removal of trees from these environmentally sensitive areas can lead
to erosion, loss of habitat and loss of aesthetic value adjacent to park land; and
WHEREAS the former municipalities of East York and Scarborough already have by-
laws to control tree removal from properties adjacent to ravines and the City of Toronto
is preparing to implement a city-wide by-law;
NOW THEREFORE the Council of the Corporation of the City of Pickering directs staff
to prepare a draft by-law for consideration of Finance and Operations Committee that
would require residents backing onto watercourse ravine areas to obtain a permit for
felling healthy trees; and
THAT the said by-law include a permit fee and fines for violation of the by-law; and
THAT the by-law clearly outline very limited circumstances where the felling of healthy
trees would be permitted; and
THAT staff bring the draft by-law before Committee for consideration no later than
February 24, 2003

WHEREAS an incident occurred in the City of Pickering on October 10, 2002
wherein a child was bitten so severely by a neighbour's dog that the child was
taken to the hospital emergency department for treatment; and
WHEREAS the incident took place on a public road and the child did not provoke
the dog in any way; and
WHEREAS Section 9(1) of City of Pickering By-law Number 5728~00 (Cat & Dog
By-law) states:
Where a dog has bitten a person or domestic animal, the animal
control and pound supervisor may, at his or her discretion, order the
dog to be muzzled or leashed or both, for a period of time to be
determined by the animal control and pound supervisor and the owner
of the dog shall comply therewith.
WHEREAS the Supervisor, Animal Services Centre determined that it was not
necessary to order the dog that was involved in the October 10th incident to be
muzzled; and
WHEREAS the only other alternative left to the Mother of the child that was bitten
to ensure the safety of her child was to make a civil application under the Dog
Owners' Liability Act to have the offending dog destroyed; and
WHEREAS Section 4(1) of the Dog Owners' Liability Act states that "If it is
alleged that a dog has bitten or attacked a person or domestic animal, a
proceeding may be commenced against its owner .... "; and
WHEREAS a proceeding under Section 4(1) of the Dog Owners' Liability Act may
be made by the municipality in addition to the person that was attacked by the
dog or other interested party; and
WHEREAS it is the responsibility of the municipality and its agent being the PAW
Animal Services Centre to ensure the safety of its residents through aggressive
enforcement and application of its by-laws;
NOW THEREFORE the Council of the Corporation of the City of Pickering
hereby requests the Pickering, Ajax and Whitby Joint Animal Services Committee
to direct the staff of the Animal Services Centre to immediately impose a
muzzling and leashing order on the owner of a dog that has bitten a person upon
being informed of the biting incident; and
FURTHER THAT such muzzling and leashing order remain in effect until the
owner of the dog can prove definitively that they have effective control of the dog
or until a decision is made by the PAW Joint Animal Services Committee in the
event that the owner of the dog appeals the muzzling and/or leashing order; and
FURTHER THAT the Supervisor, Animal Services Centre immediately inform the
Clerk of the City of Pickering of any incidents involving a dog bite in order for the
City to consider making a proceeding against the owner of the dog under the Dog
Owners' Liability Act.
