Rose - Chief Administrative Officer - Director, Planning & Development - Clerk - Manager, Development Review - Manager, Policy (I) ADOPTION OF MINUTES Meeting of June 10, 2002 Meeting of June 24, 2002 II DELEGATIONS a) George Ashe, 2800 Courtice Road, addressed Council with respect to Superwalk for Parkinson's Disease. He advised that he has this disease, which affects over 100,000 Canadians. He advised of the services and activities offered by the Parkinsons Society of Canada and requested support through pledging of the September 29th Superwalk for Parkinsons. - 1 - Planning Committee Meeting Minutes Monday, September 9, 2002 8:10 p.m. Chair: Councillor Ryan (III) 1. 2. MATTERS FOR CONSIDERATION PLANNING & DEVELOPMENT REPORT PD 34-02 ZONING BY-LAW AMENDMENT APPLICATION A 40/00 PICKERING HOLDINGS INC. ET AL 815 KINGSTON ROAD (PART OF LOTS 27 AND 28, B.F.C. RANGE 3) SOUTH SIDE OF KINGSTON ROAD EAST OF WHITES ROAD ADDroved See Recommendation #1 a) Sylvia Spencer, 771 Sheppard Ave., stated her approval ofthe archaeological study but not of the piping of the creek. She suggested that the hotel height be reduced from eight stories to six and requested the removal of the commercial club, restaurants, bakery and day nursery. She further stated that the signage is too garish and may provide a glare to motorists. b) Alex Artichov, representing the applicant, stated that the piping of the creek must be further studied and that the uses requested are typical of other area developments. He also advised that Boyer Pontiac have replaced the loud speakers and, therefore, there shouldn't be any noise that disturbs the residents across the street. PLANNING & DEVELOPMENT REPORT PD 40-02 ZONING BY-LAW AMENDMENT APPLICATION A 8/02 D.&J.MACKERACHER 501 ROSEBANK ROAD SOUTH (PART BLOCK K, PLAN 418) NORTH-EAST CORNER OF ROSEBANK ROAD AND COWAN CIRCLE ADDroved See Recommendation #2 a) James Chaikalis, 719 Cowan Circle, stated his concern with the amount of notification and suggested that all persons on Cowan Circle should have an opportunity to comment. -2- Planning Committee Meeting Minutes Monday, September 9,2002 8:10 p.m. Chair: Councillor Ryan 3. PLANN[NG & DEVELOPMENT REPORT PO 41-02 ZONING BY-LAW AMENDMENT APPLICATION A 04/02 JOHN TAYLOR TRUCK SALES INC. 3356 BALSAM ROAD SOUTH PART OF LOT 5. CONCESSION 5 AMENDED BY RE UIRING THE APPLICANT TO UNDERT AKE AN' ENVIRONMENTAL AUDIT TO THE SATISFACTION OF THE CITY REFERRED TO STAFF TO STUDY THE ISSUES STATED BY THE RESIDENTS a) Margaret Williamson, 3360 Balsam Road, stated that the operator of this facility should be charged for operating outside the zoning by-law, that allowing the development would be disastrous for the area and would be sending out a dangerous message by encouraging other nuisance businesses. The property is an eyesore and the tow trucks are causing a nuisance and much traffic. The Fire Department has been called about fires on this property and the storage of tires is a concern. b) John Murphy, 3080 Concession 5 Road, referred to the memo of the Division Head, Municipal Property & Engineering and questioned if staff are satisfied that contaminants are not getting in the water table. The road is not at a standard conducive to the proposed operation and an operation of this nature is not in character with the area. c) Rachael Murphy, 3080 Concession 5 Road, stated that many cars brought to this site have contaminants leaking from them, that an operation of this nature attracts an undesirable element and that the noise created from this property is extreme from crushing cars. She questioned whom to contact concerning the black smoke coming from the property. She advised that the pond on her property now has a film on it and the fish have died. d) Richard Lloyd, 3330 Balsam Road, stated his concern with respect to the water quality, the noise, the dust, the metal fence which has fallen down, the junk on the property not being stored in the building and the two leachate ponds adjacent to his property which attract mosquitoes. He advised that the trees at the west end of the property have been removed and the operator is using this area for his operation. - 3- Planning Committee Meeting Minutes Monday, September 9, 2002 8:10 p.m. Chair: Councillor Ryan e) Mr. Teknerb, Winchester Road, Kinsale, advised that there is a court case which says that no dumping is allowed between sun down and sun up. He further advised that contaminants have been found in the applicants settling ponds. f) Laura Orlandi, 3270 Highway #7 asked if Council is satisfied that no hazardous materials are being dumped. 4. PLANNING & DEVELOPMENT REPORT PO 42-02 REQUEST FOR COUNCIL'S PERMISSION TO DEVELOP LANDS BY LAND SEVERANCE E. AGNEW ET AL 1837-1841 APPLEVIEW ROAD PART OF LOT 3. PLAN 330. LOT 16. PLAN 1051 Approved See Recommendation #3 a) Kevin Lowe, 1632 Heathside Dr. advised that this application should be proposed as a plan of subdivision in order to be properly planned. This application is part of a larger subdivision and he stated his concern that the area will be developed by land severance which would provide less notification to the area. There are very serious planning issues that need to be addressed such as, the disappearance of walkways. IV ADJOURNMENT The meeting adjourned at 10:30 p.m. -4- Appendix I Planning Committee PC 2002..8 That the Planning Committee of the City of Pickering having met on September 9th, 2002 presents its eighth report to Council: 1. PLANNING & DEVELOPMENT REPORT PO 34-02 ZONING BY-LAW AMENDMENT APPLICATION A 40/00 PICKERING HOLDINGS INC. ET AL 815 KINGSTON ROAD (PART OF LOTS 27 AND 28, B.F.C. RANGE 3) SOUTH SIDE OF KINGSTON ROAD EAST OF WHITES ROAD 1. That Zoning By-law Amendment A 40100 be APPROVED subject to conditions outlined in Appendix I to Report Number PD 34-02, to: . retain vehicle sales and rental uses on the 'Boyer' parcel; . retain hotel plus accessory uses on the 'Pickering Holdings' and 'Veridian' parcels; . permit piping of the watercourse on the 'Pickering Holdings' parcel, subject to necessary approvals from the Toronto and Region Conservation Authority; and . permit hotel plus accessory uses, vehicle sales and rental uses, and a full range of retail, restaurant and office uses on all three parcels, being Part of Lots 27 and 28, B.F.C., Range 3. 2. PLANNING & DEVELOPMENT REPORT PO 40-02 ZONING BY-LAW AMENDMENT APPLICATION A 8/02 D.&J.MACKERACHER 501 ROSEBANK ROAD SOUTH (PART BLOCK K, PLAN 418) NORTH-EAST CORNER OF ROSEBANK ROAD AND COWAN CIRCLE 1. That Zoning By-law Amendment Application A 8/02, be APPROVED subject to the conditions outlined in Appendix I to Report No. PO 40-02, to permit the establishment of a second dwelling unit in the main dwelling unit, submitted by D. & J. MacKeracher, on lands being Part Block K, Plan 418 (Part 2, Plan 40R-12933), City of Pickering. 2. That the request made by E. Agnew et ai, be APPROVED, to permit the division of the subject lands, being Part of Lot 3, Plan 330 and Lot 16, Plan 1051 (known as 1837-1841 Appleview Road), for five additional lots by Land Severance rather than be draft plan of subdivision. -6-
