Moved by Councillor Brenner Seconded by Councillor Morgan Whereas the Town of Pickering is being subjected to a chronic situation of illegal roadside dumping, and Whereas the collection of this illegal roadside garbage is anticipated to cost the taxpayers of the municipal ity a projected $75,000 to $100,000 during the 1991 tax year, and Whereas this situation and its projected cost is a direct result of Metropol itan Toronto I s change in fees for vehi cu1 ar traffi c entering the Brock West Landfill Site, Now Therefore the Corporation of the Town of Pickering instructs its Solicitor to serve notice upon the Municipal ity of Metropolitan Toronto its intent to recover these costs and any other re1 ated expenditures whi ch may be attributed to Metro 's actions. Further, following this, that the Solicitor for the Corporati on of the Town of Pickeri ng is hereby instructed to initiate proceedings against Metropolitan Toronto to recover said costs. Resolution #124/90 Moved by Councillor Morgan Seconded by Councillor Mitchell Whereas by Order-in-Council No. 1858/90, made July 11, 1990, the Lieutenant-Governor of the Province of Ontario approved the Order of the Minister of the Environment exempting the proposed Pl Landfi 11 Site from the provi si ons of the Envi ronmenta1 Assessment Act, subject to certain terms and conditions; and Whereas the making of that Ministerial Order raises certain issues of concern to the Council of the Corporation of the Town of Pickering, including: (a) the possibility that the decision to exempt was a 1 ready made before the Mi ni ster requested comments from the Town; (b) the possibi1 ity that the Minister was biased in his consideration of the exemption request both on the basis that he had previously committed to grant an exemption and on the basis that he had been too involved in the SWISC proceedings to be unbiased; the possibil ity that the exemption decision was made on inadequate information; . (c) (e) . (0 (g) (h) (1) 107 15/90 (d) the possibility that the Minister failed to disclose to the Town all of the information which heinttnded to consider despite a request therefor, thus depriving the Town of an appropriate opportunity to be heard; the possibility that the Minister failed to properly consider the matters set out in section 29 of the Envi ronmenta 1 Assessment Act before granting the exemption; the juri sdicti on of the Hi ni ster to make the order he made and, in particular, to impose Condition 5 of the Order (that the area to be serviced by the site -lllðY not exclude any of the five upper tier municipalities of the Greater Toronto Area, namely Durham, Halton, Metropolitan Toronto, Peel and York; the propriety of the process implemented by the Minister particularly in light of the short time frame imposed to respond to hi s request for conments on the exemption request; the propriety of the process implemented by Durham in entering into an agreement respecting the site with Metropolitan Toronto; and the validity of the agreement between Durham and Metropolitan Toronto, particularly in view of Condition 5 of the Order; NOW THEREFORE BE IT RESOLVED THAT the law firm of Osler, Hoskin & Harcourt, retained to advise the Town with respect hereto, be instructed as follows: . (1) (2) (3) (4) (5) to proceed to commence an application to challenge the validity of the Ministerial Order exempting the proposed Pl Landfill Si te from the provi s ions of the Environmental Assessment Act on such grounds as appear appropriate; to consider whether or not the agreement between Durham and Metropo1 i tan Toronto is open to attack, and, if appropriate, to raise that issue in the same application; to add those other parties (i .e., in addition to the Minister and Durham) as may be appropriate; to consult with the solicitors for PACT provided that the interests of the Town and PACT continue to coincide; and to conti nue to report to the Town through the Town Solicitor. Councillor Morgan announced that the Province of Ontari 0 has approved a grant for the Cherrywood Wa ter Program. The following matters were discussed prior to the regular meeting: 5.
