HomeMy WebLinkAboutBy-law 7533/16 The Corporation of the City of Pickering By-law No. 7533/16 • Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the City of Pickering, Region of Durham, in Part of Blocks A and B, Plan M-998, and Part of Lot 22, Concession 1, Parts 1 to 5, 12, 18 to 23, 40R-8184 (A 15/16) Whereas the Council of The Corporation of the City of Pickering passed By-law 7492/16 amending By-law 3036, as amended by By-law 1612/83, By-law 3476/90, By-law 5219/98 and By-law 5746/00 to add a food store use to the list of permitted uses on Part of Blocks A and B, Plan M-998, and Part of Lot 22, Concession 1, Parts 1 to 5, 12, 18 to 23, 40R-8184, in the City of Pickering; • And whereas By-law 7492/16 includes an "(H)" Holding Symbol preceding the "C9" zone category on Part of Blocks A and B, Plan M-998, and Part of Lot 22, Concession 1, Parts 1 to 5, 12, 18 to 23, 40R-8184, in the City of Pickering, which has the effect of preventing the use of a food store on the subject lands until such time a Site Plan Agreement has been entered into and registered to the satisfaction of the City of Pickering to construct an acoustical barrier along the existing loading area; And whereas an amendment to amending By-law 7492/16, to remove the "(H)" Holding Symbol preceding the "C9" Zone on Part of Blocks A and B, Plan M-998, and Part of Lot 22, Concession 1, Parts 1 to 5, 12, 18 to 23, 40R-8184, is therefore deemed appropriate; Now therefore the Council of The Corporation of the City of Pickering hereby enacts as follows: 1. Schedules I & II Schedules I & 11 to By-law 7492/16 are hereby amended by removing the "(H)" Holding Symbol preceding the "C9" Zone designation on Part of Blocks A and B, Plan M-998, and Part of Lot 22, Concession 1, Parts 1 to 5, 12, 18 to 23, 40R-8184, as set out on Schedules I & II attached hereto. 2. Text Amendment Section 6.(1) & 6.(2) of By-law 7492/16 are hereby repealed. 3. Area Restricted By-law 3036, as amended by By-law 1612/83, By-law 3476/90, By-law 5219/98, By-law 5746/00, and By-law 7492/16 is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Sections 1. and 2. above, and as set out in Schedules I & II attached hereto. Definitions and subject matter not specifically dealt with in this by-law shall be governed by the relevant provisions of By-law 3036, as amended. By-law No. 7533/16 Page 2 4. Effective Date This By-law shall come into force in accordance with the provisions of the Planning Act.
