A meeting of the Pickering Township
Council was held on MONDAY, the
SIXTEENTH day of DECEMBER, 1968, at

The Clerk of the Township, D. J. PIitz, swore into Council,
Mr. Robert Mason. Councillor Mason took the De~laration of
Office and upon being congratulated by all members of Council
took his place on Council as Councillor for Ward 2, Township
of Pickering.
ADOPTION OF MINUTES
Moved by Councillor J. Kruger, seconded by Councillor V. Rudik
that the minutes of Council meetings held on December 3 and 9,
1968, be adopted as presented with the following amendment made
to the minutes of December 3, 1968, by adding the following
motion.
Moved by Councillor D. Kitchen, seconded by Councillor J. Kruger
that age limit be removed from By-law #3585, a By-law to regulate
and govern the keepers of billiard, pool and bagatelle tables.

Mr. J. Faulkner, Planning Director advises of the concern of
the Committee of Adjustment over the increase in the number of
apparent flagrant violations of building and zoning regulations,
and the construction resulting from the non-issuance or conversion
of issued building permits, placing the Committee in the position
of dealing with a completed and operating situation rather than
dealing with a proposal.
Referred to Committee of the Whole scheduled for January 13, 1969.
The Ontario Water Resources Commission advises that Mr. Richard
McBean attended the Basic Water Works Operators' Course held
October 21st tò 25th, 1968 at the Commission Laboratory and
obtained an "Au grade in the examination held at the end of the
Course.
Mr. James A. Taylor, Township Solicitor advises that the Hearing
regarding the Township of Pickering and County of Ontario
Assessment appeal, for an Order for the production of various
material in the hands of the County Assessment Commissioner,
was dismissed.
Mr. D. Quick, Chairman, School Board, School Area #2, states
that the application of Pickering Township to be annexed to
Metropolitan Toronto has caused some concern among school
personnel due to the fact that in January, 1969, the schools
of this district become part of the Divisional Board of
Education in the County of Ontario.

He requests that any written agreement which may be made with
Metropolitan Toronto provide for the protection of the rights
of employees who were employed by the School Area #2 Board as
of December 31, 1968. The Board would also like to meet with
Council to discuss any agreement which may be drafted re8arding
anne~ation of the Township.
Service and Stark, Solicitors for Mr. Harry Hughes, Mr. Ron Bell
and Dr. Gordon Clark, writes regarding the problems his clients
are experiencing due to the reconstruction of the intersection
of East Avenue and Ridgewood Road.

Mr. C. R. Williams, Secretary J Township of Uxbridge Planning
Board, advises they will receive written suggestions for
revisions to the proposed Gravel Pit By-law until January 3rd
to be considered by the Board at the meeting of January 6,
1969, and subsequent to this meeting, a joint meeting for
further discussions will be arranged towards the end of January.

Mr. Robert Mason accepts the appointment as representative on
Township Council for Ward 2, and also advises that he will be
on vacation from December 4 to December l5, and apologizes to
the Chairmen of meetings at which he should be present during
that period.
Miss Lucille Chapman, 39 St. George's St., Pickering expresses
thanks and appreciation for the Township sponsored scholarship
with which she has been presented.
Mr, D, Horsf'ield, Chairman, advises of the Committee of
Adjustment appointments for the year 1969.
Mr. J. H. Faulkner, Planning Director conf'irms that the meeting
regarding the Metropolitan Toronto and Region Transportation
Study (M.T.A.R.T.S.) East District Critique has been changed
f'rom December 3rd to December 19th, 1968.
W. R. Kellough & Associates advise of costs to date since last
account was rendered in connection with Pickering Township
Assessment Equalization Appeal.

The Planning Department recommends that a report be prepared,
regarding the proposed subdivision, Keith Stewart Realty,
Part of Lots 15 to 18, Concession 7, on specific requirements
for estate development, including a resume of the experience
in other municipalities with such development, and that in the
interim, no action be taken with respect to Planning Report #141.

Councillor J. Kruger advises that he has been invited to sit
on a panel on May 9th, 1969 at a conference, the theme of which
will be "Learning, Living and Leisure" sponsored by the Ontario
Municipal Recreation Association Conference Program Committee.

DELEGATIONS
Moved by Councillor D. Kitchen, seconded by Councillor V. Rudik,
that Mr. Gustav Oerlemans be heard.
Mr. Oerlemans, representing the Federation of Ratepayers'
Association of Frenchman's Ba~ appeared before Çouncil presenting
a prepared brief on street lighting in his area.
Reeve Williams advised Mr. Oerlemans that the present Council
prepared the required legislation to enable these areas to be
lighted and if all goes well the cost will be imposed on the
areas in 1969. He said delays could be expected unless the
Ontario Hydro employed additional staff.
Councillor A. King gave his support to Mr. Oerlemans' request
and indicated that Bayly St. should be included in his brief,
and further that the Ontario Hydro be urged to give these areas
top priority.
Mr. King suggested that the Township send a letter to the
Ontario Hydro pointing out the urgency with respect to the need
for street lights in the various areas of the Township.

leave to introduce a By-law o£ the Township of Pickering to
regulate and license driving schools and instructors and that
same now be read a first time.

that By-law number 3S89 to regulate and license driving schools
and instructors be now read a second time, and that Council go
into Committee of the Whole thereon.

to authorize the execution of an agreement dated the 18th day
of November, 1969 (construction and maintenance of a swimming
pool in the Woodlands Centennial School) and that same now be

MOVED by Councillor V. Rudik, seçonded by Councillor R. Mason
that this Council does hereby endorse the recommendation of th~
Picker!ng Township Planning Board on November 28th, 1968; and
hereby directs that the application (A 7/68) - to amend the
zoning of the property known as the Westerly 83 feet of the
Easterly 220 feet of the Northerly l35 feet of Lot 19, Con. 8
from Residential tR5' to General Commercial 'C2t specifically
to permit the conversion of the existing structure to a combin~d
funeral home, ambulance service and residence; be APPROVED in
accordance with Site Plan #4 - received on November 26th, 1968-
on the grounds that such use is compatible with the surrounding
area and is in keeping with the spirit and intent of the'
Zoning By-law and Official Plan; subject to:

Clarification with the County Engineer with respect to
any necessary road widening, and if such road widening is
required, it be so deeded to the County.
The applicant agreeing to construct a minimum of 10 parking

that this Council does hereby endorse the recommendation of
the Pickering Township Planning Board of November 28th, 1968;
and hereby directs that the East District Joint Planning Committee
report on the Metropolitan Toronto and Region Transportation!
Study, dated November 19th, 1968, be ADOPTED as the comments,
of the Township of Pickering, provided that the last paragraph
on page 5 of the report, be amended to endorse the principle
of a parkway belt, but question the means of implementation.

MOVED by Councillor J. Kruger, seconded by Councillor D. Kitchen,
that whereas Bell Canada has filed an application with the
Canadian Transport Commission to seek approvals of increases
in its rates for exchange and long distance services and
equipment to be effective March 1st, 1969:

AND WHEREAS the Council of the Township of Pickering does
not approve of such application;
BE IT THEREFORE RESOLVED that the Council does not endorse the
said application for further rate increases; however, it does
agree that the proposed rate decreases in the application be
endorsed.

MOVED by Councillor V. Rudik, seconded by Councillor
D. Kitchen, that this Council does hereby endorse the recommenda-
tion of the Pickering Township Planning Board on December 10th.
1968; and hereb~ directs that the City of London Resolution
(3l.l7.l) (4/18ïB & R) with the change recommended by the
Planning Board, be ENDORSED, and such endorsation be forwarded
to the Minister of Municipal Affairs.

Resolution #375/68
MOVED by Councillor V. Rudik, seconded by Councillor D. Kitchen,
that whereas the Corporation of the Township of Pickering is a
property owner and a gravel pit operator in the Township of
Uxbridge;
AND WHEREAS the Corporation of the Township of Uxbridge proposes
to seek approval to an Official Plan zoning by-law and gravel
pit operation by-law;
AND WHEREAS the proposed by-laws are so restrictive that the
Township pit could not be operated;
AND WHEREAS the extreme broad range of uses would hamper the
Township operation;
BE IT THEREFORE RESOLVED that the Corporation of the Tcwnship
of Pickerjng strongly object to the proposed restrictive by-laws.

with the regular order of business to deal with the following
resolutions.
The Council voted unanimously in favour of hearing the
resolutions proposed by Councillor Kruger.

MOVED by Councillor J. Kruger, seconded by Councillor D. Kitchen,
that whereas the Ontario Municipal Board has imposed "ad
infinitum" on the Township of Pickering a maximum limit of 100
residential building permits per calendar year as a means of
controlling educational costs in the Township;
AND WHEREAS the Ontario Municipal Board Order was executed prior
to the creation of the Divisional Board of Education for the
County of Ontario which will pool the assessment resources of
the County Region for educational purposes;
AND WHEREAS approximately 85% of the long term debt of the
Township is represented in the cost of education and this
liability will now be transferred to the Divisional Beard of
Education;

AND WHEREAS the Ontario Municipal Board Order has had the effect
of seriously restricting the assessment growth in the Township
to the extent that assessment increase in 1968 will be insufficient
to cover the normal rising cost of Government for the minimum
Municipal services in the Township;
AND WHEREAS this position will be aggravated for Township rate-
payers because major residential developments have been
announced or are underway in the Township of Uxbridge, the Town
of Whitby, the Town of Ajax and the Village of Pickering,
apparently without these municipalities obtaining agreements to
provide increased industrial or commercial assessment to o£fset
the cost of education in the jurisdictional area of the Divisional
Board of Education;
AND WHEREAS if it was valid for the Ontario Municipal Board to
control the cost of education in the Township of Pickering by
imposing residential building restrictions, it is equally as
valid for the Ontario Municipal Board to extend these building
restrictions to cover all municipalities in the entire
Divisional Board of Education area for the same financial
reasons;
AND WHEREAS in the. new financial environment of the Divisional
Board of Education, it would be inequitable and punitive to
impose on Pickering Township a residential building restriction
while all other municipalities in Ontario County were unrestricted;
BE IT THEREFORE RESOLVED AS FOLLOWS:

That the Ontario Municipal Board be requested forthwith
to lift the 100 building permit quota on the Township.
That in the interests of all ratepayers in the jurisdictional
area of the Divisional Board of Education for the County of
Ontario, the Ontario Municipal Board in conjunction with
the Minister of Municipal Affairs and the Minister of
Education be asked to conduct immediately a survey of the
economic viability of the educational region, to determine
the desireability of imposing a residential buiJding quota
on the said region with permits to be issued on a first
come first served basis until the quota was reached.
That the Minister of Municipal Affairs be requested to
refuse approval for all future subdivision proposals in
Ontario County unless the residential development is
compensated by industrial or commercial assessment sufficient
to offset the additional cost of education occasioned by
the residential development unless the residential develop-
ment can be shown to be self-supporting.
That copies of this resolution be forwarded to the
Divisional Board of Education for Ontario County, Ontario
County, all municipalities in Ontario County, the City of
Oshawa, the Minister of Municipal Affairs, the Minister'
of Education and the Ontario Municipal Board.

MOVED by Councillor J. Kruger, seconded by Councillor D. Kitchen,
that whereas major residential development proposals have been
announced or are underway in the Township of Uxbridge, the Town
of Whitby, Town o£ Ajax, and the Village of Pickering without
apparent agreement to provide compensating industrial or
commercial assessment to offset additional education costs
occasioned by the residential development;
AND WHEREAS the added cost of education resulting from these
major developments will be carried by all municipalities in
the County of Ontario which includes Pickering Township;
AND WHEREAS because of the low industrial assessment in the
Township the above increased costs of education will have to be
raised in the main by directly taxing residential ratepayers
in the Township;
AND WHEREAS a co-ordinated planning and development policy is
an essential interim measure which must be adopted by the County
of Ontario prior to the Oshawa centered region being formed;
BE IT THEREFORE RESOLVED AS FOLLOWS:

That the Minister of Municipal Affairs be requested to:

Defer approval of all present and future residential
development proposals in process for municipalities
in the County of Ontario and the City of Oshawa
pending completion of the financial and organizational
review being carried out as a prerequisite for the
implementation of Regional Government for an Oshawa
Centered region.
Impose on the County of Ontario those planning and
development standards which result from the review
in 'At above to ensure proper interim control measures
by the County until the Oshawa centered Regional
Government is properly operating.

If the Minister of Municipal Affairs declines to act for
the protection of Pickering ratepayers as in '1' above,
then, as an alternative, request the Minister of Education
to pay extra-ordinary grants to the Township of Pickering
equal to the Township's share o£ any increased educational
costs resulting from the unco-ordinated, sparodic residential
development in the County of Ontario and the City of Oshawa.
That a copy of this resolution be sent to the Divisional
Board of Education for the County of Ontario, Ontario
County, all municipalities in Ontario County, the City of
Oshawa, the Minister of Municipal Affairs, the Minister
of Education and the Ontario Municipal Board.
