CARRIED ~ DELEGATIONS Before delegates had an opportunity to express themselves, Council set aside all other business to pass an amending By-law to By-law #3274. Watering restrictions will be placed on residents of the water area during the months from June 15 through to September 15, 1967, or until the By-law is repealed. See By-law #3292. Councillors Chatten and Williams gave a brief explanation on the reasons for imposing a water restricting By-law by stating that should the water supply reach a point where it would not be adequate to meet domestic demands, an emergency would be declared and that sound trucks would be used to advise the people. Reeve Laycox stated that he did not wish to put the people in a position where they would be without water, and suggested that they not water their lawns or wash their cars in the dry months. 1. Moved by Councillor Chatten, seconded by Councillor Williams that Mr. D. Kitchen be heard. ~ Mr. Don Kitchen read from a prepared brief, pertaining to two main questions -- (1) (2) ~~y do we have a water shortage? Vfuy must we pay such high taxes? Mr. Kitchen was insistent that the Provincial Government must give help, suggesting the complete removal of the costs of education, welfare, and police from property taxes. Mr. Kitchen invited Council to a special meeting on April 11 at g:OO p.m. to be held at the Sir John A. MacDonald School in Bay Ridges. Please refer to copies of brief kept on file. - 3 - 2. Moved by Councillor J. Williams, seconded by Councillor R. Chatten, that Mr. Kruger be permitted to read a brief which was to be presented by G. A. Hall, Vice-Chairman of the West Rouge Ratepayers' Association. This brief covered the water situation and the increased tax rate. t On the water, he suggests that no further building permits be issued until this problem is overcome. He also made reference to the adverse publicity the Township is receiving due to the excessive mill rate increases. Please refer to copies of brief kept on file. 3. Moved by Councillor Williams, seconded by Councillor Chatten, that Mr. C. S. Morton be heard. Mr. MOrton spoke on a matter pertaining to law enforcement in the Township of Pickering. The Reeve suggested that this should be directed to the Police Commission and not to Council. Mr. Morton said he had contacted the Police Commission but was refused a hearing. Reeve Laycox contradicted this statement and as a result a brief altercation ensued resulting in Mr. Morton being ejected from the Council Chambers. He left the Council Chambers without incident but later returned. Moved by Councillor Williams, seconded by Councillor Chatten that Mr. Morton be given an opportunity to speak. Mr. Morton launched into a series of complaints about the Pickering Police Department, stating that the people needed protection from the Police and requested a Royal Commission investigation into the Police Department. He complained further about conditions of Liverpool Road and the actions of the Reeve. ~ 4. Moved by Councillor Williams, seconded by Councillor Chatten, that Mr. J. Kruger, President of the West Rouge Association, be heard. Mr. Kruger read from a prepared brief which pertained chiefly to the high taxes in the Municipality and the effect on the average home owner, stating that if the trend continues, it could force the average homeowner out of this Township. He emphasized the need for effective action to be taken immediately, by suggesting a plan of action. 1. Put the re-assessment of homes in Pickering Township in proper perspective. 2. Exert every effort to offset rising school costs. 3. Have Council be more financially conservative. 4. Take a plan of action which he referred to as financial brinkmanship, to tell the higher levels of government that the people of Pickering Township can be taxed no further or they will have to default on their debentures with the government. Mr. Kruger suggested that Council should plan now for 1968 to try to find a way out of what he refers to as a financial mess. Please refer to the brief on file. - 4 - 5. Moved by Councillor Waller, seconded by Councillor Beer, that Mr. E. G. Devonshire be heard. Mr. Devonshire appeared before Council on behalf of his client, Mr. R. Jones, on the matter of an application to rezone a part of Township, Part Lot 23, Concession 1, from Highway Commercial Zone nC3 \~ to General Commercial Zone nC2¡¡. ~ The application was recommendad to Council for approval. However before plans and specifications are prepared, Mr. Devonshire asked for Council's approval. A number of questions were put to Mr. Devonshire by members of Council. (1) Lack of parking spaces and traffic congestion on Liverpool Road -- how could this be resolved? (2) was Mr. Devonshire's client prepared to pay towards the cost of servicing this property? (3) When would construction start? Mr. Devonshire suggested to Council that if his Commercial development were permitted, this would provide local èmployment and also return to tþe Municipality an estimated tax revenue of approximately $70,000.00. He further pointed out that much of the money spent by the residents of the Township is being expended in the neighbouring municipalities of Ajax, Scarborough, Toronto, and Pickering Village. A motion was put to Council recommending a change in the zoning and was lost. See Motion No.2. It was suggested that proper plans be submitted to Council before any change in the zoning is made. Ontario Water Resources Commission, re Pickering Township Sewage Project and Rouge Hills Golf & Country Club Ltd., advise they are unable to provide cost figure at present, but expect matter to be settled by end of year. Copies to Council. 2. West Rouge Ratepayers' Association re members being better informed with regard to the affairs of Council. Read in open Council. Copies to Council. ,. Mrs. Brown of West Rouge, re cleaning up of the drainage course on private property, property owned by Mr. Chester. Also, repair of the boundary fence of the Chester property. Letter was not received by the Clerk, but was directed to the Reeve. Reeve Laycox assured Mrs. Brown that the matter will be looked after and that the proper department has been advised on this matter. 5· (6) 1. INFORMATION Poul Poulsson, Township Engineer, advises that the Board of Transport Commission has issued an order to the C.N.R. to install, within six months of date of order (March 8) flashing light signals, short arm gates and bell at Chesterton Shores Railroad Crossing. Mr. J. H. Faulkner, Planning Director, advises that Mr. R. Merritt has been appointed as the lay representative and Mr. C. Laycox as the elected representative from the Township of Pickering on the East District Joint Planning Committee. Moved by Deputy Reeve Mrs. J. L. McPherson, seconded by Councillor Chatten that this matter be referred to the Committee of the Whole Council for further discussion. 2. 3. The Bell Telephone Company of Canada advise that they have entered into a Partial C.A.T.V. Agreement with Mr. Albulet for the Township of Pickering. Clerk to obtain additional information as to.:what. this agreement will entail, e.g. relay-tower or other structure. 4. Hon. M. B. Dymond, Minister of Health re proposed standards under Ambulance Services Act. Copies of Act ordered for members of Council. 5. Department of Municipal Affairs extends invitation to attend W. Clifford Clark Memorial Lecture, 1967. Copies to Council. 17) BY-LAWS By-Law Number 3289 Councillor R. Chatten, seconded by Councillor N. waller moves for leave to introduce a By-law of the Township of Pickering to appoint a Community Centres Board to manage and administer certain Community Centres and Athletic Fields within the Township of Pickering in conformity with the Community Centres Act and that same now be read a first time. Councillor R. Chatten, seconded by Councillor D. Beer, moves that By-law Number 3289 to appoint a Community Centres Board to manage and administer certain Community Centres and Athletic Fields within the Township of Pickering in conformity with the Community Centres Act be now read a second time, and that Council go into Committee of the Whole thereon. Spang, that the Council of the Township of Pickering authorize the Planning Department to advertise for additional staff, Planning Technician and Planning Draftsman, as recommended by the Planning Department in their 1967 budget. Spang, that the Council of the Township of Pickering authcrize the Clerk to call tenders on the purchase of the supply of -- I. Waller, that the Dominion of Canada Bearer Bonds Numbers TZgB077g27 and T29BII0540 be cashed and the proceeds be applied against the expenses incurred regarding Rougedale Acres Subdivision, along with the proceeds on the deposit held on Lot 66, Plan M37. CARRIED Resolution #93/67 MOVED by Councillor N. Waller, seconded by Councillor J. Williams that the Council of the Township of Pickering consent to the canvass for funds by the West-Pickering Branch and the North- Pickering Branch of the Ontario County Unit of the Canadian Cancer Society in the respective areas of the said Branches, during the month of April, 1967. CARRIED Resolution #94/67 MOVED by Councillor H. Spang, seconded by Councillor N. Waller, that whereas the operation of gravel trucks within the Township of Pickering creates many road hazards and undue damage to roads, and, Whereas large road work projects are carried out by the Department of Highways especially a widening of No. 2 Highway and Highway 401 in 1967, where the largest bulk of the gravel comes from gravel pits in Pickering Township, this Committee recommends to Council to have the By-law Enforcement Officer appointed as a Special Constable, as recommended by the By-law Committee on March 16, 1967, subject to approval of Police Commission. Williams that Council make a further application to the Metropolitan Toronto in respect to the installation of Traffic Lights at the intersection of Highway No. 2 and Sheppard Avenue, as recommended by the Roads Committee on March 14, 1967. Chatten that the lease for the north half of Sideline 14/15, Concession 9, be permitted assigned to Mr. W. P. Wilder the purchaser of the property of the present owner Mr. Kortright, as recommended by the Roads Committee on March 14, 1967. CARRIED Resolution #97/67 MOVED by Councillor R. Chatten, seconded by Deputy Reeve Mrs. J. L. McPherson, that Mrs. Hart's Claim be referred to the Township's Insurance Company for action, as recommended by the Roads Committee on March 14, 1967. CARRIED Resolution #98/67 MOVED by Councillor R. Chatten, seconded by Councillor H. Spang, that the bill in the amount of $18.26 for Plowing the Cowan Lane be written off, as recommended by the Roads Committee on March 14, 1967. CARRIED Resolution #99/67 MOVED by Councillor R. Chatten, seconded by Deputy Reeve Mrs. J. L.McPherson, that Council advise Planning Board that Council's policy is that no residences or buildings be permitted on any road not maintained by the Township as a Public Road assumed by By-law except where provision for maintenance under a Subdivision Agreement applies. Further that the Planning Director be requested to prepare amendments to the Zoning By-law to implement this policy as soon as possible in order to prevent possible construction of buildings on roads that only exist on paper, as recommended by the Roads Committee on March 14, 1967. Spang, that Council ask Metropolitan Toronto what their plans are in respect to the intended Sanitary Land Fill operation in the Rouge Valley, particularly in respect to pollution control, use of land expropriated and road access, as recommended by the Roads Committee on March 14, 1967. Spang, that the Clerk be authorized to purchase an Olivetti Underwood D-24, Calculator at a cost of $607.95 as provided for in the 1967 budget. CARRIED Resolution #102/67 MOVED by Councillor N. Beer, that this Council does hereby authorize the removal of the old school bell from the Red Cross Centre on the Brock Road and the donation of the bell to the Board of School Area #1 for the specific purpose of placing it on a cairn on the grounds of the present Brock Road School, and that the Area #1 School Board be responsible for the cost of the operation. Spang, that the Treasurer be authorized to pay the Progress Certificate #A129g Statement #12 Final in the amount of $54,51g.49 subject to the Township receiving the assurance from our solicitor that there are no liens registered against the property and that the Municipality is fully protected under the Mechanics Lien Act. CARRIED Resolution #106/67 MOVED by Councillor J. Williams, seconded by Councillor R. Chatten, that the Township of Pickering Council is prepared to compile and support a presentation to the Provincial Government re property taxation in Pickering Township and the surrounding fringe areas. CARRIED Resolution #107/67 MOVED by Councillor R. Chatten, seconded by Councillor J. Williams, that this Council does hereby accept the tender of A. K. Ferguson of $525.00 for Salvage Rights from the Township Dump in Lot 15, Concession 4 for the period between April 1, 1967, to March 31, 1969, subject to approval of Township Engineer. CARRIED l2..L MOTIONS ~ 1. MOVED by Deputy Reeve Mrs. J. L. McPherson, seconded by Councillor H. Spang, that the Engineer be directed to report on the cost of widening and constructing the Private Roads to standards that would qualify for D.H.O. subsidy where possible and the cost of maintaining such other Private Roads not possible to widen or assume, as recommended by the Roads Committee on March 14, 1967. TABLED ~ - 10 - 2. MOVED by Councillor N. Waller seconded by Councillor D. Beer, that this application (A22/66} to amend the zoning of the subject property (Pt. Lot 23, Con. 1) from Highway Commercial Zone wiC3 ii to General Commercial Zone iiC2" to permit the operation of a neighbourhood shopping mall thereon, be approved subject to the following conditions: (1) That no construction shall take place until this site is serviced with municipal water and sanitary sewers. (2) That no construction shall take place prior to completion of access arrangements from Liverpool Road by the Department of Highways of Ontario and/or the County of Ontario. (3) Site plan approval by the Planning Board prior to the issuance of any building permit. (4) That parking space be provided in accordance with the requirements of section 5.19.2 of By-law 3036; or as demanded by and laid down by prospective tenants. This motion came under discussion since it was deleted from the agenda on the recommendation of the Township Solicitor, due to the matter pertaining to a mandamus order, on the issuing of a building permit for a building to be erected on a road not main- tained by the Township as a Public Road. The majority of Council members were of the opinion that it was imperative that the Township protect itself against the expense of building roads which would provide access to these lots and that all amendments to the By-law be implemented. Councillor Waller expressed his feeling indicating he could not vote for this motion, basing his decision on the Township Solicitor's recommendation. Moved by Councillor N. Waller, seconded by Councillor J.
