McPherson, seconded by Deputy Reeve G. Ashe, that the minutes of the Council meeting held on the 19th day of January be adopted as amended. Recorded vote on By-law 3770/70 to include Councillor Kruger as voting in the negative. CARRIED l!!~GATIONS 1. Moved by Councillor Mrs. J. L. McPherson, seconded by Deputy Reeve Ashe that Mr. K. E. Stockelbach be heard. Mr. Stockelbach had his counsel, Mr. M. W. R. Boyes speak on his behalf with respect to the amendment to the zoning of lands owned by Mr. Stockelbach, to have the holding designation removed and without the ten foot road widening which Council has requested. He advised that his client's first mortgagee refuses to give a partial discharge for the 10 ft. which is holding up his project to develop the Avis Park into a marina. Mr. Boyes indicated that his client is prepared to set back the required ten feet, making it available to the Township for future use but that his mortgage is for a term of five years making impossible dedication of same to the Township; however, his client would be agreeable to enter into any form of agreement which would be satisfactory to the Township and Mr. Stockelbach. The Council suggested that this could be a solution, recommending that Mr. Boyes contact our Solicitor and the Township Engineer, Moved by Councillor Kruger, seconded by Deputy Reeve Ashe that Miss V. Swan be heard. 2, Miss Swan inquired from Council as to when the aoning of her area (Lot 5, Plan 274) 350 Dyson Road was changed from zoning R4, Single Family Residen'tial to Commercial. Her reason for the inquiry was that sne~ll Printer's Shop directly across the street from her at 333 DYson Road. She went on to request a copy of the amending by-law and the reason why she was not notified of the zoning change. !n§1rYctioqs - Clerk to have Planning Department investigate. Moved by Councillor R. Chat ten , seconded by Councillor Mrs. J. MePberson that Mr. J. Black be heard. 3. A number of snowmobilers appeared at the Council meeting when it was learned that the Council was contemplating putting a Snowmobile By-law into effect regulating the use of the machine within the Township of Pickering. The delegation appeared before Council to protest. .iI14 l! 2. 3. 4. 5. 6. 7. - 2 - 3/70 Mr. Black, in his brief to Council, stated that if such a by-law was passed, it would be very discriminatory. He agreed that a by-law was needed to control but not to ban the vehicles from the Township altogether. He suggested that the snowmobiles be limited to all roads above Highway #2 and also suggested a curfew with 9 o'clock deadline. He asked that the by-law be deferred until the Province has set the regulations. \ Mr. Colin Robinson suggests that the snowmobiles be kept out of all public parks. See Resolution #59/70. CORRESPONDENCE The Ontario County Roman Catholic Separate School Board is requesting that all Municipalities in the County of Ontario forward plans of any subdivisions to their Board for their study and information. Referred to Planning Department. The Department of Energy and Resources Management, Air Management Branch advises that the Township's request to extend to February 28, open burning at the 1òwnship site, has been granted subject to two conditions; that burning will not take place after 5 p.m. or on Saturdays or Sundays; and that large quantities of plastics or rubber must not be burned. The Ontario Water Resources Commission, regarding the Township's request for acceptance, as a Provincially-owned project, a sewage treatment plant in the Duffin Creek area, advises that a more complete study is to be made with particular reference to the site of the plant. Mrs. K. Sharma, Librarian submits two estimates, for consideration by Council, regarding renovation of the Old Brougham Municipal Building for use by the Library Board. Copies to Council. Mr. James A. Taylor, Q. C., Township attended the Ontario Municipal Board Uxbridge, representing the Township, Uxbridge by-laws 1517 and 1538. The on January 30, and he will advise of Copies to Council. Solicitor, advises that he Hearing at the Township of in opposition to Township of hearing is to be continued any developments. The Council noted in Mr. Taylor's letter mention of an amendment indicating plans for a sewerage plant oyer the line in the Township of Pickering, suggesting that Mr. Taylor obtain further information to this application and forward same to Council. The Township of Uxbridge forwards a copy of their resolution with respect to the operation of pits and quarries and requests the Township of Pickering to endorse same. Copies to Council. McPherson, that whereas the majority of the electorate within the Township voted in favour of fluoridating the Pickering water supply, that the Engineer be authorized to provide for the necessary fluoridation equipment and installation as part of the cost of expanding the water treatment facilities proposed completed in 1970 and to proceed with the fluoridation of the water supply~ as recommended by the Standing Committee on Roads, January 21, 1970. McPherson, that the owners abutting Stroud's Lane be permitted connections to the watermain subject to: (1) Agreement to be registered against title providing for payments for watermain equivalent to the Local Improvement rates as established for residents within the Spruce Hill Local Improvement Area. Payment in cash of the normal connection charge from the main to the streetline. (2) (3) Dedication of the widening required to establish Stroud's Lane as a 66 ft. road to permit installation of the water shutoff box at the streetline as widened. McPherson, that the Township of Pickering agree to the County Engineer's proposal to acquire lands at the 4th Conc. and Church Street sufficient to both settle the County needs to widen the 4th Conc. and the Township's immediate need to improve the C.P.R. crossing and the Township's future need to eliminate the present jog and permit filling of the lands to assist in the implementation of the jog elimination, at no cost from surplus excavations that become available from time to time. Further, that the Township is prepared to participate in the acquisition of this land to the extent of 50 percent of the total estimated cost of $6,000.00. McPherson, that the Munkipality's membership in the Canadian Good Roads Association be renewed on a yearly basis at the discretion of the Township Engineer, as recommended by the Standing Committee on Roads, January 21, 1970. Chatten that Section 19 (e) of the Taxi Cab Licensing By-law 3746 be amended to read as follows: ti(e} The taxicab number plate issued under this By-law shall, at all times, be securely and prominently affixed to th~ right rear portion and on the outside of the vehicle in re~pect of which the same was issued. Each vehicle shall be operated as a taxicab at all times. Failure to comply with t4e terms set out in this section hereof, shall, at the discret~on of the Council of the Township of Pickering, be sufficient cause tor revocation of or refusal to renew such licønse." Rudik, that the method of payment of contributions to the Municipality for the East Ridge Development be made over a period of one year in a form satisfactory to the Solicitor; that payment one be made prior to the registration of the Plan, payment two be made six months after registration; and payment number three be made on the twelfth month; all payments of contributions to be completed after one year, as recommended by the Standing Committee of the Whole Council, January 26, 1970. CARRIED Resolution #49/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor V. Rudik, that the East Ridge subdivision be required to provide a residential to industrial assessme~ratio, basing the industrial assessment requirements on the minimum of 960 sq.ft. residential, being the floor area in the Zoning By-Jaw, #1978, as recommended by the Standing Committee of the Whole Council, January 26, 1970. CARRIED Resolution #50/70 MOVED by Deputy Reeve G. Ashe, seconded by Councillor V. Rudik, that the Township Solicitor be instructed to prepare a draft agreement for the East Ridge subdivision and to include within the draft agreement the conditions as agreed to and recommended by the Committee of the Whole to Council as Items A, B, C and D of the Clerk's report dated January 26, 1970, as recommended by the Standing Committee of the Whole Council, January 26, 1970. Rudik, that the Committee of the vfuole Council meetings be held on a trial basis in Brougham and in Bay Ridges areas (one in each location) and further, that the necessary arrangements for a meeting hall be arranged, and that the said meetings be advertised in a newspaper circulated in the areas, as recommended by the Standing Committee or the Whole Council, January 26, 1970. Rudik, that whereas the Provincial Government has relocated the Provincial Court (Criminal Division) from its former location in Whitby to the Oshawa City Hall; AND WHEREAS this relocation will affect and inconvenience th& residents of the Town of Ajax, Village of Pickering and the Township of Pickering in that the distance to attend for summons and payment of fines has been greatly increased; AND WHEREAS the local Police Departments are required to travel greater distances to deliver and pick up court documents and fines; AND WHEREAS the total population of the three local municipalities total 43,000 residents, warranting a Provincial Court Sub-Office; AND WHEREAS the Councils of the Municipalities of the Town of Ajax, Village of Pickering and the Township of Pickering strongly support the need for a Local Provincial Court Sub-Office; BE IT THEREFORE RESOLVED that the Provincial Government be petitioned to have a Provincial Court (Criminal Division) Sub- Office located within either the Town of Ajax, Pickering Village or the Township of Pickering.
