¢ 0 U N C I L.. _M~ E E T I N G A meeting of the Picketing Township Council was held on MONDAY, the THIRD day of NOVEMBER, 1969, at 8 p.m. PRESENT: ~eeve J. R. Williams Deputy Reeve R. Rudik that the minutes of the Council meeting dated October 20th, 1969, be adopted as amended. CARRIED Moved by Councillor R. Mason, seconded by Councillor J. Kruger, that the minutes of the Council meeting of October 29~h, 1969, be adopted as presented. CARRIED (II) ACCOm~S Approval of accounts for the month of October, 1969 be approved for payment. See Resolution #296/69. I~__DE PUTATIONS 1. Moved by Councillor R. Mason, seconded by Councillor J. Krxzger, that Mr. A. V. Kanbergs be heard. Mr. Kanbergs appeared on behalf of Mr. A. Bredovskis with respect to his client's application A 17/69, to amend the zoning by-law 1978 by a specific exemption to permit the erection of an industrial building on a parcel of land (Lot 18 and 19 and a part of Lot 6, Plan 5). The application was refused by Planning Board on the grounds that development of this site for the proposed use was premature without an area road pattern and said proper~y does not front on a 66 foot public street. The Council endorsed the recommendation of the Planning Board by their Resolution #273/69. Mr. Kanbergs appealed to Council to reconsider his client's application on the basis of not requiring municipal services. The Council after considerable deliberation declined to reverse its previous decision. 2. At the request of Council, Mr. J. S. Hobbs, Commodore of the West Rouge Canoe Club, together with several of its members, appeared before Council to receive congratulations and a small token of appreciation from Council for their successes in the past season's racing competitions. Chatten of Ontario Water Resources Commission Certificate to Mr. Norman W. Sowerby on completion of course and certification as Sewage 'Works Operator. - 2 - 28/69 ,{,V) CORRESPONDENCE 1. The Ontario Humane Society requests permission from Coun©il to tag, in support of the Ontario County Humane Shelter, in the hopping centres of Bay Ridges~ oq the ~ve~ing of November 7 Friday} and on November 8, 1969 (Satur~ay~. Clerk to advise the Ontario Humane Society of the conflict of dates with those of the Canadian Legion scheduled for November 5 to the llth, 1969. It was suggested they arrange for alternate dates. 2. The Ontario Good Roads Association in finalizing plans for its 76th Anniversary Convention to be held at the Royal York Hotel, Toronto, February 23, 25 and 25, 1970, is asking that if Council is aware of a road problem of general interest, the solution of which requires study, amending legislation or other action, the problem be expressed in a resolution wh~hrm~ry be considered by the Convention. They are also asking for names for recognition of long services in the cause of good roads. Referred to the Roads Committee. 3. The Town of Mississauga forwards its resolution re Cable Television, requesting the Township of Picketing to endorse same. Prepare copies for Council. Inquire from Township Solicitor, legal aspects of the Mississauga proposal, and as to possible intent of the resolution. 5. Received note of thanks from Mr. Ross Murison, Reeve of Picketing Village, confined to the Ajax-Picketing General Hospital recuperating from a heart attack. (VI) .. INFORMATION 1. Mr. James A. Taylor, Township Solicitor, forwards procedure of expropriation regarding Lots 117 and 118, Registered Plan 285. Copies to Council. 2. The Ontario Municipal Board forwards notice of approval of $119,200.00 capital expenditure for the construction of sanitary sewer, watermain and asphalt pavement on Dillingham Road. 3. Mr. W. A. Johnston of Squires Beach extends thanks to members of Council for the time and effort given by them in the past term, and wishes Council his best in the forthcoming election. 5. Mr. W. A. Johnston of Squires Beach extends appreciation and thanks to Picketing Township Council, Ajax Town Council and the M.T.R.C.A. re discharge of firearms posting of the Duffins Creek area. 5. The Department of Lands and Forests advises of a three-day open deer season, November 3, 5, and 5, 1969, shotguns only, no dogs. Refer to Resolution #55/69, March 17, 1969. 6. The Ontario Good Roads Association advises of the cancellation of the meeting scheduled for 7:00 p.m. Tuesday, November 18, 1969 at the Rock Haven Motor Hotel, Peterborough, Ontario. 7. The Planning Department forwards for the information of Council a motion from the Planning Board Minutes of October 9 re A 13/68, Liss &Hyman, Lot 27, Plan 592, that the Site Plan as submitted is unacceptable to the Planning Board, site plan being preliminary sketch of their intention as they require the elevation of Highway #2 as reconstructed in order to present a proper detailed site plan. 8. The Ontario Water Resources Commission forwards carbon copies of letters forwarded to the following, advising that water samples indicate the presence of Coliform bacteria. Mr. D. CARRIED Resolutiom #300/69 MOVED by Deputy Reeve R. Chatten, seconded byCouncillor R. Mason, that whereas the Lawrence Avenue extension is proposed to run easterly through the southerly extremities of the Township of Picketing; AND ~HEREAS there are residential building lots located on the proposed right-of-way; AND WHEREAS it is in the interest of the ~unicipality to restrict the building of homes on these lots to reduce the cost of future acquisition of right-of-way for the Lawrence Avenue extension; BE IT THEREFORE RESOLVED that the Council acquire lots 117 and 118, Plan 28~ at a price to be negotiated pending appraisal of said land by a qualified appraiser. AND FURTHER, that Council be prepared to negotiate an offer on Wednesday, October 29, 1969; AND THAT the Clerk be instructed to have appraisals made on Lots 21, 22, 11, 12, and 13, Registered Plan 233, of the Township of Picketing; AND THAT the Council consider the purchase of these lots for the purpeSes of the Lawrence Avenue right-of-way, as recommended by the Standing Committee of the Whole Council, October 27, 1969. CARRIED Resolution #301/69 MOVED by Deputy Reeve R. Chatten, seconded by Councillor R. Ymson, that the Canadian National Railway provide one mile of trackage as a spur line regardless of cost into the industrial area to be designated by Council and located south of the MacDonald-Cartier Freeway and further, that the grade approaches and crossings be controlled by the railway, and that the track be designated within five years, and further, that the section of the C.N.R. proposal with respect to $100,000.00 be withdrawn; and further, that Council withdraw their objection to the present spur line, provided that the above conditions are complied with, as recommended b.y the Standing Committee of the T~hole Council, October 27, 1969. CARRIED Resolution #302/69 MOVED by Deputy Reeve ~. Chatten, seconded by Councillor R. Mason, that the Kennel License issued to Mrs. Martha MacKenzie be revoked. This License is not being revoked by reason only of the use of the land, but it is the manner of carrying on the kennel operation, as recommended by the Standing Committee of the ~hole Council, October 2?, 1969. CARRIED Resolution #303/69 MOVED by Deputy Reeve X. Chatten, seconded by Councillor R. Mason, that the Council of' the Township of Pickering endorse the recommendation of the Metropolitan Toronto Council with respect to the amendment to Clause No. 1 of Report #8 of the Metropolitan Toronto Waterfront Plan, amendment reads as follows: (a) "It is further recommended that, when such negotiations take place, representatives of those municipalities in the Metropolitan Toronto Planning Area fronting on Lake Ontario, and the Toronto Harbour Commis.sion~ be invited to attend with the Legislation and Planning Committee; and (b) It is further recommended that The Municipality of Metropolitan Toronto request the Government of Canada and the Government of the Province of Ontario to enter into an agreement with the Councils of the Municipalities fronting the waterfront to acknowledge the jurisdiction and ownership in those municipalities over lands created in the area governed by the Metropolitan Waterfront Plan.~ as recommended.by the Standing Committee of the ~hole Council, October 27, 1969. CARRIED Resolution #305/69 MOVED by Deputy Reeve R. Chatten, seconded by Councillor R. Mason, that Resolution #1~9/69 providing for the sharing of cost for servicing the ,Supreme Aluminum property sold as serviced land to the extent of $17,$00.OO be rescinded and that the Township of Picketing Council agree in sharing of the cost to a limit of $18,955.95 to assist in covering the additional cost in servicing these lands with water and sanitary sewers, as recommended by the Standing Committee of the Whole Council, October 27, 1969. CARRIED - 6- 28/69 Resolution #305/69 MOVED by Deputy Reeve R. Chatten, seconded by Councillor R. Mason, that Council endorse the report of the TownShip Engin. eer with respect to the parking area for the Picketing Township Sports Arena and .accept the quote of Lynview Construction Ltd. in the amount of ~11,538.00 for the removal of top soil and replacement of granuXar -"A" base, all to the satisfaction of the Township Engineer, as recommended by the Standing Committee of the Whole Council, October 27, 1969. CARRIED Resolution ~306/69 MOVED by Deputy Reeve R. Chatten, seconded by Councillor R. Mason, that Councillor R. Mason be appointed as an alternate from Council to sit on the Site Plan Committee, should the original appointee be absent, as recommended by the Standing Committee of the Whole Council, October 27, 1969. CARRIED Resolution #307/69 MOVED by Councillor D. Kitchen, seconded by Councillor J. Kruger, that Committees of Council and the School Board appointed to consider the swimming pool project be directed to meet to recon- sider the criteria of getting the swimming pool program back to the Dunbarton High School site, as recommended by the Standing Committee on Finance, October 29, 1969. CARRIED Resolution #~08/69 MOVED by Deputy Reeve R. Chatten, seconded by Councillor V. Kruger, that whereas the advertisement for the local improvement of watermains, sanitary sewers and roads for the industrial lands, Par~ Lot 19, Range 3, Broken Front Concession has been completed; AND %~HEREAS the Ontario Municipal Board has given its approval for said local improvement; BE IT THEREFORE RESOLVED that the Council of the Township of Picketing authorize the Engineer to call tenders on said capital project. CARRIED - 7 - 28/69 Resolution #310/69 MOVED by Councillor J. Kruger, seconded by Councillor V. Rudik, that the question with respect to "are you in favour of becoming a Borough of Metropolitan Toronto, or a Borough of an Oshawa Centered region, or not in favour of either proposal" be placed on the 1969 election ballot and be submitted to the electorate as a three-part ballot, as recommended by the Committee of the Whole Council. CARRIED Resolution #311/69 MOVED by Councillor J. Kruger, seconded by Councillor V. Rudik, that whereas Robert Schotten has under date of October 8, 1969, applied to the Council of the Corporation of the Township of Pickering for a loan under the provisions of the Tile Drainage Act; AND WHEREAS By-Law Number 1048 of the Township of Pickering authorizes the Council to borrow upon the credit of the Corpora- tion such sum or sums not exceeding $10,000.00 to assist land owners with drainage projects; AND WHEREAS the necessary funds will be raised by the issuance and sale of debentures to the Treasurer of Ontario and She said debentures are not a charge against the credit of the CSrporation; BE IT THEREFORE ENACTED that the Clerk be authorized to apply to the Treasurer of Ontario for the purchase of debentures in the amount of $2,700.00; THAT upon receipt of the approval of the Treasurer of Ontario to the purchase of these debentures, the Treasurer of the Township of Pickering is hereby authorized to advance the said $2,700.00 to Mr. Robert Schotten; AND THAT the necessary By-law be drafted in accordance with the provisions of the Tile Drainage Act to provide for the levying of an annual rate over and above all other rates on the='property of the said Mr. Robert Schotten sufficient for the paym~ent of the principal and interest of the said debentures. Kruger, moves that By-law Number 3729/69 to authorize the execution of a deed of 3150 acres of land in Lot 19, Range 3 to Scaet Laboratories Limited be now read a second time, and that Council go into Committee of the Whole thereon. Kruger, moves that By-law Number 3730769 to repeal by-law number 3726 respecting expropriation, be now read a second time, and that Council go into Committee of the ~ole thereon. Kruger, moves that By-law Number 3731/69 to confirm the proceedings of the Council of the Corporation of the Township of Picketing at its meeting held on the third day of November, 1969, be now read a second time, and that Council go into Committee of the Whole thereon.
