Kruger, seconded by Councillor D. Kitchen that the minutes of Council held on March 17, 1969, be adopted as presented. CARRIED (a) Councillor J, K~uger inquired f.rom the Reeve as to the results on Resolutions ~376/68 and #377/68. The Clerk advised that a follow-up letter has been sent out to the respective municipalities and that reply as to the action taken is filtering in. It was suggested that this be given further consideration in Committee of the Whole, after more time has been ,allowed for the municipalities to make their replies, (b) Councillor D. Kitchen inquired as to confirmation of a split mill rate for the two old school areas continuing on into 1969. The Reeve advised that on discussion with the Clerk and Township Auditors, the two rates will continue for the year 1969, but he wished to have confirmation from the Department of Municipal Affairs. Attn: Mr, Ke,nnedy, Chairman of the Board Appe~ t, Gran~ .a ..Building Permit to Reginald .and Lorna Braid Dear Mr. Kennedy: ~e have been refused a building permit for 1969 from the Township of Picketing. The reason stated that they have authoriza- tion from the Ontario Municipal Board to issue 100 building permits per year. ~e purchased a 2 acre lot on the Greenwood .Road in 1960 and have been paying taxes since that date. - 2- 11/69 In the fall of 1968 we applied for a permit to install a culvert. The Pickering Township authorities did this for the fee of $75.o0. On January 15, 1969 we made formal application for a building permit. Our lot plan was taken by the County Health Department and was approved for a well and septic bed, the spetic to be located 1OO feet from the well. We returned to the Engineering Department, they accepted our deposit of $300.00 (although this has not been cashed) and accepted a copy of the building plans. The well has been drilled, the material for our home has been purchased, and now upon requesting the permit on March 21st, we have been notified that the permit has been d~ ied, on the grounds that only 100 building permits can be issued as follows: Group A Developers 45 Group B Personal Homes 50 Group C Rural 1OO It seems absurd that the Ontario Municipal Board is refusing Picketing Township the right to collect our Tax Dollars consider- ing the fact that: (1) There is no water required; (2) No sewage required: (3) No garbage collection required; (4) No further road maintenance; (5) The hydro is our cost; (6) We have no children, although under present. Education Plans this cost is not borne by the Township. So how can we possibly be a drain on the Township. They have everything to gain. Our home will be in a Rural residence area, with restrictions as to minimum size, therefore the taxes would be substantial. It is our intention to appear at the next Council meeting on Monday, March 31st, 1969 and we would appreciate your assistance on our behalf. Dear Mr. Plitz: Re: ,Reginald and Lorna Braid I have been directed by the Chairman of the Board to you a copy of a letter dated March 24, 1969 from Mr. and Mrs. Reginald Braid, and the same is enclosed herewith. Will you be good enough to forward your comments at your earliest convenience herein. Yours truly, R. Scott, Secretary - 3 - 11/69 Reeve Williams advised Mrs. Braid that the 0OUncil is controlled by the Ontario Municipal Board on a quota of 100 residential building permits and further that an'appointment is being arranged to meet with Mr. J. A. Kennedy, Chairman of the Board to discuss among other things the possibility of having our quota increased to 300 for 1969. Councillor Rudik suggested that in reply to the Ontario Muni~ pal Board letter, Council should mention the Ontario Municipal Board Order which imposes the restriction. Mrs~ Braid was requested to bear with Council for a further two weeks when it was likely a definite answer would be given. 2. Moved b~ Councillor J. Kruger, seconded by Councillor A. King that Mr~ T. A. Newman be heard. Mr. Newman appeared on behalf of Mr. Cunningham who is seeking an agreement with the Township and a building permit to erect a house on an unopened (unimproved) Township road allowance between Township lots 8 and 9, Concession 8. Mr. Newman requested Council's permission to allow Mr. Cunningham to speak on his own behalf. Mr. Cunningham advised Council that he was aware of Mrs. Pugh receiving a building permit under a restrictive agreement and that he was willing to assume this responsibili$¥. Mr. Newman made reference to his inquiries to the various officials of the municipality and was assured of no problems in effecting a transfer of the agreement or the permit. It was on this assurance that his client, Mr. Cunningham, proceeded with the purchase of this property from Mrs. Pugh. The Council had second thoughts about this problem, suggesting that it be referred back to the Roads Committee for a review and final recommendations. Mr. Newman advised Council that his client would be agreeable to enter into a new agreement with the Township. See Motion 8 (e). Referred to the Roads Committee. Some members of Council felt that under the circumstances the Township shoula allow a transfe~ of the agreement and issuance of a building permit as they would probably find themselves in the position of having a mandamus issued and would be without an agreement if the request was not met. 3. Moved by Councillor Kruger, seconded by Councillor Rudik that Mr. C. W. Laycox of P.M.A. Real Estate be heard. Mr. Laycox made a presentation to Council of drawings of four old buildings located in the Township. He explained that 5000 brouchures had been mailed by his Company to all parts of the world, advertising the Township's industrial potential, and that this was the first series of a set of three of four pictures in each set. The Council thanked Mr. Laycox and his Company for their pre- sentation and advised they would be suitably hung in the Municipal Building. Ltd., Whitby- 155,600.O0 (f) Aykroyd Const. 1965 Ltd. 142,7OO.00 The Council and the Architect, Mr. Silverberg, agreed that the bids were too high. Mr. Silverberg suggested to Council that he be authorized to select the three lowest bids, contact the respec- tive construction companies to attempt a more reasonable construc- tion cost. On recommendation of Council, Mr. Silverberg retained the tenders advising he would contact the Clerk in two to three days on the results of his efforts. The matter was tabled and referred to the Committee of the Whole Council. (V) CORRESPONDENCE 1. Fir. M. B. Beauchamp, Administrator Clerk-Treasurer, Town of Ajax, advises the Township of Picketing Resolution #39/69 was presented to their Council and has been referred to their Finance and Legislation Committee for further consideration. 2. Mr. J. G. McQueen, Clerk-Treasurer, Village of Picketing, forwards a copy of their Council's motion favouring the division of the Township in a north-south direction, the easterly part to be joined to Ajax, Picketing Village, and associated with an Oshawa-based region. Motion as follows -- (passed March 17,1969) "Moved by Mr. McLean, seconded by Mr. Dingley, that it is the opinion of this Council that, assuming the Minister of Municipal Affairs exercises his perogative in prohibiting the Township of Picketing from joining the Municipality of Metropolitan Toronto, this Council favours alternative two of the regional Government proposal of the Town of Ajax, dividing the Township of Picketing in a north-south direction, with the easterly portion of the Township of Picketing, the Town of Ajax, and the Village of Picketing forming one municipality in the Regional Government mmnicipality located east of Metropolitan Toronto and associated withan Oshawa-based region. "This o~a~emen~ is subJec~ ~o ~he availability of further informa- tion being provided by the municipalities referenced." The Council inquired as to the poss/ble breakdown in communi6a- tions with the Village of Picketing, as this type of motion should not have been written. ' Reeve Williams had talked with Reeve Muison and Reeve Polack on Wednesday, March 26, 1969, and stated there was no indication made at this meeting that such a resolution was being considered. He indicated that if Metro made a move in the direction of Pickering's amalgamation with it, the thinking of the Provincial Government could be changed. It was suggested that every effort be made to have the Councils of the three municipalities meet again and that communications be improved. 3. ~. & Mrs. R. Braid, forward carbon copy of a letter addressed to the Ontario Municipal Board with reference to obtaining a building permit - Greenwood Road. See Delegation ~1. Mr. A. Robertson, on behalf of the four major Ratepayers' Associa- tionsin the F~enehman's Bay Area, requests that more consideration be given to the location of proposed high rise apartments. Copies to Council. 5. Mr. A. Robertson, President, Bay Ridges Ratepayers' Association, requests that the Ratepayers' Associations be consulted before appointments are made to the Parks and Community Boards in this area. Copies to Council. 6.~:~ The Toronto Building and Construction Trades Council, regarding tender for the Pickering Fi~e Hall, forward names of two contractors considered by them to be "unfair contractors" as they are not in contractual relationship with the Toronto Building Council, and suggests this be considered when the tender is awarded. No action by Council. 7. Mr. J. Ross Backus, Business Administrator and Treasurer, Ontario County Board of Education forwards comments in regard to the Board's preliminary requisition for funds of March 12, 1969. Copies to Council. No action by Council. 8. The Ontario Municipal Board acknowledges receipt of letter dated March 24 from Mr. & Mrs. R. Braid re building permit, and requests the Clerk to forward comments at the earliest convenience. See ~elegation #1. 9. The Railway Transport Committee re Resolution #373/68 (Bell Tele- phone Order re revision of rates) forwards copy of their notice advising that a pre-hearing conference will be held April 8 in Ottawa for the purpose of receiving suggestions as to the fixing of a date for hearing the application. m PORTS 1. Kitchen, that the site plan attached to the agreement with the Frenchman's Bay Yacht Club Incorporated, dated February 24th, 1967, be replaced by site plan I, Revision 'B' March 17th, 1969, whereby the Spar Shed was relocated from the south side of the Club House to the north dock in the Dry Sail area provided that the Spar Shed be not closer than 5 feet to the north lot line. Kitchen suggested that it would be a good idea to form our own United Appeal, joining forces with the Town of Ajax and the Village of Picketing. He indicated that the vast majority of people working have as their place of employment, the City of Toronto. The Council should look into this. Resolution #58/69 MOVED by Councillor D. Kitchen, seconded by Councillor A. King, that the Engineer be authorized to obtain tenders for: Calcium Flake Gravel Crushing Calcium Liquid 2 Four Ton Dump Trucks Cold Mix Asphalt 1 One Ton Work Truck Surface Treatment Hopper Sander Asphalt Pavement Repairs Weed Sprayer CARRIED - 11- 11/69 The question of tendering for gravel crushing was debated briefly with it being suggested that this be deleted from the resolution, basing this on the recent report submitted by Mr. Poulsson, P. Eng., with respect to gravel crushing, and purchase. It was decided to leave this in the resolution but Council should decide on the recommendation made in the report. Dorosz, Part South half Lot 18, Concession l; and WHEREAS this approval was subject to a condition that satisfactory arrangements be made with Council regarding roads and services prior to the consent becoming effective; BE IT THEREFORE RESOLVED that the Committee of Adjustment be advised that the applicant has made satisfactory arrangements with Council regarding road and services and that these arrangements are as follows: A. The owners must dedicate Parcel E as shown on the schedule entitled Part Lot 18, Conc. l, dated February 27, 1969, free and clear of incumbrances to the Township. The Township agrees to keep such land in reserve for a future road allowance. It is not the intention of this Council to require a road to be constructed on Parcel E at this time. B. That the Township will initiate a local improvement for the extension of the gravel road and the watermains to the northerly limit of Parcel R as shown on the schedule entitled Part Lot 18, Conc. l, dated February 27, 1969, and to provide a one foot reserve at the north limit of the road so constructed. It is intended that a debenture issued for the gravel road shall have a term of 5 years and the debenture issue for the watermain for a term of 20 years, and that ~ entire cost share be levied as a rate per foot frontage against the benefitting lands. C. That the Township will not issue occupancy permits for any building constructed prior to the completiQn of the gravel road and watermains.
