COUNCIL MEETING
A meeting of the Picketing Township
Council was held on the SEVENTEENTH

ADOPTION OF ~INUTES
Moved by Councillor J. K~uger, seconded by Councillor A. King
and carried tmanimously, the minutes of the Council meeting held
on February 3, 1969, were adopted.
(II) NEW BUSINESS
1. Councillor Kruger expressed concern that the local radio station
apparently received copies of the minutes of a recent Regional
Government meeting prior to members of Council. He wondered
whether there was any truth to the statement that the proposed
region was to include eight boroughs.
The Reeve explained that the reference to eight boroughs resulted
from remarks made by Mayor Nevauan of Whitby concerning the possible
expansion of the area to be considered in the current study to
include parts of the Counties of Victoria and York as well as the
whole of Ontario County. To his knowledge, the Government had
not yet defined the boundaries of the region.
As to the distribution of minutes to the various news media
prior to members of Council, this matter would be corrected.
.(III}, DELEGATIONS
1. Moved by Councillor Kruger, seconded by Deputy Reeve R. Chatten
that Mr. D. Eyes be heard.
Mr. E~es appeared before Council concerning a recent Committee
of Adjustment decision involving a 10 acre parcel of land owned
by him. He asked that Council direct the Committee to reverse
their decision in order that he might separate a five-acre
parcel from his property. It was-pointed out to Mr. Eyes that
the Committee as constituted was appointed as having exclusive
authority in this area and that any redress he might wish restgd
with the Ontario Municipal Beard and the Courts. Evidently he
had appealed the decision of the Committee to the Ontario
Municipal Board and his appeal had been denied.
Mr. Eyes was of the opinion that his ~roperty fell within the
broad definition of a cluster and on inquiry to the Committee
concerning the definition of a cluster within the meaning in
the Zoning By-lawhad received no satisfaction.
Some discussion followed during which the relationship of the
Committee of Adjustment to Council was explained. It was suggested
that if Mr. Eyes wished to pursue the matter further, he should
appeal the decision of the Ontario Municipal Board to a higher
court.

COmmS O DENCE
1. The Ontario Good Roads Association confirms Convention dates of
February 24 to 26 at the Royal York Hotel, Toronto, and advises
of a Ladies' Convention Committee Program.
2. Mr. William H. Wallace, Clerk of the Town of Whitby, forwards
copy of letter from the President of the Ontario Municipal
Association, Mayor J. A. Heenan, concerning a joint brief
requesting an indefinite postponement of the request by Bell
Telephone Company for a rate increase. Mr. Wallace advises
that the Council of the Town of Whitby is actively opposing the
rate increase.
3e Mr. F. E. Sider, District Forester, Department of Lands and
Forests, extends thanks to the Game Commission of Picketing
Township for their effort in helping to improve pheasant
hunting.
4. Mr. C. R. Williams, Secretary, Township of Uxbridge Planning
Board, forwards a revised copy of a by-law to regulate the
carrying on and operation of pits and quarries, and advises
that a meeting will be held on Tuesday, February 18, 1969 at
8:00 p.m. in the Uxbridge Township Hall to meet with representa-
tives of the Township of Picketing to discuss the proposed
revised by-law with Council and Planning Board.

(V),L INFORMATION
1. As certain members were unable to attend the joint Planning
Board and Council meeting scheduled for February 25, 1969, an
alternate date was requested by the Planning Director.
March ll has been selected as the alternate date.
2. James A. Taylor, Township Solicitor, advises that the Appeal
Book and Evidence re the Township's Assessment Appeal were filed
in the Court of Appeal on February 12, and Notice that the Appeal
had been perfected was served on the Solicitors for the County'
of Ontario and for the Town of Ajax and also sent out to the
Solicitor for the Town of Whitby for service.
3. Aggregate Producers' Association of Ontario advises the post-
ponement of the February 18, 1969 meeting re Uxbridge Township
and gravel p%t operators. Meeting has been rescheduled for
March 25, 1969.

including such legal advice as is required to fight any application

that the Engineer be instructed to take all the necessary steps
to enforce the Zoning and Building By-~aws in respect to the con-
struction of a carport in contravention of Zoning By-law 2511
and Building By-law 3295 on Lot 219, Plan 345, being 951 Beachpoint
Promenade occupied by Mr. J. Kuchta, as recommended by the Standing
Committee on Roads dated February 4, 1969.

Resolution #21/69
MOVED by. Councillor A. King, seconded by Councillor R. Mason,
that whereas the Council of the Township of Uxbridge accepts the
proposed provisions for renewal of the fire contract with the
Township of Pickering as contained in our letter dated October
23rd, 1968.
BE IT THEREFORE ENACTED that the Clerk, with the assistance of
the Township Solicitor, prepare a new agreement with the
following amendments.
(a) Standby rates be increased from $500.00 to $750.00 per annum.
(b) The charge for services be increased from $75.00 for two
hours service to $1OO.O0 for the first hour and $50.00 per
hour for each hour thereafter.
(c) And further provided that either Corporation shall have the
right to terminate the agreement at the end of any calendar
year by giving twelve months clear notice in writing to
the other party of its intention.
(d) And further, that the legal costs for the preparation of
this agreement will be shared equally by both municipalities.

MOVED by Councillor V. Rudik, s~conded by Councillor A. King,
that whereas the Metropolitan Toronto and Region Conservation
Authority has adopted the recommendation of the Conservation
Areas Advisory Board and the Executive Committee having regard
to Project C.A.-48 "A Project for the Acquisition and Development
of the Frenchman's Bay Area";
AND WHEREAS the Municipality of Metropolitan Toronto and the
Township of Pickering will be ~esignated as benefitting
municipalities;
BE IT THEREFORE RESOLVED that the Township of Pickering does
endorse the action of the Conservation Authority, and further,
agrees to transfer to the Authority for a nominal sum, all lands
owned by the Township included within the project (approx. 48
acres-~
The Township would request that the Authority consider continuing
the lease presently in effect on the lands occupied by the
Frenchman's Bay Yacht Club, and further, that the Authority agrees
to lease back to the Township of Pickering the area known as
West Shore Glen Park for a nominal sum, as recommended by the
Committee of the Whole Council, February 13, 1969.

MOVED by Councillor V. Rudik, seconded by Councillor A. King,
that this Council does hereby endorse the recommendation of the
Pickering Township Planning Board on January 23, 1969; and hereby
directs that the application (A 20/68) to amend the zoning from
Rural Agricultural Zone 'A' to Local Commercial Zone 'Cl' to
permit the operation of a combined retail store and residence;
on property known as Lot 16, Plan 329; be resused on the grounds
that such is not considered compatible with the present level
of servicing nor the surrounding development.

MOVED by Councillor V. Rudik, seconded by Councillor D. Kitchen,
that this Council does hereby endorse the recommendation of the
Pickering Township Planning Board on Janugry 23rd, 1969; and
hereby directs that this application (A 1/69} to amend the
industrial zoning by a specific exemption to permit the use of
the existing factory as a Legion Hall for the Royal Canadian
Legion, Bay Ridges Branch; on proper~y known as the Southerly
91 feet of the Northerly 685 feet of the Easterly 242 feet
approximately of the Westerly 622 feet of Lot 20, Range 3; be
APPROVED on the grounds that the proposed use is considered
compatible with an industrial area; subject to:
l) Provision of a chain link fence around the property
boundaries;
2) Provision of a parking area properly surfaced;
3) External lighting to be directed away from abutting
properties;
Submission of a Site Plan for the approval of the Planning
Board, with such to indicate the above conditions l, 2,
and 3, as well as entrances, exits, building locations and
all physical features;
5) That the applicant enter into a Site Plan Agreement with
the Municipality;
6) The requirements of the County Health Unit with respect to
the proposed operation;
7) The requirements of the Fire Department;
8) That this approval shall become null and void on the 23rd
of January 1970 if the above conditions have not been
fulfilled.
And Council hereby further directs that the necessary amending
by-law be prepared accordingly.

Resolution #25/69
MOVED by Councillor V. Rudik, seconded by Councillor D. Kitchen,
that this Council does hereby endorse the recommendation of the
Pickering Township Planning Board on January 23rd, 1969, and
hereby directs that development of the subject property (the
north-west corner of Bayly Street and Brock Road) be ACCEPTED in
accordance with the Display Plan dated January 23rd, 1969, wit~
such Display Plan to be used as a reference for future land
divisions through the Committee of Adjustment; subject to:
l) That the applicant enter into a registerable agreement with
the Municipality, incorporating the conditions of approval;
2) That the Plan be amended to conform with the Display Play
dated January 23rd, 1969;
3) That satisfactory arrangements be made with the Council, with
respect to such items as: sanitary sewers, storm sewers,
watermains, paved roads and curbs, sidewalks, street lights
and signs, hydrants, paved driveways, and back of lot drainage;
4) Contributions to the Municipality to cover sewer and water
plant extensions, in an amount to be determined by Council;
5) That the owners agree to erect on the lands within the plan,
only those buildings permitted under ~he provisions of By-law
Number 25115.
6) The deeding to the Municipality, free and clear of encumbrances,
such easements %n locations and widths as required by th~
Township Engineer;
7) That all outstanding taxes and local improvement charges be
paid or satisfactory arrangements be made with the
Municipality, prior to finalizing any consent applications;
8) That the streets shall be named to the satisfaction of the
Township of Picketing and Metro Planning Boards;
9) That permanent access to individual sites shall be from
internal roads, with any access from the Brock Road to be
of a temporary nature only, for construction purposes or
general use, with such general use access terminating when
physical access is available from internal streets;
10) That the road allowances and widenings, as indicated on ~he
Display Plan dated January 23rd, 1969 be deeded, free an~
clear of encumbrances, to the applicable governmental
authorities.

that the 1969 Capital Forecast as amended be recommended to
Council for adoption and that the Forecast be forwarded to
Nr. J. A. Kennedy, Ontario Municipal Board Chairman, with a
request for an appointment to meet and discuss the 1969 Five-
Year Capital Forecast in detail along with our proposal to increase
our residential building permit quota from the present 100 to
300 permits, as recommended by the Committee of the Whole Council,
February l3, 1969.

that the Council of the Township of Pickering advance $95.00
from the 1969 budget as designated for the Pickering Township
Track and Field organization, said funds to be used in the
training of ~r. John Schaepper in Leadership and Training Course
under the guidance and directorship of Mr. Lloyd Percival, as
recommended by the Committee of the Whole Council, February 13,
1969.

MOVED by Councillor R. Mason, seconded by Deputy Reeve R. Chatten,
that whereas it has been brought to Council's attention that
lands in Registered Plan 525 are being offered for sale in the

THEREFORE be it resolved that an investigation be made in~o the_
alleged violation of The Planning Act and/or Subdivision Control
By-law Number 2091 of the Township of Pickering; and that the
Clerk be directed to advise the owners of the lands offered for
sale contrary to The Planning Act, of the consequences of any
violations thereof.

Ontario; request the Minister of Municipal Affairs to defer
approval of all future subdivision proposals within jurisdictional
area of the Divisional Board of Education for the County of --
Ontario unless an approved Official Plan and/or Restricted A~.ea
By-law is in effect in the Municipality; and residential develop-
ment is compensated by industrial and/or commercial assessment.

2. Open negotiations with Bell Canada to establish an Emergency
Service Number in all exchanges serving the Township of Pickering.

3. Engage the services of W. R. Kellough and Associates to super-
ficially explore the Assessment Roll to determine the properties
which would warrant closer examination, and consideration for
submission to the Court of Revision as the basis of the Township
appeal.

repaid under a special agreement.
