Marshall ADOPTION OF MINUTES (II) Moved by Councillor Mrs. J. L. McPherson, seconded by Coun~illor D. Quick, 'that 'the minutes of the meetings of March 6 and l3, 1972, be adopted as amended. CARRIED l. DELEGATIONS 2. On motion of Mr. Ashe, seconded by Mr. Ki tchen and carried it was agreed that Mr. R. Mason be heard. Mr. Hason appeared before Council to obtain their assistance in ob'taining an exclusion from the expropria- tion procedures initiated against the residential property owners adjacent to the Metro Sanitary Landfill Site. In a detailed brief he touched on the his'tory of the situation referring to the previous agreements that Council had had with the Metro Works Department in connection with this site. It was his understanding that at no time was it intended that the residential property owners were to be expropriated, it being understood that the landfill operation was to be restricted to the aggregate sites to the north. He suggested that Council should protect the interest of the citizens involved by rescinding the by-law designating the entire area as a Sanitary Landfill Site. The Reeve noted that the present by-law before Council had only had two readings and as such could be amended at this stage should it be deemed necessary. He suggested that a meeting should be arranged between the Metro Works Department and the Township Works Committee and the interested citizens to discuss their objections to the site. He also noted that i't would be to Council's advantage to know exactly whióh residents were opposed to the expropriation. Mr. Mason volunteered to supply a list of these people. On motion of Mrs. McPherson, seconded by Mr. Ashe, and carried, it was agreed that Mr. Lang be heard. Mr. Lang appeared before Council in support of the applica- tion of th9 Apostolic Church and their request for a rezoning of Lot 3l in Plan 509 to permit the construction of a chapel. He noted that a personal canvass of the area had raised only objections to such practical items as the absence of water and sewers and suggested tha't these were items that could be resolved. The chapel was 'to be built (III) l. 2. 3. 4. 5. - 2 - 8/72 to accommodate eighty people while the size of the existing congregation was forty. In response to Mr. Lang's remarks the Reeve noted the fact that the property was less than half the size required by the zoning by-law for such a use. He also noted that the residents in the area had made their views known on the subject at the recent Planning Board meeting. Council wondered whether the congregation had considered the temporary use of a school facility for their meetings until such time as they had sufficient funds to locate on a site more suitable. Evidently this was contrary to the Church policy. See Resolution #95/72. CORRESPONDENCE The City of Oshawa forwards their resolution with respect to municipal police costs incurred in overseeing the Liquor Control Board of Ontario Act, requesting Council's endorsation of same. The City of Oshawa forwards their resolution with respect to control of traffic in private parking areas, requesting Council's endorsation of same. Copies to Council and News Media. See Resolution '98/72. The City of Oshawa forwards their resolutions regarding (i) legislation regarding the duties of pedestrians, and (ii) persons soliciting rides on highways, requesting Council's endorsation of same. Copies to Council and News Media. See Resolutions '99/72 and #lOO/72. The Kinsmen Club of Bay Ridges requests permission to conduct a blitz sale of Kin Gro Fertilizer in the Pickering Township on Saturday, April 8, 1972, in aid of their various community activities. See Resolution #lO3/72. Mr. M. W. Basich, Project Co-ordinator, Department of Social and Family Services, advises that the tenders and documents for the Day Care Centre have been reviewed, and suggests that the two low contractors re-submit their base tender price with liquidation damages clause and kitchen equipment deleted. In this filing, the Company proposes no change in the present level of rates now being charged to this municipality. The Borough of Scarborough forwards their by-laws 12346, l4569, and 14693 regulating and restricting land use to ascertain if there are any objections to same. Instructions - Copies to be sent to Council and to Planning Department. The Ontario Municipal Board forwards copy of the Board's Order re the appeal by Dawn Abraham against a decision of the Committee of Adjustment, in which the Board orders that this appeal be allowed, and that the application for the variance be granted for a temporary period expiring on the 21st day of December, 1976, subject to the condition that not more than 30 pupils may be in attendance at anyone time. (VI) RESOLUTIONS Resolution #94/72 MOVED by Councillor D. Kitchen, seconded by Councillor D. Quick, that the Council of the Township of Pickering adopt the procedures outlined in the Planning Report "Initial Administrative effect of the Federal-Provincial Statement of March 2nd, 1972, regarding an Airport and Satellite City in Pickering Townshipll dated March 9th, 1972; and that this report be made available to the public on request after confirmation of the content by the Province. CARRIED Resolution #95/72 MOVED by Councillor D. Kitchen, seconded by Deputy Reeve G. Ashe, that this Council does hereby endorse the recommendation of the Planning Board of March 9th, 1972, that application A l8/72 to amend the zoning on Part Lot 31, Plan 509 to permit a church on approximately l/2 acre be REFUSED on the grounds that such is incompatible with the current and anticipated future uses of the surrounding area. CARRIED Resolution #96/72 MOVED by Councillor D. Kitchen, seconded by Councillor K. Matheson, that this Council does hereby endorse the recommendation of the Planning Board of March 9th, 1972 that application A l4/72 part lots II and 12, Concession 4 to specifically amend the zoning to allow the operation of a chinchilla ranch be APPROVED subject to site plan control regarding size of operation and level of sanitation prior to the issuance of any building permit, and same is hereby recommended to the Minister of Municipal Affairs for approval. CARRIED - 5 - 8/72 Resolution 197/72 MOVED by Deputy Reeve G. Ashe, seconded by Councillor D. Kitchen, that the Council of the Township of Pickering endorse the resolution of the City of Oshawa, as follows: "Whereas the licence fees remitted by the Liquor Control Board of Ontario to municipalities are well below municipal police costs incurred in overseeing the Liquor Control Board of Ontario Act~ and "Whereas the financial arrangements of 20% of the licence fees remitted by the Board to municipalities were negotiated a number of years ago; "Now therefore be it resolved that the municipalities petition the Liquor Control Board of Ontario with respect to renegotiating the financial arrangements of 20\ of the licence fees remitted by the Board to municipalities in order to adequately cover police costs which have substantially risen since the time the original financial agreement with the Liquor Control Baord of Ontario took place. "That this resolution be submitted to the Minister in charge of the Liquor Control Board and also to the Association of Municipalities of Ontario, the Canadian Federation of Mayors and Municipalities and other municipalities in Ontario for endorsation.\i CARRIED Resolution '98/72 MOVED by Councillor Mrs. J. L. McPherson, seconded by Deputy Reeve G. Ashe, that the Council of the Township of Pickering endorse the resolution of the City of Oshawa, as follows: "Whereas the number of motor vehicles utilizing parking areas made available to the public at large on private property increases daily; nAND WHEREAS signs and markings, when used, are inconsistent, having no uniformity with standard highway signs and markings; "AND WHEREAS such lack of, or inconsistency of signs and markings leads to confusion for the motorist; "AND WHEREAS the municipal police have no jurisdiction over the said areas, other than cases coming under the Criminal Code~ "NOW THEREFORE BE IT RESOLVED that the Province of Ontario be petitioned to enact legislation to regulate the move- ment of traffic by prescribing uniform traffic control signs and markings and rules of the road to apply within parking areas made available to the public at large on private property; "AND FURTHER, that the Province of Ontario be petitioned to amend the existing legislation to require the investi~ation and reporting of all accidents occurring within parking areas made available to the public at large on private property in the same manner that is required for accidents occurring on public highways, as outlined in Sections 139 and 140 of the revised Highway Traffic Act; ..........Continued - 6 - 8/72 Resolution *98/72 - Continued \lAND FURTHER, that c.opies of this resolution be forwarded to the Prime Minister of Ontario, the Minister of Transportation and Communications of Ontario, the Association of Municipalities of Ontario, the Ontario Traffic Conference and all urban municipalities of lS,OOO population or greater, seeking endorsation and support. Ashe, that the Council of the Township of Pickering endorse the resolution of the City of Oshawa, as follows: "WHEREAS in the vicinity of many schools, students make a practice of walking several abreast on the roadway rather than on the sidewalks or footpaths provided for that purpose, "AND WHEREAS.this practice is increasing, "AND WHEREAS such practice presents a hazard to both the motorist and pedestrian and creates an obstruction to vehicular traffic, nAND WHEREAS present legislation does not allow a municipality to pass a by-law making the use of sidewalks mandatory by pedestrians, "THEREFORE BE IT RESOLVED that the province of Ontario be petitioned to amend the existing legislation regarding the duties of pedestrians as presently contained in the Highway Traffic Act, to require the mandatory use of sidewalks, where provided by all pedestrians when walking along a highway. "AND FURTHER that copies of this resolution be forwarded to the Prime Minister of Ontario, the Minister of Transportation and Communications of Ontario, the Association of Municipalities of Ontario, the Ontario Traffic Conference and all urban municipalities of IS,OOO population or greater, seeking endorsation and support." Matheson, that the Kinsmen Club of Bay Ridges Inc. be permitted to conduct a blitz sale of Kin Gro Fertilizer in the Township of Pickering on Saturday, April 8,1972; proceeds to be used for Kinsmen service projects in the local area such as baseball, hockey, Christmas hampers to needy families, Santa Claus parade and Cystic Fibrosis Research at the Hospital for Sick Children. Kitchen, that the Council of the Township of Pickering accept the Offer of Purchase and Sale for 1 acre of Pickering Township industrial land at a price of $10,000.00, and further, that Edwards & Gunn be authorized to prepare the necessary survey and register same, and that the Township Solicitor, J. A. Taylor, be instructed to prepare the necessary deed of land and transfer of same, as recommended by the Standing Committee of the Whole Council in Closed Session, March 13,1972. CARRIED - 8 - 8/72 Resolution #105/72 MOVED by Councillor D. Quick, seconded by Councillor K. Matheson, that the Council of the Township of Pickering accept the Agreement of purchase and sale for one and one-half acre of land, more or less, of Pickering Township's industrial land at $13,000.00 per acre as submitted by Remis Garage Limited, subject to the agreement being closed~ with cash payment in full being made on May 15th, 1972, and further, that a plan of survey be prepared by Edwards & Gunn and transfer of lands be negotiated by the Township Solicitor, James A. Taylor, Q. C., as recommended by the Standing Committee of the Whole Council, in Closed Session, March 13, 1972. CARRIED Resolution #l06/72 MOVED by Councillor D. Quick, seconded by Councillor D. Kitchen, that whereas the Kiwanis Club of Dunbarton, Inc. is conducting a Littercheck Campaign in the Township of Pickering; AND WHEREAS the Council of the Township of Pickering have been requested to participate in this campaign and to encourage the resident property owners of the Township to become aware of their responsibilities and to assist them to stop littering and stop others littering. BE IT THEREFORE RESOLVED that the Council of the Township of Pickering endorse the Littercheck Campaign by: 1. Declaring April 1st, 1972, as the opening day for the Littercheck program. 2. Place l2'¡ x 12" decals on all Township vehicles where possible (supplied by the Kiwanis Club). The Township of Pickering arrange for the frequent emptying of litter bins placed throughout the Township's garbage area. 3. 4. The Township of Pickering declare a clean-up week in the month of May, and further, provide special pick-ups throughout the Township for this period. Provide assistance with publicity program through press, radio and T.V. s. CARRIED - 9 - 8/72 Resolution #107/72 MOVED by Councillor D. Quick, seconded by Councillor K. Matheson, that whereas in a letter of March 16, 1972, the Department of Social and Family Services have made certain recommendations with respect to the construction of the Day Care Centre on Liverpool Road; AND WHEREAS this has necessitated the resubmission of tenders to include the exclusion of the liquidation, damage-bonus clause on the tenders submitted by The Bonner Development Company Limited and Gar-Jon Construction Limited~ BE IT THEREFORE RESOLVED THAT the Deputy Clerk, the Treasurer, and the Architect be authorized to open the said tenders, and subject to the Architect's approval, the contract awarded to the lowest bidder, and that the approval of the Department of Social and Family Services be obtained, to enter into a contract for the construction of the Day Care Centre~ AND FURTHER that the Deputy Reeve and the Deputy Clerk be authorized to sign a Letter of Intent addressed to the lowest bidder in order that no further delay be experienced in the construction of the Day Care Centre; AND THAT Resolution #90/72 be and the same is hereby rescinded. Quick, that this Council does hereby endorse the recommendation of the Pickering Township Planning Board of March 9th, 1972, that subject to possible minor boundary changes which may be recommended by Metropolitan Toronto as a result of the objections received to By-law 4096/71 to permit the operation of Sanitary Land Fill by Metro Toronto, the remaining objections be considered not valid. Matheson, that the Council of the Township of Pickering endorse the resolution of the City of Oshawa, as follows: WHEREAS the number of persons soliciting rides on highways within a city, town, village or built up area is increasing, fu~D WHEREAS such practice presents an inconvenience and potential hazard to motorists and pedestrians, AND WHEREAS present legislation only prohibits the soliciting of rides while on the travelled portion of the highway, THEREFORE BE IT RESOLVED that the Province of Ontario be petitioned to amend the Highway Traffic Act to prohibit the solicitation of rides within the boundaries of a city, town, village or built up area, fu~D FURTHER that copies of this resolution be forwarded to the Prime Minister of Ontario, the Minister of Transportation and Communications of Ontario, the Ontario Traffic ..........Continued - 10 - 8/72 Conference and all urban municipalities of 15,000 population or greater, seeking endorsation and support.
