Williams Deputy Reeve G. Ashe Councillors - V. Rudik Mrs. J. L. McPherson D. Kitchen J. Kruger (R. Chatten - Absent - Illness) Clerk D. J. PIitz Prior to proceeding with the business at band, Reeve Williams advised Council of the passing of Mr. George Todd, a former Councillor and Reeve of the Township of Pickering. Reeve Williams asked for a minute of silence in respect. Reeve Williams and Councillor V. Rudik on behalf of Council extended condolences to the Todd Family. ....' The Reeve and members of Council each took the opportunity of this first meeting of the New Year (1971) to speak on the past year's business and accomplishments of Council and what they will endeavour to accomplish in the coming year. Councillor J. Kruger advised Council of his decision to resign from Council effective as of January 22,1971, to take on the position of Executive Assistant to the Chairman ot the Municipality of Metropolitan Toronto. Members of Council expressed their surprise and regrets at Mr. Kruger's decision. Mr. Kruger indicated that Council could appoint a person to replace him to complete his term of oftice, offering the names of three prospects. Council accepted the suggestion of Mr. Kruger, however, they referred the matter to a future meeting of Committee of the. Whole Council to resolve this problem. ADOPTION OF MINUT~ Moved by Councillor Mrs. J. L. McPherson, seconded by Deputy Reeve George Ashe that the minutes of Council held on December 8th and 14th respectively be adopted as presented. CARRIED Councillor Kruger made reference to two items on the minutes ot,December 8, 1970, (1) (2) Snow removal trom Township sidewalks The Krosno Blvd. watercourse requesting that these be reterred to the respective committees tor a tinal decision and recommendation to Council. MOTION 2. - 2 - 1/71 IV DELEGATIONS l. Moved by Councillor Rudik, seconded by Councillor Mrs. J.Lw' McPherson that Mr. John Gilbert, Solicitor tor Mr. R. Mastrange~ be heard. / Mr. Gilbert appealed Mr. Mastrangelo's case betore Council dealing with an accessory building which has been con- structed on his client's property (lO acres) located in Part Township Lot 27, Concession 7, without first obtaining a building permit. He explained that the purpose ot the building was to store implements and tools used in the growing of fruit and vegetables for family needs. The building is intended for storage and not for living accommodations; however it is intended when funds are available that a house would be constructed on this land, probably within three years time. Mr. Gilbert explained that this land was purchased in' September of 1963 prior to the amendment to the zoning regulations when the 500 foot frontage became a requirement. The Council agreed that there was a violation of the Municipal by-laws in respect to the erection of this build- ing without a permit however under the circumstances it was felt that before any decision of Council is made, the matter should be returned to the by-law committee for a recommendation. Moved by Councillor Rudik, seconded by Councillor Kruger, that the problem of Mastrangelo relative to a building permit be referred to the Committee on By-law and that a full report be supplied by the By-law and Planning and Building Departments. CARRIED Snowmobile Bv-Law Moved by Deputy Reeve G~ Ashe, seconded by Councillor Mrs. J. L. McPherson, that ~œ. N. Waller be heard. Mr. Waller, representing the snowmobilers of two organized clubs, the Pickering Snow Rovers and the Dunbarton Snow Drifters, reviewed with Council the draft by-law prepared to regulate and govern the use of motorized snow vehicles within the Township. Mr. Waller was of the opinion that a by-law was needed; however he was of the opinion that Clause 5 was too restrictive, understanding that snowmobiles could not be operated anywhere south of the MacDonald Cartier Freeway. After explanation by Council that this was not being interpreted correctly, he was satisfied with the explanation that this applied only to roads under Township jurisdiction and not to open private lands south of 401. It was suggested by Councillor Kruger that perhaps other areas north of 401 should be restricted from the operation of snowmobiles, suggesting such areas as ~hitevale, Claremont, Brougham, Greenwood, Green River, Cherrywood and the East Woodlands, Rosebank Road North areas. The snowmobilers objected to this stating that this was too restrictive. Council were of the opinion that this should be considered at a later date for inclusion in the by-law, but for the' present pass the by-law as presented. - 3 - 1/71 Mr. Waller also objected to the curfew indicating 10 p.m. was too early, suggesting that II p.m. Sunday through to Thursday with the hour of 1:30 o'clock established for Friday and Saturdays. There were objectors in the spectators who felt the hours of operation should be left as written in the by-law. However, certain members of Council felt that a change in the hours of permitted use should be reviewed suggesting the hours of 12:30 a.m. to g a.m. in the rural areas and 10 p.m. to g a.m. in the urban areas. This, again, was objected to by the snowmobilers on the grounds that there should be one set of rules applicable to the Township as a whole. A number of objections were raised by non-snowmobile owners, particularly in reference to noise factor, driving habits, and hours of operation, all of which led to noisy re~ction from the two represented groups. Under the circumstances, Council was not able to continue with the normal functions of Council business, resulting in the Reeve requesting clearance of the hall. With Councillor D. Kitchen in the Chair, the Council pro- ceeded to give the regulation by-law for snowmobiles three readings. The Council recommended that this by-law be referred to the by-law Committee to further consider the inclusion of the Hamlets as restricted areas and possibly also further consider the change of hours in which the machines can be operated. 1. 2. 3. 4. ORRESPONDENCE The Metropolitan Toronto and Region Conservation Authority forwards copy of their report on the Pickering Township Museum in Brougham, re their assistance in development and operation of same. Copies to Council. Instruction§ - Arrange to have the Chairman of the Museum Board appear before Council in Committee of the Whole to discuss the M.T.R.C.A. report. Mr. Alfred Croxford brings to Council's attention the use of snowmobiles in the Pickering Beach area. Mr. P. W. Clendinneng, Annland Street, Bay Ridges, forwards petition re conservation and the Marsh and Greenbelt surrounding the Pickering Nuclear Station. Copies to Council. Donald F. Webb, Oshawa Aquatic Club Diving Coach, submits request for assistance re the training of Beverley Boys and Nancy Robertson of Pickering, now training in Winnipeg. Copies to Council. Cobden, Secretary-Treasurer, Pickering Environ- mental Advisory Committee, advises that members of this committee express grave concern over the proposed road development in the Rouge River - Bay Ridges areas. In their opinion, the proposed roads would have a bad effect on the environment in these areas. Copies to Council. W. R. Kellough & Associates forward copy of a report re the Township of Pickering 1970 Equalization, advising that Messrs. Weir and Foulds will contact the Township on this. Copies to Council. Referred to the Committee of the Whole Council. Mr. H. L. Fair, Agricultural Representative, Ontario County, and Secretary-Treasurer, Ontario County Soil and Crop Improvement Association requests a grant from the Township for the year 1971, and express appreciation of grants made in past years. The Ontario Government, Minister of Justice and Attorney General issues a Press Release regarding the New Land Compensation Board, to start operations December 1st, assuming responsibility for setting compensation in expropriation cases across Ontario. Mr. A. N. MacKay, Director, Assessment Standards Branch, Department of Municipal Affairs, advises they have submitted to the Ontario Municipal Board all the documentation to support their requests for a review of the Equalized Assessment and Equalization Factor for the Township of Pickering and for a number of other townships. It is his understanding that revised calculations will be distributed early in the new year. Copies to Council. Mr. E. A. Starr, Director, Department of Agriculture and Food, advises that a grant in the amount of $20,000.00 has been approved for payment re the Donald Beer Sports Arena and Community Hall. Mr. Poul H. Poulsson, P. Eng., Township Engineer, submits report on Trench Inspections carried out in the year 1970. The Ontario Hydro forwards carbon copy of a letter sent to the Department of Transport requesting a meeting with respect to T.V. Interference - Sandy Beach Road - Township of Pickering. Copies to Council. Instructions - Clerk to advise that Reeve Williams and Councillor Kitchen will be attending this meeting. The method of financing the Sewer Plant in accordance to a 40:60 ratio has been referred back to Council by the Road Committee. Ontario Water Resources Committeè approval has been received. Council to decide method of financing and obtain Ontario Municipal Board approval on 1970 expenditures. .. 5 - 1/71 RESOLUTIONS Resolution #1/71 MOVED by Deputy Reeve G. Ashe, seconded by Councillor J. Kruger, that the olympic size indoor swimming pool be constructed on the Woodlands Centennial and Dunbarton High School site and that the exact location be determined by the Architect subject to the Board of Education approval and further that a Committee of Council, Reeve Williams and Deputy Reeve Ashe meet with a Committee of the Board of Education whose main purpose will be to meet with the Ontario Municipal Board to arrange the best means of financing this project and also arrange for its construction, as recommended by the Standing Committee of the Whole Council, December 14, 1970. Kruger that Council concur with the recommendation of the Planning Board's report relative to the Teen Centre project, as recommended by the Standing Committee of the Whole Council, December 14,1970. Rudik, that the lands on the south-east corner of Brock Road and Bayly Streets being surplus to the Brock Road allowance be offered to the purchaser of the Township land at this corner for the same price per acre previously negotiated, subject to the necessary road closings, utility easements and surveys, as recommended by the Standing Committee on Roads, December 16, 1970. McPhers:> n, that the Township Engineer be requested to advise the County Engineer that the steep approach to the Bayly-Liverpool Inter- section from the West creates serious problems during snow and ice conditions if not properly controlled by sand and salt and that the County Engineer be requested to give priority to this location in his Winter Control Programme, as recommended by the Standing Committee on Roads, December 16, 1970. Rudik, that an item of ~45,000.00 be included in the 1971 Road Programme to provide a storm sewer on Oklahoma Drive together with repairs and repaving of the existing surface, and include the sum of $12,000.00 to construct a permanent sidewalk on East Avenue between the William G. Rudik, that the Township Engineer be authorized to commence the Finch Avenue engineering designs required to reconstruct Finch Avenue between Dixie and White's Road to County standards and investigate the financing of debenturing this road work, as recommended by the Standing Committee on Roads, December 16,1970. Rudik, that the Road Equipment Reserve Fund be established and maintained for purchase of Road Equipment only and that yearly surpluses be accumulated to provide for the years of heavy eq¡ipment purchases in accordance with the Ten Year Road Programming Study and that the Treasurer be advised of Council's intent, as recommended by the Standing Committee on Roads, December 16, 1970.
