(II) RESOLUTIONS REPORT OF THE EXECUTIVE COMMITTEE OF AUGUST 8th 1977 See Appendix I Resolution 163/77 Moved by Councillor Matheson, seconded by Councillor Robertson that the recommendations contained in the Executive Committee Report of August 8th 1977, Items #1, #4, #5, #7 - #13 and #15 - #19, be adopted. CARRIED Resolution 164/77 - Item #2 Moved by Councillor Matheson, seconded by Councillor Robertson that the recommendation contained in the Executive Committee Report of August 8th 1977, Item #2, be adopted. AMENDMENT Moved by Councillor Robertson, seconded by Councillor Fisher that the Council of the Town of Pickering recommend to the Region of Durham that the Model Parking By-law be amended to read: "No Parking: 12 Midnight to 7:00 p.m. and a three hour maximum; Parking: 7:00 p.m. to 12 Midnight." CARRIED Resolution 169/77 Moved by Councillor Cahill, seconded by Councillor Ma the son tha t : 1) By-law 625/77 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 6th day of June 1977; 2) No further Official Plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 625/77 and which said By-law would not be in conformity, including the District Plan of the Town of Pickering District Planning Area, Region of Durham which was adopted by Council February 17th 1975 and recommended to the Region of Durham for approval. CARRIED - 117 - 21/77 (II) RESOLUTIONS (Con!i~uedl Resolution 170/77 Moved by Councillor Matheson, seconded by Councillor Robertson that: 1) By-law 652/77 is in conformity with the Official Plan of the Town of Pickering approved and in force at the time said By-law was passed, namely the 4th day of July 1977; 2) No further Official Plan has been proposed by Council nor approved by the Ministry of Housing since the passing of said By-law 652/77 and which said By-law would not be in conformity including the District Plan of the Town of Pickering District Planning Area, Region of Durham which was adopted by Council Febrùary 17th 1975 and recommended to the Region of Durham for approval; 3) That the objections received objecting to this By-law be considered invalid; 4) And further, that the objections be forwarded to the Ontario Municipal Board. CARRIED Resolution 171/77 Moved by Councillor Fisher, seconded by Councillor Matheson that the tender of Harnden & King Construction Limited in the amount of $2,225.80 for Asphalt Sidewalk- Altona Road, be accepted. CARRIED Resolution 172/77 Moved by Councillor Kitchen, seconded by Councillor Cahill that the tender of Bennett Paving & Materials Limited be accepted in the amount of $29,922.50 for Hot Laid Asphalt, subject to the approval of the Ministry of Transportation and Communications. CARRIED Resolution 173/77 Moved by Councillor Kitchen, seconded by Councillor Robertson that the tender of Warden Construction Company Limited be accepted in the amount of $18,866.50 for the installation of Storm Sewers on Fairport Road, subject to the approval of the Ministry of Transportation and Communications. CARRIED Resolution 174/77 Moved by Councillor Kitchen, seconded by Councillor Matheson that the tender of Seal Top Paving & Construc- tion Limited be accepted in the amount of $14,934.30 for road improvements on Liverpool Road, subject to the approval of the Ministry of Transportation and Communications CARRIED - 118 - 21/77 (III) BY-LAWS Councillor Matheson, seconded by Councillor Robertson moved for leave to introduce By-laws of the Town of Pickering: By-Law Number 685/77 To amend By-law Number 266/75 limiting the number of automobile service stations and public garages. By-Law Number 686/77 To authorize the execution of a Licence Agreement between the Corporation of the Town of Pickering and Lorne Davis with respect to the leasing of Parts 3 and 9, Reference Plan 40R-2638. By-Law Number 687/77 To authorize the execution of an Agreement between the Corporation of the Town of Pickering and Parcival Developments Limited with respect to Lot 116, Plan 350, Town of Pickering (LD 305/76) THIRD READING Councillor Matheson, seconded by Councillor Robertson moved that the report of the Committee of the Whole on By-law Numbers 685/77 to 687/77 inclusive, be adopted, and that the said By-laws be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and that the Seal of the Corporation be affixed. thereto. By-Law Number 688L77 - Two Readings Only Councillor Mathêson,'seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Working Rights Agreement between the Corporation of the Town of Pickering and The Ministry of the Environment and Ontario Hydro with respect to Part Lot 20, Broken Front Concession, Range 3. and that same now be read a first and second time, and that the Council go into Committee of the Whole thereon. CARRIED MOTION Moved by Councillor Kitchen, seconded by Councillor Robertson that By-law Number 688/77 be tabled after Second Reading. CARRIED - 119 - 21/77 (III) BY-LAWS (Continued) By-Law Number 689L12 Councillor Kitchen, seconded by Councillor Robertson moved for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Demolition Agreement between the Corporation of the Town of Pickering and Theodorus Jan Hendrik Vermeulen and Martini Vermeulen with respect to Part Lot 76, Plan 816, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (IV) OTHER BUSINESS 1. Tender of Bennett Paving & Materials Limited - Hot Laid Asphalt, confer Resolution #172/77 2. Tender of Warden Construction Company Limited - Installation of Storm Sewers, confer Resolution #173/77. 3. Tender of Seal Top Paving & Construction Limited - for Road Improvements on Liverpool Road, confer Resolution #174/77. 4. Demolition Agreement Between the Town of Pickering and Mr. & Mrs. T.J.H. Vermeulen, confer By-law Number 689/77. 5. Mayor Anderson opened the Council Meeting by announcing the accidental death of Mr. Don Quick who had been a Trustee of the Board of Education from 1970 - 1971 and a Councillor of the former Township of Pickering from 1972 - 1973. (V) CONFIRMATION BY-LAW -- By-Law Number 690/77 Councillor Robertson, seconded by Councillor Fisher moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 15th day of August 1977, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. REGION OF DURHAM - MODEL PARKING BY-LAW -----,- ----- That the Town Solicitor's report dated July 5th 1977 with respect to the Regional Model Parking By-law be forwarded to the Region of Durham for their consideration; That the Town of Pickering not adopt a universal three- hour parking restriction on roads under the jurisdiction of the Municipality; That the Town of Pickering indicate to the Region of Durham its interest in adopting a similar parking by- law subject to the amendments suggested by the Town Solicitor in his report of July 5th 1977. TOWN OF COBALT - FINANCIAL ASSISTANCE That the amount of $250.00 be forwarded to the Town of Cobalt Disaster Fund, with the funds charged to General Ledger Account 2195. ZONING BY-LAW 1609/77 LOOKOUT POINT SOUTH SUBDIVISION . That the report of the Town Solicitor dated July 13th 1977 with respect to By-law 609/77 (Lookout Point Subdivision) be received and that the Municipality not request the Ontario Municipal Board to dispense with a Hearing in this matter as envisaged under Section 35 of the Planning Act, Subsection 14. 5. STATEMENT OF FINANCIAL POSITION - - ---.- That the report of the Treasurer-Collector dated July 11th 1977 with respect to the financial position of the Municipality as of June 30th 1977 be received for information. 6. REGION OF DURHAM - PARKING POLICY - - -,-- That the Region of Durham be advised of the Town's endorsement of the proposed Regional Parking Policy. BROCK TERTIARY PLAN - ORANGEBROOK DEVELOPMENTS --- - That the letter of Derek Willis and Associates Limited dated July 20th 1977 with respect to the Brock Tertiary Plan and submitted on behalf of their clients Orangebrook Developments be received and held pending a possible Hearing before the Ontario Municipal Board once the Plan is submitted to the Board for approval. LIBRARIES - REVISED 1977 BUDGET That the report of the Treasurer-Collector dated July 22nd 1977 with respect to the 1977 Library Budget be adopted and that Council approve the revised 1977 Library Budget dated June 2nd 1977, which authorizes the initial transfer to the Reserve for Replacement of Books. 1977 EQUALIZED ASSESSMENT REPORT FOR THE REGIONAL MUNICIPALITY OF DURHAM - TOWN OF PICKERING ----'--' .--.-- That the report of the Treasurer-Collector dated July 19th 1977, with respect to the 1977 Equalized Assess- ment Report be received for information. FENCE - 712 KINGFISHER DRIVE -- -'-,--- That the report of the Administrator-Clerk dated July 29th 1977, with respect to the construction of a fence between Town-owned property and 712 King- fisher Drive be approved. WALKWAY - BALATON AVENUE - ANNLAND STREET ---- That the Director of Public Works be authorized to proceed with the improvements to the Balaton Avenue - Ann1and Street walkway envisaged in his report of July 13th 1977 to the Administrator-Clerk, with the cost to be charged as an unbudgeted 1977 expenditure to Account # 2132-6181. ALUMINUM WIRING -_-,- That the report of the Administrator-Clerk dated July 29th 1977 and the Director of Public Works dated July 25th 1977, with respect to aluminum wiring be received for information and that the subject be reconsidered by Council following the publication of the conclusions of the Province of Ontario Commission of Enquiry on aluminum wiring. 15. ONTARIO HOUSING CORPORATION --'.-- That the Town of Pickering advise the Ontario Housing Corporation of its approval of the establishment of an area-wide Housing Authority, exclusive of the City of Oshawa, to administer Ontario Housing Corporation units within the Region of Durham. SUBDIVISIONS - SIMON HENRY KAPTYN ESTATES - AMENDED STORM DRAINAGE PROPOSALS ----- That the Director of Public Works be authorized to negotiate with the Simon Henry Kaptyn Group concerning the storm drainage system for their property on Plan M-1040 in the Industrial Area and that a report be forwarded to Council outlining the preferred alternative. PICKERING HOCKEY ASSOCIATION - PROPOSED TOURNAMENT That the report of the Director of Recreation dated August 3rd 1977 be adopted and that the Pickering Hockey Association be permitted to utilize the Public Skating hours scheduled for the Don Beer Sports Arena on February 3rd and 5th 1978, as outlined in their request on June 27th 1977. ACCOUNTS FOR APPROVAL That the Accounts dated July 31st 1977 in th amount of $1,607,249.59, as submitted by the Administrator- Clerk, be approved. APPENDIX II REPORT OF THE EXECUTIVE COMMITTEE MEETING OF AUGUST 15th 1977 1. DELEGATION - LOT SEVERANCE - BURNS LOT 13, PLAN 353 That Mr. & Mrs. Neil Burns be informed that the Town of Pickering is not prepared to deviate from its policy with respect to lots created by the Land Severance Committee and that if they wish to finalize the decision of the Land Severance Committee with respect to their property in Plan 353, Lot 13, that they will be obliged to do the following: 1. Pay the reduced Land Severance fee of $2,500.00 to the Town of Pickering. 2. Provide evidence to the Town that they have come to a såtisfactory financial arrangement with The Bramalea Group with respect to connecting into services provided by that Company. 3. Assume the cost of the necessary Reference Plan to define the one foot strip of land adjacent to their property owned by the Town of Pickering. 2. LEASING OF INDUSTRIAL LANDS That a By-law be passed authorizing the Mayor and Clerk to execute a Licence Agreement between the Town of Pickering and Lorne Davis on lands more particularly described under Reference Plan 40R-2638 as Part 3 and Part 9. 3. ALLOCATION OF SEWAGE CAPACITY - INDUSTRIAL LANDS That the Town Manager be directed to inform the Region of Durham that the Town of Pickering's position with respect to the allocation of sewage capacity within the Industrial Area as expressed in their Resolution # 167/76, Item 7, dated November 1st 1976 remains flexible and that in particular the Municipality would be prepared to re-a110cate the capacity should other developers, such as the Captain Group, come forward with specific development plans " capable of immediate implementation. 4. SITE PLAN AGREEMENT - PARCIVAL DEVELOPMENTS LIMITED . That a By-law be prepared authorizing the Mayor and Clerk to execute a Site Plan Agreement between the Town of Pickering and parcival Developments Limited with respect to Lot 116, Plan 350. 5. COMMEMORATION MEDALS That the Council Members advise the Town Manager, prior to August 19th 1977, of those citizens they feel worthy of receiving the commemorative medal being issued by the Secretary of State of Canada in honour of the 25th Anniversary of the accession of Her Majesty the Queen to the Throne, together with the reasons why they feel such an award should be made and that a final list for submission to the Office of the Premier be prepared for the approval of Council prior to August 23rd 1977. . . 6. - 2 - APPENDIX II ELVIN CONSTRUCTION LIMITED - DRAFT PLAN OF SUBDIVISION ROSEBANK ROAD SOUTH That the Town Solicitor be directed to withdraw the Town's appeal to the Ontario Municipal Board against the Land Division Committee decisions affecting LD 254/76 and LD 256/76 on the express understanding that the development of these two lots will be subject to a Development Agreement with the Municipality and, conditional upon Mr. Elvin entering into a further agreement acknowledging that the development of the surplus lands will not take place without benefit of a Registered Plan of Subdivision.
