Whereas, pursuant to the provisions of the Planning
Act, the Treasurer of Ontario and Minister of Economics
and Intergovernmental Affairs enacted an Order, dated
March 3rd 1972, as Ontario Regulation 102/72;
And whereas pursuant to the provisions of that Act,
the Minister of Housing enacted a further Order,
dated January 10th 1974, as Ontario Regulation 19/74;
And whereas, pursuant to the provisions of those Orders,
the Minister of Housing presently exercises certain
zoning and subdivision controls over certain lands
wi thin the boundaries of the Townof Pickering;
And whereas the Council of the Corporation of the
Township (now Town) of Pickering enacted a By-law,
being By-law 3037, which, but for the above-mentioned
Orders, imposes certain zoning and subdivision controls,
pursuant to the provisions of The Planning Act, over
the same lands;
And whereas the standards in the Order and the standards
in the By-law differ in certain respects to such an
extent that the desirable orderly development of the
lands is currently effected and threatened thereby;
Now therefore be it resolved that:
1.
The Minister of Housing of the Province of Ontario
be requested to amend Ontario Regulation 102/72 as
follows:
a)
by deleting from section 5 thereof the following:
Minimum ground
floor area
one storey - 1000 square feet
one and one half storeys
or more 750 square feet
b)
by deleting from section 6 thereof the following:
Minimum front yard
Minimum side yard
25 feet
10 feet on one side and
4 feet on the other side
25 feet
Minimum rear yard
and by substituting therefor the following:
Minimum front yard
Minimum side yard
Minimum rear yard
40 feet
10 feet
40 feet
c)
by deleting from clause 1 of section 6A the
phrase "and shall not be less than three feet
from any lot line".

The said Minister be requested to amend Ontario
Regulation 19/74 as follows:

a)
by deleting from section 5 thereof the following:

by deleting from section 6 thereof the following:

by deleting clauses 1,2 and 3 of section 7 thereof
and substituting the following therefor:

All accessory buildings that are not part
of the main building shall be erected in
the rear yard.
2.
No accessory building or structure, except
a garage shall be closer than fifty feet
to any single-family dwelling on the lot.
3.
No accessory building or structure shall
be less than ten feet from any lot line.

By-Law Number 672/77 - Third Readins
The Committee of the Whole arises and reports the
By-law as read.

Councillor Cahill, seconded by Councillor Matheson
moved that the report of the Committee of the Whole
on By-law Number 672/77 to authorize the execution
of an Agreement between the Corporation of the Town
of Pickering and the Pickering Panthers Junior Hockey,
Inc., with respect to the rental of the Don Beer Sports
Arena, and moved that the said By-law be now read a
Third Time and PASSED, that the Mayor and Clerk sign
the same, and the Seal of the Corporation be affixed
thereto.

passed.

moved for leave to introduce By-lawsof the Town of

To authorize the execution of a Site Plan Agreement
between the Corporation of the Town of Pickering and
Shell Canada Limited with respect to Part of Lot 22,
Range 3, Broken Front Concession, Town of Pickering.

To authorize the execution of a Site Plan Agreement
between the Corporation of the Town of Pickering and
Patrick John McCarthy and Murray Gallagher with respect
to Part Lot 19, Range 3, Broken Front Concession,
Town of Pickering (P CA 4/77)
By-Law Number 676/77
To authorize the execution of a Demolition Agreement
between the Corporation of the Town of Pickering and
Nick Rohwer Construction Limited with respect to the
removal of a foundation from those lands included in
Plan 40R-3532.
By-Law Number 677/77
To authorize the execution of a Lot Grading Agreement
between the Corporation of the Town of Pickering
and Robert Fleming Allan Birrell and Glenda Birrell
with respect to Part Lot 35, P~an 350 (LD 324/76)

To authorize the execution of an Agreement between
the Corporation of the Town of Pickering and Proctor
&~ern Limited with respect to the Liverpool Community
Secondary Plan.

By-Law Number 679/77
To repeal part of By-laws 4166/72 and 4205/72,
amending Restricted Area By-law 3036.
By-Law Number 680/77
To authorize the execution of Easement Agreements
with the Director, the Veterans' Land Act, and with
John Richard Wilson and Edith Diana Wilson, respecting
a drainage easement on Lots 103 and 104, respectively,
Plan 1051 (Parts 1 and 2, Plan 40R-3755).
The Committee of the Whole arises and reports the
By-laws as read.
THIRD READING
Councillor Robertson, seconded by Councillor Fisher
moved that the report of the Committee of the Whole
on By-law Numbers 674/77 to 680/77 inclusive, be
adopted, and that the said By-laws be now read a
Third Time and PASSED, that the Mayor and Clerk
sign the same, and that the Seal of the Corporation
be affixed thereto.
CARRIED
By-Laws read a first, second and third time and finally
passed.

Council directed that no building permit
be issued for the contemplated changes until the
actual site plan had been approved by either the
Executive Committee or the Planning Committee.

moved for leave to introduce a By-law of the Town of
Pickering to repeal part of By-laws 3179/67
, - amending Restricted Area By-law 2511, and that
same be now read a first, second and third time and
that the same be now finally passed and that the Mayor
and Clerk sign the same and that the Seal of the
Corporation be thereto affixed.

Pickering to define and determine the duties and
responsibilities of the Town Manager, and that same
be now read a first, second and third time and that
the same be now finally passed and that the Mayor
and Clerk sign the same and that the Seal of the
Corporation be thereto affixed.

OTHER BUSINESS

Fire Inspection - Rosebank Nursing Home
Councillor Cahill inquired as to the status of the
outstanding items to be completed as a result of the
inspection carried out on the Rosebank Nursing Home
by the Fire Department. A further report is to be
submitted.
2.
Newsletter
It was suggested that the Recreation Department should
include in the next Newsletter an item indicating the
nights that Council and Executive Committee meet.

By-Law Number 684/72
Councillor Kitchen, seconded by Councillor Fisher
moved for leave to introduce a By-law of the Town
of Pickering to confirm the proceedings of the Council
of the Corporation of the Town of Pickering at its
meeting held on the 8th day of August 1977, and that
same be now read a first, second and third time and
that the same be now finally passed and that the
Mayor and Clerk sign the same and that the Seal of
the Corporation be thereto affixed.
