SPECIAL COUNCIL MEETING
A special meeting of Pickering Town Council
was held on MONDAY, JUNE 20th 1977 at 8:30 P.M.

RESOLUTIONS
Resolution 115/77
Moved by Councillor Matheson, seconded by Councillor
Robertson that whereas section 42 of The Municipal
Act, R.S.O. 1970, C.284, as amended, requires that
where the seat of a member of a Council becomes
vacant under section 38, the Council shall forth-
with declare the seat to be vacant;
AND WHEREAS the seat of Mayor became vacant by
virtue of his resignation made pursuant to subsection
(e) of section 38 of the said Act the said Council
hereby declares the seat of Mayor to be vacant.
CARRIED
Appointment to the P2§ition of Mayor
Councillor Anderson indicated his conflict of
interest in this item and did not vote.
Resolution 116/77
Moved by Councillor Matheson, seconded by Councillor
Robertson that whereas Section 44, Subsection 1,
Chapter 284, R.S.O. 1970 ènvisages a Council appointing
a successor to the head of Council where a vacancy
in this position exists; and
WHEREAS the Mayor has submitted his resignation,
effective June 21st 1977;
BE IT THEREFORE RESOLVED that Councillor John Anderson
be apponted to the position of Mayor for the Town
of Pickering for the balance of the current Council
term.

Resolution 117/77
Moved by Councillor Cahill, seconded by Councillor
Matheson whereas section 42 of The Municipal Act,
R.S.O. 1970, C.284, as amended, requires that where
the seat of a member of a council becomes vacant

the seat to be vacant;
AND WHEREAS the seat of John Anderson became vacant
by virtue of his resignation made pursuant to subsection
(e) of section 38 of the said Act the said Council
hereby declares the seat of Regional Councillor to
be vacant.

Councillor Fisher did not participate in the
discussion or the vote.
Resolution 118/77
Moved by Councillor Cahill, seconded by Councillor
Matheson that whereas Section 44, Subsection 1,
Chapter 284, R.S.O. 1970, envisages a Council
appointing a successor to the head of Council
where a vacancy in this position exists; and
WHEREAS Regional Councillor John Anderson has been
appointed to the position of Mayor;
BE IT THEREFORE RESOLVED that Gerry Fisher be
appointed to the position of Regional Councillor
for the Town of Pickering for the balance of the
current Council term.

Resolution 119/77
Moved by Councillor Robertson, seconded by Councillor
Cahill that whereas section 42 of The Municipal Act,
R.S.O. 1970, C.284, as amended, requires that where
the seat of a member of a council becomes vacant under
section 38, the Council shall forthwith declare the
seat to be vacant;
AND WHEREAS the seat of Councillor Gerald Fisher
became vacant by virtue of his resignation made
pursuant to subsection (e) of section 38 of the said
Act the said Council hereby declares the seat of
Councillor - Ward 3 (Local) to be vacant.

BY-LAWS
By-Law Number 640/77
Councillor Matheson, seconded by Councillor Robertson
moved for leave to introduce a By-law of the Town of
Pickering to appoint a Mayor for the Corporation of
the Town of Pickering and that same be now read a
first, second and third time and that the same be
now finally passed and that the Mayor and Clerk sign
the same and that the Seal of the Corpaætion be
thereto affixed.
CARRIED
By-law read a first, second and third time and finally
passed.
Councillor Anderson declared his conflict of interest and did
not vote on this By-law.

By-Law Number 641/77
Councillor Cahill, seconded by Councillor Fisher
moved for leave to introduce a By-law of the Town
of Pickering to appoint a member of the Council to
act in the place of the head of the Council from
time to time and that same be now read a first,
second and third time and that the same be now
finally passed and that the Mayor and Clerk sign
the same and that the Seal of the Corporation be
thereto affixed.
CARRIED
By-law read a first, second and third time and finally
passed.
Councillor Matheson indicated that he abstained
from voting on this By-law.
By-Law Number 642/77
Councillor Cahill, seconded by Councillor Matheson
moved for leave to introduce a By-law of the Town
of Pickering to appoint a member of the Council of
The Regional Municipality of Durham and that same
be now read a first, second and third time and that
the same be now finally passed and that the Mayor
and Clerk sign the same and that the Seal of the
Corporation be thereto affixed.
CARRIED
By-law read a first, second and third time and finally
passed.
Councillor Fisher did not participate in the
discussion or the vote.
By-Law
Councillor Cahill, seconded by Councillor Matheson
moved for leave to introduce a By-law of the Town
of Pickering to require the holding of an election
to fill the vacancy in the office of local councillor
in Ward 3, and that same now be read a first and
second and third time.

Resolution 120/77
Moved by Councillor Robertson, seconded by Councillor
Fisher that the subject of the Local Councillor of
Ward 3 be deferred to the next Executive Committee
subject to a legal opinion being given concerning the
recorded vote on the By-law for an election.

By-Law Number 643/77
Councillor Fisher, seconded by Councillor Robertson
moved for leave to introduce a By-law of the Town of
Pickering to confirm the proceedings of the Council
of the Corporation of the Town of Pickering at its
meeting held on the 20th day of June 1977 and the
Special Meeting of Council dated June 20th 1977,
and that same be now read a first, second and third
time and that the same be now finally passed and that
the Mayor and Clerk sign the same and that the Seal
of the Corporation be thereto affixed.
CARRIED
By-law read afirst, second and third time and finally
passed.

ADJOURNMENT
Moved by Councillor Robertson, seconded by Councillor
Fisher that the meeting into Closed Session at the
hour of 9:02 p.m.
