COUNCIL MEETING
A meeting of the Pickering Town Council
was held on MONDAY, JUNE 20TH 1977 at
7:30 P.M.

ADOPTION OF MINUTES

Fisher that the minutes of the meeting of June 6th
1977, be adopted.

DELEGATIONS
The following had indicated their desire to address
Council with respect to the pending vacancy for the
position of Mayor:
Mr. Bruce Handscombe - West Shore Association
Mr. Don Yarrow
MOTION
Moved by Councillor Robertson, seconded by Councillor
Cahill that Mr. Bruce Handscombe of the West Shore
Association be heard.
CARRIED
Mr. Handscombe explained that the Executive of the
West Shore Association had discussed the proposal of
Council to appoint a Mayor. The majority of the
Executive indicated their support of the appointment
of a Mayor for several reasons namely: because of
the lag of time between the resignation of the Mayor
and the election of a new Mayor; temporary appointments
do not lend themselves to good government; a person
unknown to the residents may run for Mayor in the election;
the representation of Regional Council is lost in the
meantime; the cost of an election was also a consideration.
Mr. Handscombe also pointed out that August is a very
poor time for an election and that a low voter turn-
out would most probably be the result. Because of
the above mentioned reasons the West Shore Association
supports any decision of Council.

Cahill that Mr. Don Yarrow be heard.

DELEGATIONS (Con~Eued)
Mr. Yarrow indicated that there is no need to
have an election. He pointed out that while he
was canvassing for the Provincial Election most
of the residents were not in favour of a Municipal
Election-. The cost of an election is an important
consideration. He also pointed out that the candidate
of Council for the appointment of a Mayor has been
Acting Mayor during the absence of Mayor Ashe and
thus~ had experience in the past.

By-law 609/77 is in conformity with the Official
Plan of the Town of Pickering approved and in
force at the time said By-law was passed, namely
the 16th day of May 1977;
2)
No further Official Plan has been proposed by
Council nor approved by the Ministry of Housing
since the passing of said By-law 609/77 and
which said By-law would not be in conformity,
including the District Plan of the Town of
Pickering District Planning Area, Region of
Durham which was adopted by Council February
17th 1975 and recommended to the Region of
Durham for approval;
3)
That the objections received objecting to this
By-law be considered invalid;
4)
And further, that the objections be forwarded to
the Ontario Municipal Board.

Robertson that the week of June 25th to July 1st 1977
shall be observed as "CANADA WEEK" in the Town of
Pickering.

Fisher that the Claremont Lions Club be granted
permission to hold a Beerfest in the Claremont
Community Park on July 23rd 1977.

Moved by Councillor Fisher, seconded by Councillor
Anderson that the Municipality submit an application
to the Province of Ontario under the Rural Employment
Incentives Program 1977-78 and that the funds secured
be used for a Municipal Tree Planting Program.

Robertson that the Region of Durham be requested
to install 3 vehicle pre-exemption units as directed
by the Fire Chief for the Town of pickering, on the
understanding that the Town will assume all installation
and maintenance costs associated with the system.

Moved by Councillor Anderson, seconded by Councillor
Robertson that a grant of $1,300.00 be given to the
Ajax-Pickering-Whitby Assocation for the Mentally
Retarded, that the amount be charged to Account
Number 2195 and that an over-expenditure be allowed
on that budget i tern.

Town Fire Chief dated June 12th 1977, relative to the
telephone service be approved and that the Fire Depart-

By-Law Number 639/7]
To authorize the execution of an Agreement between
the Corporation of the Town of Pickering on the one
hand and Murray V. Jones and Associates Limited and
the Environmental Applications Group Limited on the
other hand with respect to the preparation of the
Frenchman's Bay Water and Shoreline Development
Plan for the Town of Pickering.
The Committee of the Whole arises and reports the
By-laws as read.

Councillor Robertson, seconded by Councillor Fisher
moved that the report of the Committee of the Whole
on By-law Numbers 628/77 to 639/77 inclusive, be
adopted, and that the said By-laws be now read a
Third Time and PASSED, that the Mayor and Administrator-
Clerk sign the same, and that the Seal of the Corp-
oration be affixed thereto.

By-Laws read a first, second and third time and
finally passed.
OTHER BUSINESS
Mayor Ashe - Res~SE~~i~
Mayor Ashe addressed the Members of Council and
the public and he indicated that he is leaving
the Town in excellent financial condition. He
indicated that this is a result of the co-operative
spirit of past Councils and because of the excellent
staff and the excellent leadership of Mr. N.C. Marshall
the Administrator-Clerk. He indicated that he hoped
that the development of the Town Centre would proceed
expeditiously and he also recommended that the
Recreation Complex proceed as the Town's capabilities
grow and needs appear. He expressed a concern about
the confidence of Council going astray. He concluded
in hoping that Council will take their prerogative
and appoint a successor.

Gentlemen:
It is with mixed feelings that I herewith submit my
resignation as Mayor of the Town of Pickering. I would
ask that said resignation become effective immediately
follaring the regular Council Meeting of Monday, June 20th 1977.
It has been my honour and privilege to have served the
people of Pickering approximately 7~ years as Deputy
Reeve and Mayor. May I take this opportunity to sincerely
thank the Council and staff for all the help and support
over the past number of years.
In my new position as M.P.P. for Durham West Riding I
will attempt to serve with enthusiasm, dedication and
concentrated effort for the benefit of all our people
and all the Municipalities that comprise Durham West.

That the report of the Treasurer-Collector dated
May 25th 1977, be approved, and that the existing
Rural Street Light Areas be amalgamated for purposes
of the 1978 tax year.
L~tDFILL SITES - 5th CONCESSION ACCESS ROAD
That a by-law be passed authorizing the Mayor and
Clerk to execute an Offer to Purchase covering
required road widenings on the 5th Concession, more
particularly described in Reference Plan 40R-3579,
Parts 1, 2,4, 5 and 6.
"NO PARKING" BY-LAW
That a by-law be prepared amending By-law 195/75
including the prohibition of parking on portions of
the Industrial ROad ,and Modlin Road, as recommended

QUOTATION - TAB SIGNS & OVERLAYS
That the report of the Town Buyer dated May 17th 1977
with respect to the quotations received on Tab Signs
and Overlays be adopted and that the normal tendering
procedure be waived.
ONTARIO HOME RENEWAL PROGRAM
That the Corporation of the Town of Pickering make
application for a grant to the Minister of Housing
in the amount of $68,428.00, being fifty percent of
the eligible grant for the continuance of the Ontario
Home Renewal Program.
OPTION AGREEMENT - MINISTRY OF THE ENVIRONMENT
YORK-DURHAM SEWAGE SYSTEM
That a by-law be passed authorizing the Mayor and
Clerk to execute an easement in favour of the Ministry

RESOLQTION - REGIONAL MUNICIPALITY OF WATERLOO
That the resolution of the Regional Municipality
of Waterloo with respect to their concern regarding
"Psi Mind Development" Organization activities
be endorsed.
EASEMENT - SUPREME ALUMINUM
That the Administrator-Clerk be authorized to negotiate
with Supreme Aluminum for the securing of an easement
through their property to accommodate pedestrian
traffic to the Don Beer Sports Arena.
AGREEMENT OF PURCHAßE AND SALE - LOT 95, PLAN 816
That the Mayor and Clerk be authorized to execute
an agreement of Purchase and Sale for Lot 95, Plan 816
to Giuseppe Nesci in the amount of $500.00 and that
the necessary by-law be passed to this effect.
SUBDIVISION AGREEMENT - ALVES CONSTRUCTION
That a. by-law be passed authorizing the Mayor and
Clerk to execute a Subdivision Agreement between the
Corporation of the Town of Pickering and Alves Con-
struction Limited (Draft Plan l8T-76016) Part Lot 29,
Registered Plan 509, Block AG, Plan M-997, and that
item 6 (d) of Schedule "B" of the Agreement should
read $6,000.00 instead of $4,000.00.
BILL C-40 - AN ACT TO AMEND THE AERONAUTICS ACT
(CANADA)
That the report of the Town Solicitor dated June 13th
1977, pertaining to Bill C-40, be received for information.
SITE PLAN AGREEMENT - PETER BALDER
That a by-law be passed authorizing the Mayor and
Clerk to execute a Site Plan Agreement between the
Corporation of the Town of Pickering and Peter Balder
with respect to a condition imposed as a result of
a Land Division Committee.decision, Parts 1 and 3,
Plan 40R-3572.
ACCOUNTS FOR APPROVAL
That the Accounts dated May 31st 1977, in the amount
of $1,073,005.83, as submitted by the Administrator-
Clerk,be approved.
MAYOR - SUCCESSION
That whereas Section 44, Sub-section 1, Chapter 284,
R.S.0.1970 envisages a Council appointing a successor
to the head of council where a vacancy in this position
