A meeting of the Pickering Town Council
was held on MONDAY, APRIL 4th 1977 at
8:00 P.M.

ADOPTION OF MINUTES
Moved by Councillor Robertson, seconded by Councillor
Fisher that the minutes of the meetings of March 21st
and 28th 1977, be adopted.

DELEGATION
Mr. Dennis Hunter and Mr. Bruce Handscomb of the East
Shore Community Association and the West Shore Community
Association were in attendance with respect to the
current water and sewer bills distributed by the Region
of Durham.

Moved by Councillor Robertson, seconded by Councillor
Kitchen that the spokesmen be heard.
CARRIED
Mr. Hunter and Mr. Han~ spoke brièfly in support
of the written presentation which they had presented
to Council. After some discussion concerning the
service charge and the method of billing Mayor Ashe
commended the Associations for their analytical
presentation.

Robertson that all pertinent and back-up material
relative to water and sewer billing be given to the
East Shore Community Association and the West Shore
Community Associàtion and any other Ratepayers Groups
upon request.

Moved by Councillor Robertson, seconded by Councillor
Fisher that whereas Section 636a of the Municipal Act
as enacted by Statutes of Ontario, 1973, c.124 transfers
the responsibility for the hearing of the applications
for cancellation, reduction or refund of taxes to the
Council of the Municipality;
AND WHEREAS notices in writing of applications have
been received by the Clerk of the Municipality for
the cancellation, reduction and refund of taxes for
various reasons;
AND WHEREAS upon inviestigation and receipt of
reasonable explanations all claims have been substantiated;
BE IT THEREFORE RESOLVED that the Council of the Town
of Pickering accept the following list of applications
and authorize the adjustment of taxes to be made accordingly.

Matheson that the Mayor and Clerk be authorized to
petition the Ministry of Transportation and Communications
for a supplementary allocation of subsidy monies for
the year 1977 in the amount of $2,125.12.

Moved by Councillor Kitchen, seconded by Councillor
Robertson that the quotation of Jim Davidson Motors
Limited for a Dodge one ton truck at $5,798.35 and
a half ton Dodge truck at $5,276.00 be accepted and
further that the quotation of Cliff Mills Motors
Limited for a 3/4 ton G.M.C. Van in the amount of
$5,500.00 be accepted, as recommended by the Director
of Recreation and Transportation in his report of
March 24th 1977.

Moved by Councillor Robertson, seconded by Councillor
Anderson that the Administrator-Clerk be authorized
to reduce the Letter of Credit presently held by the
Municipality guaranteeing the payment of lot levy
fees in the Pickering Developments Subdivision in
the amount of $200,000.00 to $35,000.00.

BY-LAWS
By-Law Number 577/77
Councillor Fisher, seconded by Councillor Robertson
moved for leave to introduce a By-law of the Town of
Pickering resp~cting the removal of snow and ice from
and to municipal lands, and that same now be read a
first and second time, and the Council go into Committee
of the Whole thereon.
AMENDMENT
Moved by Councillor Anderson, seconded by Councillor
Robertson that Section (1) of the By-law 577/77 be
changed to read "Twelve hours" instead of "Nine hours".
CARRIED
The Committee of the Whole arises and reports the
By-law as amended.
Councillor Fisher, seconded by Councillor Robertson
moved that the report of the Committee of the Whole
on By-law 577/77 now be read a Third Time and PASSED,
and that the Mayor and Clerk sign the same, and the
Seal of the Corporation be affixed thereto.

By-Law Number 578/77
Councillor Robertson, seconded by Councillor Fisher
moved for leave to introduce a By-law of the Town of
Pickering to amend By-law Number 266/75 limiting the
number of automobile service stations and public
garages, and that same be now read a first, second
and third time and that the same be now finally
passed and that the Mayor and Clerk sign the same
and that the Seal of the Corporation be thereto affixed.

By-Law Number 579/77
Councillor Kitchen, seconded by Councillor Cahill
moved for leave to introduce a By-law of the Town of
Pickering to amend By-law Number 3818/70, regulating
garbage dumps and the depositing of garbage, refuse,
waste or any other material on private or public
property, and that same be now read a first, second
and third time and that the same be now finally
passed and that the Mayor and Clerk sign the same
and that the Seal of the Corporation be thereto affixed.

By-Law Number 580/77
Councillor Cahill, seconded by Councillor Matheson
moved for leave to introduce a By-law of the Town
of Pickering to authorize the execution of an agree-
ment between the Corporation of the Town of Pickering
and Ontario Housing Corporation with respect to the
financing of the provision of 36 Senior Citizens Units
(Block A, Plan M-1045) - Foxglove Avenue, and that
the same be now read a first, second and third time
and that the same be now finally passed and that the
Mayor and Clerk sign the same and that the Seal of
the Corporation be thereto affixed.

By-Law Number 581/77
Councillor Anderson, seconded by Councillor Kitchen
moved for leave to introduce a By-law of the Town of
Pickering to authorize the execution of two site Plan
Agreements between the Corporation of the Town of
Pickering and Bianca Israeli, Luba Smoskowitz and
Harvey Friedman on the one hand (Part 1, Plan 40R-
3535) and Kent Industrial Developments Limited on
the other hand (Part 2, Plan 40R-3535) with respect
to Block AC, Plan M-997,.. and that same be now read
a first, second and third time and that the same be
now finally passed and that the Mayor and Clerk sign
the same and that the Seal of the Corporation be
thereto affixed.

moved for leave to introduce a By-law of the Town
of Pickering to authorize the execution of a Development
Agreement between the Corporation of the Town of
Pickering and Jack Jacobsen Construction Limited
with respect to Lot 43, Plan 1041 (LD 533-6/76),
and that same be now read a first, second and third
time and that the same be now finally passed and that
the Mayor and Clerk sign the same and that the Seal
of the Corporation be thereto affixed.

Notice of Motion - Rouge River Foot Bridge
Moved by Councillor Cahill, seconded by Councillor
Matheson that whereas renewed concern has been
expressed by the area residents of Ward 1, in'the
Town of Pickering known as the Rosebank Area over
the construction of a foot bridge over the Rouge River;
arid
WHEREAS the concerns of the citizens of West Rouge
in Scarborough expressed in their petitions to the
Metro Parks and Recreation Committee, Metro Executive
Committee and Metro Budget Committee argued against
the request of the Borough of Scarborough for a foot
bridge across the Rouge River; and
WHEREAS the decision of the Metro Budget Committee
on Tuesday, March 29th 1977, approved the expenditure
of bUilding a foot bridge across the Rouge River; and
WHEREAS the letter of the Town of Pickering dated 1975
was not considered in part where it stipulated "The
Town of Pickering will bear no cost pertaining to
this foot bridge".
BE IT THEREFORE RESOLVED that the Council of the Town
of Pickering serve notice on the Borough of Scarborough
and the Metro Toronto Council before final approval
is given to the construction of the foot bridge over
the Rouge River that the Town of Pickering shall not
and will not consent to a foot bridge unless;
a)
The Town of Pickering is relieved of any cost
pertaining to its construction,
Given written notice of clearance of any liabilities
that may occur,
b)
c)
Be absolved of any maintenance in the future, and
d}
Be assured in writing from the Borough of Scarborough
and the Metro Executive Council that the Town of
Pickering be relieved of any indemnities caused
by pedestrian use of this foot bridge in conjunction
with the railway property.
There was some discussion concerning the wording of
the Motion.
Resolution 65/77
Moved by Councillor Kitchen, seconded by Councillor
Robertson that the Notice of Motion pertaining to
the Rouge River Foot Bridge be tabled and that it
be referred to the Town Solicitor for analysis of
the wording, and that furthermore comments be regu~_sted
from staff and that these along with the previous
Resolution be submitted to Council at a later date.

3.
Swim-a-thon
It was brought to the attention of the Public
that Councillor Robertson swam 100 lengths of
Dunbarton Indoor Pool in the C.A.S.A. Swim-a-
thon .
4.
Operation Update
It was noted that the Bingo held on Wednesday,
March 30th 1977 for the benefit of the Ajax-
Pickering Hospital was very successful. The
cheque is to be presented during the Bingo of
Wednesday, April 6th 1977.
5.
Letter to The Honorable J. Rhodes - L.C.B.O. Warehouse
The Mayor indicated that he wrote a lengthy letter to
The Honorable J. Rhodes, Minister of Housing expressing
his displeasure at the dècision to locate the L.C.B.O.
Warehouse in Whitby rather than in Pickering which
had been seriously considered for this facility.
6.
Association with Conservation Authorities
It was noted that the larger part of the Town of
Pickering is within the watershed that is under the
jurisdiction of the Metropolitan Toronto and Region
Conservation Authority and that this authority has
spent much money within the municipality of the Town.
Only about 10% of the area of the municipality is
within the jurisdiction of the Central Lake Ontario Conservation
Authority.
7.
By-Law Report
Councillor Matheson requested an explanation of the
items entered as "other" in the By-law Report.

Councillor Anderson, seconded by Councillor Fisher
moved for leave to introduce a By-law of the Town
of Pickering to confirm the proceedings of the Council
of the Corporation of the Town of Pickering at its
meetings held on the 28th day of March and the 4th
day of April 1977, and that same be now read a first,
second and third time and that the same be now finally
passed and that the Mayor and Clerk sign the same
and that the Seal of the Corporation be thereto affixed.

BY-LAW - REMOVAL OF SNOW AND ICE
That the report of the Town Solicitor dated March 10th
1977 with respect to snow clearance from sidewalks be
adopted and that the appropriate by-law be forwarded
to Council for its adoption.
GARAGE LICENSING BY-LAW
That the report of the Town Solicitor dated March 23rd
1977 with ;espect to amendments to By-law 266/75 be
adopted and that the necessary amending by-law be pre-
pared granting the licence classifications indicated
in the report.
GARBARGE DUMPING BY-LAW
That àh>amending By-law be prepared amending By-law
13818/70 - Garbage Dumping, consistent with the recom-
mendation of the Town Solicitor in his report of
March 23rd 1977.
FENCE BY-LAW
That Mr. Michael Patterson (728 COrtez Avenue) and
Mr. Harvey March (738 COrtez Avenue) be granted an
exemption under the provisions of By-law 425/76
with respect to the height of a fence in their front
yard and that they be permitted to infringe on the
Town-owned property adjacent to their front yard on
the expre8s understanding that the fence in question
will be removed from the Town property if required
by the Municipality within fourteen days of written
notice for such removal from the Town.
AGREEMENT - ONTARIO HOUSING CORPORATION
36 SENIOR CITIZENS UNITS - FOXGLOVE AVENUE
That the MAyor and Administrator-Clerk be authorized
to execute an agreement between the Corporation and
Ontario Housing Corporation with respect to ~ 36 unit
Senior Citizens Development in Plan M-1O45, Block A,
(Foxglove Avenue).
SITE PLAN AGREEMENTS - J'.D)~S. SUBDIVISION
That thè Mayor and Administrator-Clerk be authorized
to execute two Site Plan Agreements with respect to
Parts 1 and 2, Plan 40R-3535 - Pickering Developments.
SITE PLAN AGREEMENT - JACK JACOBSEN CONSTRUCTION LTD.
LOT 43, PLAN 1041
That the Mayor and Clerk be authorized to execute a
Site Plan Agreement with Jack Jacobsen Construction
Limited with respect to Lot 43, Plan 1041, (Part 1,
5,6, 7, & 8, Plan 40R-3265) which is required as a
condition of Land Division Application LD 533-6/76.
SUMMER ICE PROGRAM - DON BEER SPORTS ARENA

PICKERING INDOOR TENNIS
That the report of the Director of Recreation and
Transportation dated March 16th 1977 with respect to
the erection of an air-support structure over the
tennis courts at Sandy Beach Road be received and that:
1.
The Pickering Indoor Tennis Committee be officially
recognized as an advisory group to the Municipality
with respect to the installation of an air-support
structure over the Sandy Beach Tennis Court.
2.
That a capital expenditure of $80,000.00 be
authorized for the year 1977 in support of
the construction of an air-suppòrt structure
over the Sandy Beach Tennis Courts.
Thatan amount of $3,000.00 be included in the
Recreation Administration budget to be utilized
for advertising in connection with the generation
of funds in support of the structure and that it
be recognized as a component cost of the project.

for the purchase of a new air-support structure.

into an undertaking that the membership will

$40,000.00 of this should be available through

made available to the Municipality a sum of
$20,000.00 representing the 1977 constri'bution
to this project by June 30th 1977.
PURCHASE OF TRACTOR & MOWER - PARKS DEPARTMENT
That the Director of Transportation with respect
to the acceptance of the quotation of E.H.E. Equipment
Salies in the amount of $3,080.00 for the supply of a
Graveley Tractor and Mower be accepted and that the
additional funds over and above the 1977 budget,
allocation for this item in the amount of approximately
$1,080.00 be secured from the 1976 Year End Surplus.

PICKERING LIONS CLUB - SKATE-A-THON
That the request of the Pickering Lions Club in their
letter of March 16th 1977 for the waiving Or reduction
of the normal hourly rate for the use of the Don Beer
Sports Arena for purposes of their proposed Skate-a-
thon be denied, but that they be encouraged to proceed
with the project and a Council Grant equal to one half
of the hourly rate be made to the club if they proceed.
MUSEUM BOARD - 1976 SURPLUS
That the 1976 Surplus as audited standing to the credit
of the former Town of Pickering Muse~ Board be recorded
on the Town's 1977 General Government Budget as a
"Transfer from Own Funds - Other Boards" and credited
to G/L 1930, and that this amount be allocated to the
Museum Reserve Accounê as part of the distribution of'
the 1976 surplus.
DIAL-A-BUS SUBSIDY
That the report of the Treasurer-Collector with respect
to the 1977 budget for the Public Transit operation be
adopted and that the figures be incorporated in the
1977 Budqet.
SENIORS COUNCIL OF AJAX-PICKERING - GRANTr
That the request of the Sèniors Council of Ajax-Pickering
for a 1977 grant of $150.00 be approved.
SCHOOL CROSSING - ELIZABETH B. PHIN PUBLIC SCHOOL
That the Director of Public Works be instructed
to include the installation of a sidewalk along the
west side of Altona Road, as outlined in his report
of March 8th 1977, in the 1977 Construction Program
and that a more detailed report on this installation
be submitted for the consideration Council.'
OUTSTANDING AMENDMENTS - MINISTER'S ZONING ORDER
That the report of the Administrator-Clerk dåted
March 18th 1977, re: amendments to the Minister's
Zoning, Order, be received for information.
HOLDING ZONE BY-LAW - HAMLET OF GREENWOOD
That a Restricted Area By-law Holaiftg Zone, be
prepared for the entire Hamlet of Greenwood and that
this By-law be adopted by the Town and submitted to
the Ontario Municipal Board with the request that
it not be considered for approval, until the revocation
in total or part of the Minister's Zoning Order.
STORM SEWERS, - ROSEBANK AREA
That the Municipaljty take the initiative in the
installation of storm sewers within the Rosebank
Area and that a more definitive report with respect
to cost and specific services to be included in
the project be prepared for the consideration of
Council, as recommended by the Administrator-Clerk
in his report dated March 10th 1977.

ACCOUNTS FOR APPROVAL
That the accounts dated March 25th 1977, in the
amount of $2,110,787.31, as submitted by the
Administrator-Clerk be approved.
DICTATING EQUIPMENT - ADMINISTRATOR-CLERK'S DEPT.
That the Purchasing Department be authorized to
purchase a Dictaphone "Thought Tank System" for
the Office of the Administrator-Clerk at a cost of
$1,875.00 plus sales tax, with any over-expenditure
of the 1977 budgetary allowance covered as a draw
agaist the 1976 Year End Surplus.
FRENCHMAN'S BAY STUDY - CONSULTANTS
That the report of the Director of Planning dated
March 28th 1977, with respect to the Frenchman's
Bay Water and Shoreline Development Plan be adopted
and that the firm of Murray V. Jones and Associates
Limited and the Environmental Applications Group
Limited be retained to complete the Secondary Plan
within the Frenchman's Bay Area, consistent with
the letter of Murray V. Jones and Associates Limited
dated March 28th 1977.
THE CAPTAIN DEVELOPMENT GROUP - SUBDIVISION AGREEMENT
That the Committee authorize the Administrator-Clerk
to issue a letter of intent to the Captain Development
Group, relative to their agreement on the Plan of
Subdivision registered as M-1040 acknowledging that
the subdivision agreement be extended and/or rewritten.
