There will be an inaugural meeting and election of the Board of the Ajax-Pickering Seniors Council at the Pickering High School on Tuesday, October 21, 1975, at 7:30 P.M. (II) RESOLUTIONS Resolution #158/75 Moved by Councillor A. Robertson, seconded by Councillor Spratley, that the recommendations of the Executive Committee Report of October 14, 1975, be adopted. CARRIED Resolution #161/75 Moved by Councillor D. Kitchen, seconded by Councillor K. Matheson, that Council: (1 ) Declare the week of November 5 - 11, 1975, inclusive as Remembrance Week in the Town of Pickering; - . (2 ) Permit the Remembrance flag to be displayed on the Town flag pole for Remembrance Week; ~./'o (3 ) Authorize the purchase of a wreath in an amount not to exceed $20.00; (4 ) Appoint Mayor G. L. Ashe or his designate as its representative to place the wreath at the cenotaph in the former Village of Pickering; (5 ) Grant the Legion permission to sell poppies on the streets on the 6th 7th and 8th of November. CARRIED - 127 - 26/75 Resolution #162/75 Moved by Councillor A. Robertson, seconded by Councillor Spratley, that whereas the activities of the Region of Durham and their contractors in connection with the construction of the York-Region Sanitary Sewer in the vicinity of Sandy Beach Road and Bayly Street have drained a number of residential wells in the area; And in view of the stated policy of the Region as expressed in the Works Committee report of 294/75; . . Be it therefore enacted that the Region of Durham be asked to assume the cost of connecting those homes in the subject area to the existing watermain. . ; CARRIED Motions 1. To endorse the resolution of the City of Orillia with respect to legislation governing the operation of fire, police and justice departments. MOTION LOST (III) BY-LAWS By-Law Number 305/75 Councillor K. Matheson, seconded by Councillor B. Searle, moves for leave to introduce a By-law of the Town of Pickering to authorize the execution of a Release between the Corporation of the Town of Pickering and John Donald Slack with respect to sewer agreement, Lot 7 and south half of Lot 6, Pickering, and that same now be read a first, second and third time and passed, and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 306/75 .- Councillor A. Robertson, seconded by Councillor K. Spratley, moves for leave to introduce a By-law of the Town of Pickering to number the homes and lots in Registered Plan M-1024 and M-1025 and that same now be read a first, second and third time, and passed, and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. - 128 - 26/75 By-Law Number 307/75 Councillor D. Kitchen, seconded by Councillor B. Searle, moves for leave to introduce a By-law of the Town of Pickering to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lot 22, Concession 1 and Block AC, Plan M-997, Town of Pickering and that same now be read a first, second and third time and passed, and that the Mayor and Clerk sign the same and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 308/75 Councillor K. Spratley, seconded by Councillor A. Robertson, moves for leave to introduce a By-law of the Town of Pickering to exempt certain parts of Plan M-1025 from part lot control and that same now be read a first, second and third time and passed, and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-law read a first, second and third time and finally passed. By-Law Number 309/75 - Two Readings Only (IV) 1. .' 2. . .' 3. Councillor B. Searle, seconded by Councillor A. Robertson, moves for leave to introduce a By-law of the Town of Pickering to authorize the execution of an agreement between the Ministry of Housing and the Town of Pickering (Block Y, Plan M-16, Northdown Arcadia) and that same now be read a first and second time, and that Council go into Committee of the Whole thereon. OTHER BUSINESS Mardi Gras Day Council was asked to declare November 8 as Mardi Gras day in Pickering. Note resolution above. Remembrance Week Council was asked to declare the week of November 5 - 11 as Remembrance Week. Note resolution above. Ground Water Interference - Sanitary Sewer Construction - Bayly Street and Sandy Beach Road Because of the construction by the Region of Durham through its contractors of a sanitary sewer along Bayly Street and Sandy Beach Road, some of the wells in the area have been dried out. Note resolution above. 4. 5. (V) - 129 - 26/75 Wharf Street - Frenchman's Bay Because of the difficulties which have arisen relative to Wharf Street at Frenchman's Bay, direction was given to the staff to see whether there are any other streets in a similar situation. M.T.R.C.A. - Rosebank Area Homes It was announced that the M.T.R.C.A. have decided not to acquire any more homes in the Rosebank area until such time as Council and the ratepayers agree on further developments. It was noted that M.T.R.C.A. is not pulling out of Pickering. The two houses that had been slated for demolition are being handed over to the Region for repairs and payment of taxes to be used by the Social Services Commission for emergency housing. Kitchen, moves for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meetings held on the 14th and 20th days of October, 1975, and that same now be read a first, second and third time and passed, and that the Mayor and Clerk sign the same, and the seal of the Corporation be affixed thereto. The Executive Committee presents its report and respectfully reports and recommends as follows: 1. ROSEBANK ROAD - WALKWAY.TO OLD FOREST ROAD That the recommendation of the Executive Committee dated September 8, 1975, with respect to the granting of a lease to the abutting owners on Lot 59, Plan 816, be rescinded. 2. RUNNYMEDE DEVELOPMENT CORPORATION LIMITED BY-LAW TO REMOVE PART LOT CONTROL - GLENDALE SUBDIVISION That the Council of the Town of Pickering pass a by-law removing part lot control on Plans M-IO37, M-IO38 and M-IO39 as requested by the Developer, pròviding all previous purchasers are notified by registered letters and future owners will have a clause in the Offers to Purchase and Sale indicating the easement. 3. EXEMPT O.H.C. FROM LOT LEVY FEES That whereas the Municipality is supporting the establish- ment of a Senior Citizens Development on Faylee Crescent, and, Whereas the Municipality has subsidized the project to the extent of granting the land for the project to Ontario Housing Corporation at a nominal cost, and Whereas under normal circumstances Ontario Housing Corporation would be required to pay the usual lot levy fees, Be it therefore enacted that Ontario Housing Corporation be exempted from any residential lot levy fees associated with their project on Faylee Crescent. 4. OKLAHOMA DRIVE - SIDEWALKS ~ . That the Director of Public Works be authorized to proceed with the installation of a sidewalk between Eyer Drive to West Shore Blvd. as outlined in his report of October 1, 1975, with the necessary funds being secured from the General Levy and further that he be authorized to negotiate the cost of this additional sidewalk with Bennett paving, the successful bidder for sidewalks in the Hamlet of Claremont, and that the Director of Public Works report on the cost of constructing that portion from Hillcrest Road to West Shore Blvd. in concrete. 5. 1975 LEVY FOR REGIONAL WATERWORKS AND SEWAGE SYSTEM That the Treasurer be authorized to remit to the Region of Durham the 1975 levy for Regional waterworks and sewage system as detailed in his report of September 29, 1975, to the Administrator-Clerk. - 2 - Appendix I 6. PROPOSED PICKERING AIRPORT That no further action be taken on Council Resolution #130/75. 7. BAY RIDGES COMMUNITY CENTRE ADDITION That the Mayor and Clerk be authorized to sign a contract with T. William Beddall covering the construction of the Bay Ridges Community Centre and that the Architect be instructed to proceed with the construction as soon as possible in the 1976 construction year. 8. MOTIONS ARISING FROM MEETING WITH N. CAFIK - RE AIRPORT That whereas the expropriation of a significant portion of the Municipality for purposes of establishing an Airport necessitated the reloca~ion of the Town Museum, located in the Hamlet of Brougham; and WHEREAS a portion of the Museum has in fact been expropriated by the Federal Government; and WHEREAS the Federal Government has undertaken in writing to assist the Municipality financially in the relocation of the Museum buildings to an alternate site; and WHEREAS the recent announcement of the Federal Government delaying the construction of the Airport has merely complicated the matter further; BE IT THEREFORE RESOLVED that the Federal Government be urged to undertake immediately the relocation of the Museum buildings to the new Museum site located in the Hamlet of Greenwood. * * * That whereas the expropriation of a significant portion of the Town of Pickering for purposes of establishing an Airport by the Federal Govermment has created a major problem to the local Municipality in the collection of taxes; and WHEREAS the present formula of the Federal Government directing the Municipality to collect the taxes from the Federal Government's tenants has proved most unsatisfactory; and . . WHEREAS Section 2F of The Municipal Grant Act provides that the Minister of Finance may prescribe the method of compensa- tion to be utilized in the instance of taxes owing on Crown- owned land; and WHEREAS considerable monies are owed by the Government of Canada to the Town of Pickering for taxes which have not been paid; and WHEREAS a number of owner-occupiers have refused to pay Municipal taxes as a form of protest to the Federal expropriation; BE IT THEREFORE RESOLVED that the Federal Government, and in particular the Minister of Finance, be requested to make a grant in lieu of taxes for each fiscal year covering all taxes owed on Crown lands expropriated for purposes of the Airport. * * * - 3 - Appendix I That whereas the expropriation of a portion of the Town of Pickering by the Federal Government and the Provincial Government for purposes of establishing an Airport and a City has seriously disrupted the social fabric of the area; WHEREAS a major portion of the original Town residents within the expropriated area have left the Municipality; and WHEREAS the major portion of the Crown tenants within the Airport site do not share the same social responsibilities as those of the original Town residents; and WHEREAS the provision of fire services within this portion of the Municipality depends almost entirely on the use of Volunteer Firefighters, a significant number of whom have left the Municipality as a result of the expropriation; BE IT THEREFORE RESOLVED that the Federal Government and the Provincial Government be requested to assume the costs of providing one total shift for a permanent Firefighter to be stationed at the Brougham Fire Hall. * * * That whereas the expropriation of a major portion of the Municipality by the Federal Government for purposes of an Airport has led to a significant deterioration of the area in question and in particular the deterioration of buildings and the falling of farm lands into disuse; and WHEREAS it is imperative that immediate steps be taken to return the land to proper farming use; and WHEREAS it is equally important that the buildings in the area be properly maintained. BE IT THEREFORE RESOLVED that the Federal Government be requested to take immediate steps: 1. To return the land to agricultural use. 2. That all buildings suitable for residential use be brought up to a standard acceptable to C.M.H.C. 3. That all buildings which according to the Federal Government and the Town of Pickering cannot economically be brought up to this standard be demolished. - . * * * That whereas the recent expropriations by the Federal Government of a number of Town road allowances within the Airport site has created an impossible jurisdictional situation; and WHEREAS the recent cancellation of the Pickering Airport eliminates the need of these road allowances by the Federal Governmen t; ---------- BE IT THEREFORE RESOLVED that the Federal Government be requested to abandon the expropriation on all Town-owned road allowances within the Airport site. - 4 - Appendix 1 9. ACCOUNTS That the accounts in the amount of $543,741.39 as submitted by the Administrator-Clerk be approved. * * * That the account to the amount of $600.00 pertaining to the replacement of glass in the Greenwood Community Centre be approved. 10. SEWAGE EXPENDITURES - CHARGE-BACK That the Town of Pickering accept from the Region of Durham an annual charge-back for the payments of princiapl and interest on the C.M.H.C. debenture in the amount of $199,760.04, but only until such time as the Region of Durham implements a uniform methoQ of covering all Regional sewage net expenditures; AND that the Town enter into an agreement with the Region to give effect to the necessary terms and conditions. 11. ROADS - AIRPORT AREA That the Town of Pickering maintain the roads in the Airport area on a charge-back basis until such time as the expropriation of these roads has been abandoned. , , .
