Myslik (I) ADOPTION OF MINUTES MOVED by Councillor Robertson, seconded by Councillor Matheson that the minutes of the meetings of April 1st 1974 and April 8th, 1974 be adopted. CORRESPONDENCE (II) 1. In a letter of March 30, 1974 the Rouge Hills Ratepayers Association invited Mayor Ashe and Members of Council to attend their General Meeting beina held on April 23,1974. In a letter of April 17,1974 the Ontario Hydro requested permission to post flagmen at two positions on Brock Road See Resolution Number 119/74. 2. ..lillJ RESOLUTIONS MOVED by Councillor Robertson, seconded by Councillor Matheson that the resolutions pertaining to the North Pickering Development and the Proposed Pickering Airport be referred to Executive Committee. CARRIED Resolution 109/74 MOVED by Councillor Robertson, seconded by Councillor Kitchen that the account of Oliver Lloyd & Associates, in the amount of $1,135.46, be paid, as recommended by the Executive Committee, April 8,1974. CARRIED Resolution 110/74 MOVED by Councillor Kitchen, seconded by Councillor Anderson that the tender of Miller Paving Limited be accepted in the amount of A (At Curb) $0.155 per lineal foot and B (In Road) $0.20 per lineal foot for crack filling, subject to the approval of the Ministry of Transportation and Communications, and that Resolution Number 107/74 be rescinded. CARRIED Resolution 111/74 MOVED by Councillor Kitchen, seconded by Councillor Searle that t~EREAS the City of WeIland has passed a resolution dealing with Bill 225, "An Act to Permit Municipalities to Grant Assis~ance to Elderly Residents", and - 57 - 10/74 Resolution 111/74 (Continued) ~VHEREAS the Town of Pickering has been asked to endorse the position taken by the City of Welland on this matter BE IT THEREFORE ENACTED that the Town of Pickering endorse the following resolution: "THAT NHEREAS the Province of Ontario by Bill 225, 'An Act to Permit Municipalities to Grant Assistance to Elderly Residents', provided that the Councils of local municipalities may allow certain owners of residential property a uniform credit against their real property taxes, and tiHEREAS the provision of such credits to a particular segment of the community requires, in effect, a sub- sidization by other municipal taxpayers, and ~ffiEREAS the Council of the City of WeIland deems it inequitable to provide such credits from municipal property taxes, and ~rnEREAS the provision of such credits by the provincial Government would provide uniformity across the Province and ensure that all eligible recipients are treated equitably. NOW THEREFORE BE IT RESOLVED that this Council petition the Government of the Province of Ontario to provide from Provincial funds a uniform grant to all municipal taxpayers who have attained the age of sixty-five years and who are receiving a monthly guaranteed income supplement under Part II of the Old Age Security Act (Canada), and further That a copy of this resolution be forwarded to The Honourable Willi~~ G. Davis, Prime Minister of Ontario; The Honourable John H. ~fuite, Treasurer of Ontario; Mr. Ellis P. Morningstar, M.L.A.; The Association of Municipalities of Ontario and to all major Ontario municipalities seeking their endorsement." CARRIED Resolution 112/74 MOVED by Councillor Kitchen, seconded by Councillor Robertson, that WHEREAS the Town Council has been requested to endorse the Miles for Measles project sponsored by This ~eek newspaper; BE IT THEREFORE RESOLVED that Council endorse this campaign as outlined in their letter of March 27,1974. CARRIED Resolution 113/74 MOVED by Councillor Searle, seconded by Councillor Kitchen that Draft Plan of Subdivision l8T-24846 and the Proposed Official Plan Amendment as submitted by Marshall, 1-1acklin and r-1onaghan on behalf of Heldor Development be DEEMED PREMATURE due to the lack of sewer service capacity, as recommended by the Planninq Committee, April 4,1974. . CARRIED - 58 - 10/74 Resolution 114/74 MOVED by Councillor Matheson, seconded by Councillor Spratley that the application by M.A. Brancaccio to modify the Minister's Zoning Order in respect to lands at Part Lot 6, Concession 7 to permit the construction of a poultry barn and accessory residence be APPROVED subject to the poultry barn and the residential building being constructed simultaneously by agreement to be registered against title, as recommended by the Planning Committee April 4,1974. CARRIED Resolution 115/74 :~OVED by Councillor f.latheson, seconded by Councillor Anderson that the application by H. Puqh for a Modifica- tion to the Minister's Zoning Order in respect to lands beina Part Lots 9 and 10 Concession 8 to reduce the required frontage provisions to 516' for a proposed property of 11.58 acres to be used for "Agricultural Uses" as defined be APPROVED, as recommended by the Planning ComITáttee, April 4,1974. CARRIED Resolution l16/7~ MOVED by Councillor Anderson, seconèed by Councillor Searle that The Salvation Army, Ajax Corps, be permitted to canvas the Town of Pickering for their Red Shield Appeal on May 6, 1974. CARRIED Resolution 117/74 MOVED by Councillor Anderson, seconded by Councillor Spratley that ~JHEREAS By-laws LJ448/73 éI,nd 44ti9/73 \'lere enacted by the Township of Pickering and forwarded to the Ontario Municipal Board for approval; . NŒ~ THEREFORE BE IT RESOLVED that the To,'m of Pickering is desirous of continuing the procedure required to obtain the approval of the Ontario ~unicipal Board to By-laws 44~,G/73 and 4449/73 of the Township of Pickering, enacted on the 5th day of November: 1973 and that the Ontario Municipal Board be advised accordingly. CARRIED Resolution 118/74 MOVED by Councillor Spratley; seconèed by Councillor Anderson that ~ÆŒREAS By-law No. 4387/73 was passed on June 18,1973 to raise money to aid in the construction of works and building repairs under the Shoreline Property Assistance Act, 1973; and ~mEREAS under date of July 23, 1973, rmtario Municipal Board Order E 731171 approved the application of the Township of Pickering to borr~¡ $100,000.00 to be used in the construction of works and bui1dinq repairs under the Shoreline Property Assistance Act, 1973; and t~REAS we advise that ~carLorouqh has requested a portion of this Board Order to cover the applications which were transferred to them as at January 1,1974; - 59 - 10/74 Resolution 118/74 (Continued) BE IT THEREFORE RESOLVED that the $100,000.00 Ontario Municipal Board Order on the Shoreline Property Assistance Act be apportioned to the municipalities of Ajax and Scarborough to cover the shoreline properties taken over by them as at January 1,1974 as follows: Ajax $10,000.00 Scarborough $40,000.00 C.A.RRIED Resolution 119/74 MOVED by Councillor Anderson, seconded by Councillor Robertson that WHEREAS Council by Resolution Number 96/7~ indicated their agreement to the temporary closing of the Brock Road south of Montgomery Park Road to assist the Ontario Hydro in their construction program at the Nuclear Generating Plant; and WHEREAS there are certain legal requirements which must be complied with before the road can officially be closed; and mmREAS the Ontario Hydro is obliged to commence con- struction immediately to take advantaqe of the full construction season; and t.-ffiEREAS by letter of April 17,1974 the Ontario Hydro has requested permission to permit the movement of earth moving equipment across the Brock Road and has agreed to provide adequate protection to vehicular traffic utilizing the road; IT IS THEREFORE RESOLVED that the Ontario Hydro be granted permission to move earth moving equipment across the Brock Road, as outlined in their letter of ,A.pril 17, providing that the Town of Pickering is included in their Liability Insurance Policy as a named-insured, and pro- vided that they enter into an indemnification and an agreement to save the Town of Pickering harmless of any and all use of heavy machinery 01";, the road allowance. CARRIED Resolution 120/74 MOVED by Councillor Anderson, seconded by Councillor Spratley that the Clerk be instructed to determine from the Ministry involved under what authority the gravel pit on the ~orth Road half a mile from vfuitevale was opened after being closed for ten years; also on which basis the hours of operation are determined and the usage of the 5th Concession which runs through the centre of Whitevale. CARRIED By-Law Number ,13/74 Councillor Spratley, seconded by Councillor Searle, moves for leave to introduce a By'-law of the Town of Pickering to establish certain benefits for those employees of the Town of Pickering not covered by the Union Agreement and that same now be read a first and second time, and that Council go into Committee of the Nhole thereon. The Committee of the Nhole arises ~nd reports the By-law as read. Councillor Spratley, seconded by Councillor Matheson, moves that the report of the Committee of the V1hole on By-law Number 43/74 be adopted, and th~t the said By- law be now read a Third Ti~e and PASSED, that the Mayor and Clerk sign the sarner and the seal of the Corporation be affixed thereto. CARRIED By-Law Number 44/74 Councillor Spratley, seconded by Councillor Anderson, moves for leave to introduce a By-law of the Town of Pickering to licence lotteries and that same now be read a first and second timer and that Council go into Committee of the Hhole thereon. The Committee of the ~fuole arises and reports the By-law as read. Councillor Spratley, seconded by Councillor Kitchen, moves that the report of the Conm\Ìttee of the 'f'7hole on By-law Number 44/74 be adopted, and that the said By- law be now read a Third Time and PASSED, that the Mayor and Clerk sign the saMe, and the seal of the Corporation be affixed thereto. CARRIED By-Law Number 45/74 Councillor Searle, seconded by Councillor Matheson, moves for leave to introduce a By-law of the Town of Pickering to appoint a Lottery Licencing Officer and that same now be read a first and second time, and that Council go into Committee of the ~fuole thereon. The Comittee of the ~ihole arises and reports the By-law as read. Councillor Searle, seconded by Councillor Kitchen, Moves that the report of the Committee of the r'Thole on By-law Number 45/74 be adopted, and that the said By-law be now read a Third Time and PASSED, that the Mayor and Clerk sign the same, and the seal of the Corporation be affixed thereto. CARRIED -~,~' ,- - 61 - 10/74 By-Law Number 46/74 Councillor Searle, seconded by Councillor Robertson, moves for leave to introduce a By-law of the Town of Pickering to impose special rates upon land in respect to which money is borrowed under THE SHORELINE PROPERTY ASSISTÆ1CE ACT, 1973 and that same now be read a first and second time, and that Council go into Committee of the ~fuole thereon. CARRIED Taxi-Cab By-Law The Taxi-cab By-law was referred to Executive Committee for further consideration. By-Law Number 47/74 Councillor Anderson, seconded by Councillor Kitchen, moves for leave to introduce a By-law of the Town of Pickering to authorize the execution of an Offer to Purchase between the Corporation of the Town of Pickering and the Durham Board of Education and that same now be read a first and second time, and that Council go into Committee of the ~1hole thereon. The Committee of the ~fuole arises and reports the By-law as read. Councillor Anderson, seconded by Councillor Robertson, moves that the report of the Co~mitt3e of the vrhole on By-law Number 47/71 be adopted, and that the said By- law be now read a Third Time and PASSED, that the Mayor and Clerk sign the san~, and the seal of the Corporation be affixed thereto. C^RRIED By-Law Number ~8/74 Councillor Anderson, seconded by Councillor Searle, moves for leave to introduce a By-law of the Town of Pickering to offer for sale to the abuttinq owners, a closed road allowance in ~~rt Lot 22, Concession 1 and that same now be read a first and second time, and that Council go into Committee of the ':'7hole thereon. (VI) Hotion MOVED by Councillor Robertson, seconded by Councillor Spratley that the following teams be congratulated and recognized by the Council for the honour that they have brouqht to the Town and the appropriate steps be taken by the Clerk to do this: Big H Hinor Pee ':-7ee All Stars - Kiwanis Tournament Ninners Bay Ridges Atoms - O.M.H.A. Lakeshore Champions DEFEATED It was indicated that the Town has already set up a defini te policy of a\<Jardinq rings to All Ontario Ninners. A discussion ensued concerninq the closing of the Liverpool cloverleaf by the ~ü.nistry of Tra.nsportation and Communications. The Ministry had a~reed not to restrict access to Highway ,~Ol until the Brock Road cloverleaf would be opened, however, the hazardous traffic situation necessitated the closinq. The Ministry of Transpo~tation and Communications has written a letter to Council apologizing for the precipitated action. This was considered the best possible solution in the circumstances. There have been several complaints of qravel trucks using the road through ~fuitevale. See'Resolution Number 120/74. ' The question of bicycle paths in the Town, and especially on the Brock Road overpass was raised. A resolution to this effect has already been sent to the Region. The problem of children playing hockey and other sports on the streets was discussed. These activities result in blocked roads and occasional damage to adjacent property. Practically all that can be done is to enforce existing laws and by-laws.
