HomeMy WebLinkAboutApril 2, 1979 9/79 - 44 - COUNCIL MEETING A Meeting of the Pickering Town Council was held on Monday, April 2nd 1979 at 7:30 P.M. PRESENT: Mayor J. Anderson COUNCILLORS: L. Cahill D. Dickerson G. Fisher N. Geraghty D. Kitchen K. Matheson ALSO PRESENT: N. C. Marshall Bruce Taylor Town Manager Town Clerk (I) ADOPTION OF MINUTES Meeting of March 19th 1979 (II) 1. DELEGATIONS Mr. Pearson, Barrister and Solicitor, representing the residents whose property abut the Calvary Road Baptist Church and School at 415 Toynevale Road, stated that the rezoning to permit a private school will only perpetuate an intolerable situation. The rezoning is in contravention of the Rosebank Secondary Plan which states that the subject property be used for public or separate school purposes if population warrants it, otherwise the property should revert to single family dwellings. He stated that the private school is a commercial endeavour which does not benefit the residents of the Rosebank Community. See Item #8 of the Planning Committee Report 9/79 - 45 - (III) RESOLUTIONS Resolution 46/79 - See Appendix A Moved by Councillor Dickerson Seconded by Councillor Geraghty That the Executive Committee Report dated March 26th 1979, be adopted with the following amendment: Item #12 was deferred for thirty days. Councillor Dickerson declared a conflict of interest with respect to Item #12 because he holds a third mortgage on the subject property. CARRIED Resolution 47/79 - See Appendix B Moved by Councillor Dickerson Seconded by Councillor Geraghty That the Planning Committee Report dated March 27th 1979, be adopted with the following amendment: Item #8 was deferred pending a report from the Town Solicitor on the legality of restricting the lot coverage of buildings on the subject property. CARRIED Recorded Vote on Items 3,4, 5 and 6 Yea: Councillors Cahill, Dickerson, Fisher, Matheson and Anderson Councillors Geraghty and Kitchen. Nay: Resolution 48/79 Moved by Councillor Cahill Seconded by Councillor Dickerson That the rental fee to be paid by the Pickering Hockey Association for concrete pad #1 at the Don Beer Arena on April 22, 1979 in the amount of $80.00 be waived; And that said funds be charged to Account GL 2195. CARRIED 9/79 - 46 - (IV) BY-LAWS Councillor Cahill, seconded by Councillor Matheson moved for leave to introduce By-laws of the Town of Pickering: By-law Number 974/79 To authorize the execution of a release of Dalmeco Developments Limited from a Subdivision Agreement respecting Plan M-962 and M-963 By-law Number 975/79 To amend By-law 2947, respecting the licensing, regulating and governing of salvage yards, second hand goods shops and dealers in second hand goods. By-law Number 976/79 To authorize the execution of a Site Plan Agreement between the Corporation of the Town of Pickering and Lawrence Campkin, carrying on business as Campkin's Camping Centre, respecting Part Lots 1,2, 3 and 9, Plan 230 (PCA 51/78) By-law Number 977/79 To amend By-law 733/77, licensing, regulating and governing taxicab and limousine drivers, owners and brokers. Tabled By-law Number 978/79 Being a Restricted Area By-law to amend Restricted Area By-law 3036 as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, on Part of Block U, Plan M-l039, in the Town of Pickering. By-law Number 979/79 Being a by-law to amend By-law 944/79, changing the names of streets in Registered Plans M-I017 and M-1135. THIRD READING Councillor Cahill, seconded by Councillor Matheson moved that the report of the Committee of the Whole on By-law Numbers 974/79,975/79,976/79,978/79,979/79,944/79 and 958/79 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. 9/79 - 47 - (V) 1. OTHER BUSINESS Councillor Kitchen stated that by letter dated July, 1978, Mr. George Ashe, M.P.P., promised that food and fuel signs would be installed on Highway #401 before the Liverpool Road inter- change but to date these signs have not been installed. 2. Councillor Kitchen requested information on what constitutes an emergency at the Pickering Generating Station and what emergency plans are available. Councillor Geraghty requested a statement from the Ministry of Energy on what contingency plans the Province has for nuclear emergencies. 3. 4. Councillor Dickerson, seconded by Councillor Geraghty, proposed the following motion: That a joint meeting be held with representatives from the Towns of Pickering and Ajax, the Minist- ries of Energy and Environment, Ontario Hydro, the Chief of Police, the Fire Chiefs of Pickering and Ajax and the media to review contingency plans for an emergency at the Pickering Generating Station. Moved by Councillor Kitchen Seconded by Councillor Geraghty That the aforementioned motion regarding a review of contingency plans for emergencies at the Pickering Generating Station be considered by Council. LOST Recorded Vote Yea: Nay: Councillors Dickerson, Geraghty and Kitchen Councillors Cahill, Fisher, Matheson and Anderson Moved by Councillor Cahill Seconded by Councillor Matheson That Councillor Dickerson be appointed to the Emergency Operations Control Group in the place and stead of Mayor Anderson pursuant to Section A.2 of By-law 214/74 of the Region of Durham. CARRIED 5. Mayor Anderson reported that the Region of Durham has well documented and researched emergency plans for any situation which may arise at the Pickering Generating Station. 9/79 - 48 - (VI) CONFIRMATION BY-LAW By-law Number 980/79 Councillor Cahill, seconded by Councillor Matheson moved for leave to introduce a By-law of the Town of Pickering to confirm the proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the April 2nd, 1979, and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. CARRIED By-law read a first, second and third time and finally passed. (VII) ADJOURNMENT The meeting adjourned at the hour of 8:50 P.M.. Dated April 17th 1979 u 6/79 TOWN OF PICKERING The Executive Committee having met March 26th, 1979, presents its fifth report to the Council of the Town of Pickering and recommends: 1. APPLICATION FOR REZONING BY J. MOODIE ON THE NORTH SIDE OF KINGSTON ROAD AT THE AJAX BOUNDARY FILE NUMBER B 2310 - A 24/73 That By-law 950/79 is in conformity with the Official Plan of the Region of Durham and in force at the time this by-law was passed, namely the 5th day of February, 1979; And that no further offical plan has been proposed by Council nor approved by the Ministry of Housing since the passing said By-law 950/79 in which the said by-law would not be in conformity. 2. GRANT TO CANADIAN COUNCIL OF CHRISTIAN AND JEWS FILE NUMBER C 2163 That a grant in the amount of $75.00 be made to the Canadian Council of Christians and Jews and that this amount be charged to Account # 2195. 3. CO-OPERATIVE TENDER FOR SUPPLY AND DELIVERY OF CORRUGATED STEEL CULVERT FILE NUMBER C 4300 That Co-operative Tender WD 5/79 of the Region of Durham submitted by J. V. Holt Sales for the supply of corrugated steel culvert in the amount of $20,866.55 be accepted. 6/79 - 2 - 4. TENDER FOR FIRE DEPARTMENT UNIFORMS FILE NUMER C 4300 That tender T-4-79 submitted by St. Hill Levine Uniforms and Stokes Cap and Regalia for the supply of Fire Department uniforms in the following amounts be accepted: St. Hill Levine Uniforms: Trousers Shirts Ties Fire Fighter Tunic Officer's Tunic Parkas $30.73/pr. 7.75/each 1.65/each 83,64/each 86.50/each 37.25/each Stoke's Cap and Regalia: Fire Fighter's Cap Officer's Cap $12.40/each 18.75/each 5. TENDER FOR ONE GANG MOWER AND TRACTOR UNIT. FILE NUMBER C 4300 That tender T-8-79 submitted by Turf Care Products Limited for the supply of one gang mower and tractor unit in the amount of $20,403.83, be accepted. 6. 1979 ROADS BUDGET FILE NUMBER C 2440 That the program of proposed expenditures for highway improvements for the year 1979 in the amount of $1,171,100.00 be adopted; and That the Town of Pickering hereby petitions the Ministry of Transportation and Communications for a subsidy for the year 1979 in the amount of $595,000.00. 7 . PITS AND QUARRIES FILE NUMBER A 2310.103 That the Town of Pickering not endorse the Private Member's Bill being sponsored by David Warner, M.P.P., for Scarborough-Ellesmere and dealing with the Pits and Quarries Control Amendment Act, 1978, as recommended by the Town Solicitor in his report of March 13th 1979. 8. - 3 - ST. PAUL'S ON THE HILL FILE NUMBER B 2310 6/79 That a By-law be passed authorizing the sale of a portion of the lands described under Department of Highways' Plan P-1922-47, registered on April 10th 1964, and representing that portion of the land presently abutting land registered in the name of The Incumbent and Church Wardens of St. Paul's on the Hill - Dunbarton, on the understanding that the purchaser will assume the cost of any required Reference Plan and legal costs associated with the transfer. 9. ACCOUNTS FOR APPROVAL FILE NUMBER C 2310 That the accounts in the amount of $1,115,704.31 for the period ending March 16, 1979, as submitted by the Town Manager, be approved. 11. CONVENTIONS AND SEMINARS FILE NUMBDER A 2114 Whereas it is the practice of the Town of Pickering to encourage Councillors to attend seminars and conventions of Municipal interest; and Whereas it is not possible for all Members of Council, nor in fact practical, for them to attend each and every convention and seminar; and Whereas a great deal of useful information can be obtained at such seminars and conventions which would be of interest to other Members of Council; Be It Therefore Enacted that, in future, those Members of Council attending various seminars and conventions be requested to submit a written report summarizing the highlights of such seminars and conventions or present the various briefs and suggestions made at such seminars and conventions to Council. 12. BAY SPORTS EQUIPMENT LIMITED AND FABRICLAND DISTRIBUTORS LIMITED AT 980 BROCK ROAD FILE NUMBER D2200 That the confidential report of the Town Solicitor dated March 13th 1979 and dealing with zoning infractions in the Industrial Area be adopted and that the actions suggested be taken by the appropriate departments. Item #12 was deferred for thirty days 13. APPLICATION FOR LIQUOR LICENCE FILE NUMBER A 2320.03 That the Town resist the issuance of a Liquor licence to Popeye's Restaurant at 1010 Brock Road on the basis that the zoning for the property does not envisage the establishment of a tavern at this location. 2/79 TOWN OF PICKERING The Planning Committee having met March 27th, 1979, presents it's second report to the Council of the Town of Pickering and recommends: 1. APPLICATION FOR MODIFICATION TO MINISTER'S ZONING ORDER BY J. WONG IN PART LOT 10, CON. 6 FILE NUMBER - B 2310 - M24/78 That application M24/78, as submitted by J. Wong, to modify the Minister's Zoning Order on lands being Part Lot 10, Concession 6 having a broken frontage of 275.36 m on Westney Road and area of 6.4 ha to permit the construction of a single family residence be APPROVED subject to the following condition: 1. That the owner enter into an appropriate noise abatement agreement with and to the satisfaction of the Town. 2. REVISED NEIGHBOURHOOD PLAN IN PART LOT 28, CONCESSION 1 FILE NUMBER B 2310 That modifications to the neighbourhood plan approved in principle by Council March 20, 1978, for Part Lot 28, Concession 1, be approved as outlined in Planning Report #11/79 dated March 16, 1979. 3. APPLICATION FOR REZONING AND DRAFT PLAN OF SUBDIVISION SUBMITTED BY BRAMALEA LIMITED IN PART LOT 28, CONCESSION 1 FILE NUMBER B 4100 - 18T-76036 FILE NUMBER - B 2310 - A 1/78 That Draft Plan of Subdivision 18T-76036 (revised), submitted by Bramalea Limited, with respect to lands known as Part Lot 28, Concession 1, be approved subject to the following conditions: 1. The conditions previously approved for Draft Plan 18T-76036 be rescinded. 2. Changes in "red" as shown on the plan stamped 'approved' this date. 3. The allocation of sewage treatment plant capacity and water capacity for the development. Satisfactory arrangements with the proper authorities regarding underground wiring and street lighting. Registration of the final Draft Plan of Subdivision and commencement of construction within eighteen months of Draft Approval being granted the subject Draft Plan of Subdivision by the Minister of Housing and approval by the Ontario Municipal Board of the appropriate implementing by-law. APPLICATION FOR REZONING SUBMITTED BY THE DURHAM SEPARATE SCHOOL BOARD ON TOYNEVALE ROAD FILE NUMBER - B2310 - A 19/78 That By-law Amendment Application A 19/78 by the Durham Separate School Board on lands being part of Lots 64 and 65, Plan 350, to amend restricted area By-law 2511, as amended, from R4 to R4 (Specific) to permit the establishment of a "Private Non-Resi- dential School", be APPROVED. 9. APPLICATION FOR REZONING SUBMITTED BY THE DURHAM SEPARATE SCHOOL BOARD ON TOYNEVALE ROAD FILE NUMBER - B2310 - A 19/78 That school definitions, as recommended by the Planning Director in his memorandum to the Town Manager dated December 7th, 1978, be approved and incorporated in the Restricted Area By-laws of the Town when required.
