A Meeting of the Pickering Town Council was held on
MONDAY, FEBRUARY 5th 1979 at 7:30 p.m.

DELEGATIONS
Mr. W. Arthurs, 1350 Glenanna Road, Unit #65,
Pickering, representing the Ward #3 Condominium
Association addressed Council with respect to
garbage pick-up for condominiums. He requested
garbage pick-up for condominiums be bi-weekly at
the expense of the Condominium Corporations.
2.
Mr. Mark Stewart and Mr. John Wright were present
from C.J.S.R. radio station based at Scarborough
College to request Council's support for a low
power FM station.

amount of $10,615.00, be accepted.

Moved by Councillor Geraghty
Seconded by Councillor Cahill
WHEREAS, the residence on lots 30,31 and 32, Plan 21,
Whitevale (Part 6, Plan 40R-2225) has been located for
many years some 4-1/2' away from the front lot line; and
WHEREAS, although pursuant to the provisions of section
7.2.1 of By-law 3037, the minimum front yard requirement
for this house is 30'; and
WHEREAS, as a result of the house having been built prior
to the enactment of By-law 3037, the 4-1/2' front yard
has lawful non-conforming status; and
WHEREAS, the owner of the said house has recently moved
it some 10' further away from the front, lot line, thereby
creating a 15' front yard; and
WHEREAS, in so doing the owner has brought the building
more nearly into compliance with the provisions of the said
By-law, but in so doing has lost the lawful non-conforming
status of the reduced front yard set back; and
WHEREAS, due to the historical nature of the property in
question and to the fact that the property now more closely
conforms to the provisions of By-law 3037;
NOW THEREFORE, the Council of the Corporation of the Town
of Pickering HEREBY RESOLVES AS FOLLOWS;
1.
The Clerk be authorized to issue, to whomever it may
concern, a "Letter of Tolerance" in the form attached
hereto as Schedule "A", to indicate that this Council
has no intention of taking proceedings of any sort
against the owners of the subject property on account
of any non-compliance with the front yard set back
requirements in section 7 of By-law 3037.

That Council Resolution 110/78, dated August 8th 1978
be rescinded, and further, that the Town Solicitor be
instructed to withdraw forthwith the Town's appeal of
Land Division Committee Decisions LD 208/78, LD 209/78
and LD 210/78.

BY-LAWS
Councillor Fisher, seconded by Councillor Dickerson moved
for leave to introduce By-laws of the Town of Pickering:
By-Law Number 950/79
Being a Restricted Area By-law to amend Restricted Area
By-law 3036, as amended, to implement the Official Plan
of the Town of Pickering District Planning Area, Region
of Durham, in Part Lot 17, Concession 2, Town of Pickering
and in Part of the Road Allowance between Lot 17, Concession
2, Town of Pickering and Lot 16, Concession 2, Town of Ajax.
By-Law Number 954/79
Being a By-law to appointa Local Councillor of the Town
of Pickering as an alternate Representative to the Council
of the Regional Municipality of Durham to act in the place
and stead of Mayor John E. Anderson during his incapacitation.
Acting Mayor Matheson asked for nominations for the position
of alternate representative on the Regional Council.
Councillor Fisher, seconded by Councillor Dickerson, nominated
Councillor Geraghty.
Councillor Kitchen, seconded by Councillor Cahill, nominated
Councillor Cahill.
Acting Mayor Matheson asked if the nominees will stand for
election and both agreed to do so.
On an unrecorded vote, Councillor Geraghty was chosen the
alternate representative.
By-Law Number 955/79
Being a By-law to fix instalment dates, penalty amounts
and interest rates respecting the payment and collection
of taxes.
THIRD READING
Councillor Fisher, seconded by Councillor Dickerson moved
that the report of the Committee of the Whole on By-law
Numbers 950/79,954/79 and 955/79, be adopted, and that the
said By-laws be now read a Third Time and PASSED and that
the Mayor and Cleiksign the same, and the Seal of the
Corporation be affixed thereto.
CARRIED
By-law read a first, second and third time and finally
passed.

OTHER BUSINESS
1.
In response to the delegation from C.J.S.R. Radio,
Councillor Dickerson introduced the following motion:

That a resolution to support a low per FM station be considered
by Council.

Resolution 27/79
Moved by Councillor Dickerson
Seconded by Councillor Fisher
That the Council of the Town of Pickering having considered
a brief submitted by Mr. John Wright of Scarborough College
Radio Station C.J.S.R. regarding the subject application
which brief contains the following offer and request, viz:
.. (1)
A radio station, fully equipped with some of the
most up-to-date technical resources. (One 'Production'
Studio, and one TLive' air studio.)
(2)
A fully trained production staff, well versed in
the state of 'Live' programming and 'Taped' Specials.
(3) A catalyst to promote local issues and talent that
affect the listening audience directly.
(4)
An opportunity to exchange ideas and information
between a University College Community and a
Municipal Community.
We would appreciate a motion of support from the Council
of the Corporation of the Town of Pickering for C.J.S.R.
Radio, Scarborough College, University of Toronto. This
will be furthered to the CRTC in our C-20 application.
We hope that you will ~rt what we consider to be an
innovative and beneficial proposition."
The Corporation of the Town of Pickering hereby supports
the above application by Scarborough College Radio Station
C.J.S.R.

OTHER BUSINESS (Continued)
2.
Councillor Kitchen introduced the following Notice
of Motion:
That the Region of Durham is hereby requested to
dismantle the sign facing traffic leaving the north
parking lot of the GO Station which prohibits traffic
turning left onto Liverpool Road between 4:30 p.m.
and 6:00 p.m.
3.
Councillor Kitchen further asked that a represèntative
of T.A.T.O.A. attend a Council Meeting to display
plans for the parking lot at the GO Station.
4.
Councillor Kitchen stated that~porary traffic
signals should be installed at the intersection of
Walnut Lane and Kingston Road until permanent traffic
signals are installed at Dixie Road and Kingston Road.
5.
Acting Mayor Matheson stated that the former Ballycliff
Lodge in now being ùsed as a penal institution known
as Durhamdale Inc., contrary to the zoning by-laws.
An application for rezoning to permit such a use was
submitted to the Planning Department as of this date.

CONFIRMATION BY-LAW
By-Law Number 956/79
Councillor Dickerson, seconded by Councillor Geraghty moved for
leave to introduce a by-law of the Town of Pickering to confirm
the proceedings of the Council of the Corporation of the Town
of Pickering at its meeting held on the 5th day of February 1979,
and that same be now read a first, second and third time and
that the same be now finally passed and that the Mayor and
Clerk sign the same and that the Seal of the Corporation be
thereto affixed.
CARRIED
By-law read a first, second and third time and finally passed.
