Council Meeting of December 21st, 1979 (II) ---- --RESOLUTIONS Re~oll.1tiOQ-l¡79 Moved by Councillor Dickerson Seconded by Councillor Geraghty That the petitions dated November 19th 1978 and January 3rd 1979 as submitted by residents of the Lookout Point subdivision regarding By-law 905/78 to change certain street names in Plans M-l017 and M-1135, be received. CARRIED Mrs. June Hall, 567 Creekview Circle, spoke on behalf of the Lookout Point Homeowner's Association to state that a street name change in the Lookout Point subdivision would be costly for the residents, that better sign posting would alleviate the confusion of street names and the "circle" in Broadgreen Circle is not proper because this street is a crescent. 1/79 - 2 - Council directed that a by-law be prepared for the Executive Committee Meeting of January 15, 1979 to change a portion of Broadgreen Street to Broadgreen Circle and a further portion of Broadgreen Street to Petticoat Lane. CARRIED 1/79 - 3 - Resoll.1tiou-6/79 Moved by Councillor Cahill Seconded by Councillor Fisher That the report of the Director of Public Works dated December 22nd 1978 with respect to the installation of a sidewalk on the east side of White's Road from Oklahoma Drive to the property line of Petticoat Creek Park, be adopted; and that provision be made in the 1979 Budget for this project. Boehmer Limited be advised that the Municipality is not prepared to grant them permission to operate a commerc- ial cement batching plant from their present location on the Ontario Hydro property adjacent to the Brock Road, as their present operation is of a temporary nature and contrary to the Town's Zoning By-laws and permitted only to accommodate the construction needs of Hydro Nuclear Station. CARRIED (III). - -.BY....LAWS Councillor Fisher, seconded by Councillor Dickerson moved for leave to introduce By-laws of the Town of Pickering: By....law-Nl.1mber-931/79 Being a by-law to request the Ministry of Housing to make an order under The Planning Act, section 29a, to validate the title to certain lands in Lot 10, Concession 5, Pickering. By....law-Nl.1mber-932/79 Being a by-law to authorize the execution of a Deed between the Corporation of the Town of Pickering and the Regional Municipality of Durham respecting Part Lot 18, Range 3, Broken Front Concession (Part 3, Plan 40R-852; Parts 7 and 8, Plan 40R-3158). By....law-Nl.1mber-933/79 Being a by-law to authorize the execution of a Development Agreement between the Corporation of the Town of Pickering and Bramalea Limited with respect to Part of Lots 29 and 30, Range 3, Broken Front Concession. THIRD-READING Councillor Fisher, seconded by Councillor Dickerson moved that the report of the Committee of the Whole on By-law Numbers 931/79,932/79, 933/79, 934/79, 935/79, 936/79, 938/79 be adopted, and that the said By-laws be now read a Third Time and PASSED and that the Mayor and Clerk sign the same, and the Seal of the Corporation be affixed thereto. CARRIED By-laws read a first, second and third time and finally passed. ALTERNATE-REPRESENTATIVE-FOR-REGIONAL.COUNCILLOR Mr. Roy Fitzgerald addressed Council to state that he felt that Councillor Cahill should be appointed as the alternate representative to Mayor Anderson on the Regional Council because Councillor Matheson is now the Acting Mayor and Ward I does not have direct representation on the Regional Council. The Town Clerk indicated that Mrs. Kay Sayer, on behalf of the Rouge Hills Ratepayers Association, expressed that their group wish to have Councillor Cahill appointed as the alternate representative. Acting Mayor Matheson asked for nominations for the position of alternate representative on the Regional Council. Councillor Fisher nominated Councillor Geraghty Councillor Dickerson nominated Councillor Kitchen. Councillor Kitchen nominated Councillor Cahill. Acting Mayor Matheson asked if all nominees will stand for election. Councillors Geraghty and Cahill agreed to stand for election and Councillor Kitchen declined. 1/79 - 6 - Re501l.1tiou-ll/79 Moved by Councillor Fisher Seconded by Councillor Dickerson That the candidate as alternate representative to Mayor Anderson on the Council of the Region of Durham be chosen by lot. CARRIED The Town Clerk explained that the names "Councillor Geraghty" and "Councillor Cahill" had been typed on separate pieces of card paper of equal size. These ballots with a name. typed on each was then displayed to members of Council. It was further explained that the ballots would then be inserted in a box held by the Town Manager, the box would be agitated and a ballot drawn by the Town Clerk. The ballot pulled from the box would be the alternate representative pursuant to the aforementioned resolution. The ballots were then inserted in the box held by the Town Manager, the box was agitated and the Town Clerk pulled the ballot with the name "Councillor Geraghty". By....law-Number-937/79 Councillor Dickerson, seconded by Councillor Fisher moved for leave to introduce a By-law of the Town of Pickering to appoint a local Councillor of the Town of Pickering as an alternate representative to the Council of the Regional Municipality of Durham to act in the place and stead of Mayor John E. Anderson during his incapacitation and that same be now read a first, second and third time and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. (IV) 1. _.- OTHER-BUSINESS Councillor Kitchen introduced a motion regarding parking on Radom Street. 1/79 - 7 - Re~olutiou-12/79 Moved by Councillor Kitchen Seconded by Councillor Fisher That the motion introduced by Councillor Kitchen regarding parking on Radom Street be considered by Council at this meeting. CARRIED Re~olutiou-13/79 Moved by Councillor Kitchen Seconded by Councillor Fisher Whereas a chronic parking problem exists on Radom Street between the Douglas Ravine and St. Martin's Drive; and Whereas it is desirable for both safety and con- venience to alleviate this problem by providing angle parking at this location; Now therefore the staff is hereby requested to study this possibility and forward their report to Council for consideration. CARRIED 2. Councillor Dickerson stated that there are 586 homeowners in the Glendale subdivision who have appealed their 1978 Assessment for 1979 taxes. Notices of Appeal were delivered directly to the Regional Registrar of the Assessment Review Court in Peterborough today by Gord Chambers, Tax Assessment Committee Chairman and Gail Gray, past president. The Community's mass appeal against last years assessment is to be held in County Court on March 5th and 6th 1979. The residents of the community feel that they are over assessed in comparison to similar properties in the Town of Pickering. 3. Councillor Dickerson introduced the following Notice of Motion to be considered at the Council Meeting of January 22, 1979: NOTICE-Of-MOTION Whereas several requests for assistance have been received respecting the expansion of private parking facilities at Ontario Condominium Corporation #11 (1235 Radom Street); and Whereas those requests have related to the establish- ment, construction and maintenance of a parking facility on lands immediately west of the Condominium Corporation; namely lands owned by the Incorporated Synod Diocese of Toronto (Anglican); and Whereas the Municipality is sympathetic to the needs of the residents of the Condominium Corporation for additional private parking facilities; 1/79 - 8 - Now therefore the Council of the Corporation the Town of Pickering HEREBY RESOLVES AS FOLLOWS: 1. Councillor Dickerson is hereby authorized to advise the residents of Condominium Cor- poration #11 that the Municipality regrets that it is unable to assist them in establishing, constructing and maintaining additional private parking facilities; and 2. The Clerk is hereby directed to advise the Incorporated Synod Diocese of Toronto (Anglican), through its local representative, Reverend Gordon King, of the Municipality's sympathetic position herein and to request that the Incorporated Synod Dioces of Toronto (Anglican) meet with the Board of Directors of the Condominium Corporation to discuss that matter further. 4. Acting Mayor Matheson made the following statement: Recently the Town of Pickering seems to be enjoying a high profile with the local media - the News Advertiser, in my opinion, leading the list. Information and Publicity good or bad is something that is expected by all Ratepayers and in the majority of cases welcomed by all Councils, with the members taking praise for the good and their lumps with the bad. But inaccuracies should not have to be tolerated, by any Member of Council or Town staff. I, as Acting Mayor for the Town of Pickering at this time, feel it is my duty to react to some of the comments and editorials recently circulated. For example: 1. An editorial which appeared in the December 20th issue of the News Advertiser about the purchasing policies of the Town of Pickering - it is nothing unique or new for the Council and staff to consider buying used equipment or shopping around for good deals and a simple check with the Town Manager by editorial staff would have verified this. 2. Editorial, and an article written by Shawn James in the same issue of the Advertiser criticising the Town's Planning Staff, and stating that it was a bureaucratic blunder that caused Mrs. Woitzik needlessly waiting months for official approval of her application. Again, in my view, proper verification of facts would have put a different tone on the article. My information is that at the end of February 1978 the applicant requested that her amendment be deferred until further notice and was subsequently advised that she inform the Town as to when she wished to proceed. In a letter dated October 12, 1978 the applicant requested that her application be presented to Council at their meeting of October 30, 1978, approximately 8 months after her request for a deferment. 1/79 - 9 - 3. Editorial in the Pickering Bay News re Closed Doors where one could take the impression that a meeting was held in camera with the M.T.R.C.A. The fact is it was requested as such by M.T.R.C.A. and placed on the agenda as requested but Council felt it should be in the open and were not prepared to discuss the subject behind closed doors. As to the other innuendos about developers, I and probably other Members of Council would appreciate being further apprised of these instances. As to the identification of matters to be held in closed session, legal matters should also be included. 4. An article appearing in the Oshawa Times, December 19,1978, regarding the Brock Secondary Plan, wherein Councillor Dickerson is quoted as stating his fellow Council Members are "shafting' a group of citizens by callously designating their property in a way that will lower its value. He further states that most of the Members of this Council have been in so long they just rubber stamp these things. Unfortunately, Councillor Dickerson did not name the members he was referring to. As a point of information the recommended Plan has been considered by Council on many occasions during the past two years, and for a Member of Council to make accusations of rubber stamping, is, when one considers the history of this plan, unwarranted. Council has also considered numerous delegations and accommodated various requests from small businesses in order to allow their enterprises to remain which would not have been in conformity with the recommended secondary plan by designating them Associated Industrial Uses, but in my view and professional staff, one has to use caution as to the amount of land designated Associated Industrial. It would be something new and unique in Planning if Council came to a Planning decision wherein at least one individual or property owner did not feel they were unjustly treated or to quote "shafted". Perhaps by the end of this term maybe the majority of this Council will arrive at an affirmative decision on a major Planning recommendation where no person will feel wronged, or unjustly treated - after three terms I have yet to see it. As well other inaccuracies can be identified in this article. 5. In regard to rubber stamping, I hope no Member of this Council, the media, or the residents of our Town ever confuses rubber stamping with efficiency. Decisions can be made with little or no debate by Council when recommendations are supported by well researched documentation and information from a highly skilled staff, whom are an asset and credit to Council and the residents of the Town of Pickering. The only rubber stamp that I am aware of in this Council Chamber is the one in the Clerk's possession for a recorded vote. 1/79 - 10 - Hopefully the preceding statements will clarify some of the articles and editorials that have recently appeared in the media and in future inaccuracies and misconceptions will be avoided. The Town Manager or any Member of Council can easily be contacted for the other side of the story, but I would stress that the media at least do a bit deeper research, and fully inform the public as to the complete situation. All Council Members may not agree with any or all of these statements, and if the press desires further clarity or elaboration, I can and will make myself available. In closing, I hope that this Council will work together as have Councils in the past, for the betterment and future of our Town. (V)_.
